HomeMy WebLinkAboutTigard Tualatin School District - SRTS Equipment Agreement - IG273002 IG273002 City of Tigard Safe Routes to School Equipment Usage Agreement This Equipment Usage Agreement (Agreement) is made and entered into by and between the City of Tigard ("City") and Tigard-Tualatin School District ("Borrower").The entities listed above may collectively be referred to as the Parties. I. PURPOSE The purpose of this Agreement is to document a framework of cooperation in the Safe Routes to School Program ("SRTS") that is being developed and run by the Parties for the benefit of the youth and the community to ensure educational knowledge is provided to all economic levels and to provide a safer environment while youth are traveling to and from school, through education and training. II. CITY RESPONSIBILITIES City will: A. Transport the Equipment to and from City of Tigard facility. B. Administer and staff the Safe Routes to School Programs at the locations referenced in Exhibit B. C. Maintain the equipment listed on Exhibit A (the "Equipment") to this Agreement for the purpose of providing quality education and safety training for proper bike and kick scooter usages. D. Provide curriculum as part of SRTS that may be used by the Borrower. E. Schedule events for SRTS,including training and use of Equipment. III. BORROWER RESPONSIBILITIES Borrower will: A. Allow use of the Equipment in a safe manner that minimizes the risk of injury or damage to persons and property. B. Agree to follow City's scheduling process for the Equipment. C. Make any repairs to Equipment damaged while in Borrower's possession or as a result of Borrower's activities. This does not apply to damage resulting from normal wear and tear of Equipment. D. Secure the Equipment when not in use. IV. GENERAL TERMS A. TERM. This Agreement is effective upon the date last signed by the Parties and will continue until July 1,2027,unless otherwise amended or terminated. This Agreement may be terminated upon 30 days'written notice to the other Party. B. INSURANCE. Each Party agrees to maintain Auto, General Liability, and Workers Compensation insurance or self-insurance in accordance with ORS 30.282, for the duration of this Agreement at levels necessary to protect against public body liability as specified in ORS 30.269 through 30.27. Page 1 C. INDEMNIFICATION. This Agreement is for the benefit of the Parties only. Each Party agrees to indemnify and hold harmless the other Party, and its officers, employees, and agents, from and against all claims, demands and causes of actions and suits of any kind or nature for personal injury,death or damage to property on account of or arising out of services performed, the omissions of services or in any way resulting from the negligent or wrongful acts or omissions of the indemnifying party and its officers, employees and agents.To the extent applicable, the above indemnification is subject to and shall not exceed the limits of liability of the Oregon Tort Claims Act (ORS 30.260 through 30.300). In addition, each Party shall be solely responsible for any contract claims, delay damages or similar items arising from or caused by the action or inaction of the Parties under this Agreement. D.DAMAGE TO PROPERTY. The Equipment is the property of the City. The City will insure the Equipment from covered causes of loss at all times. However,individual losses concerning items damaged,stolen or misplaced under City's insurance deductible of$1,000 will be the responsibility of the Party in control of the Equipment at the time of the loss. Value of damaged,stolen or misplaced items will be determined based on replacement cost for items of like kind and quality as determined by the City. E. MODIFICATION. Modifications to this Agreement may be made by mutual consent of the Parties,in writing,prior to any changes being performed. Exhibits to this Agreement may be added, revised or deleted by the consent of both Parties' Project Managers without modifying this Agreement. G.DISPUTE RESOLUTION. The Parties will attempt to informally resolve any dispute concerning any Party's performance or decisions under this Agreement, or regarding the terms, conditions or meaning of this Agreement.The Parties agree that in the event of an impasse in the resolution of any dispute,the issue will be submitted to the City Manager and Borrower's chief executive for recommendation or resolution. The Bike Rodeo includes a bike safety inspection and a series of skill stations directly related to everyday bicycling situations. Participants will practice starting and stopping.The safe way to exit a driveway,how to look for traffic,negotiate an intersection,and avoid common road hazards. Participants can bring their own bike and helmet or use a bike and helmet from the Safe Routes to School Fleet. Open to the public at no cost. • Pedestrian + Scooter Safety Education (2nd Grade): Elementary schools have the opportunity to include a Pedestrian + Scooter Safety Education course for their 2nd grade classes. The course includes a mix of classroom and outdoor lessons, spanning roughly one week. The Safe Routes to School Coordinator will collaborate with a teacher at each partner school to present the lessons, and The City of Tigard will loan scooters to each school from its fleet. The purpose of the course is to provide students with the basic knowledge and skill practice necessary to be safe pedestrians,while also building foundational handling skills to support their development as cyclists. • Bike Safety Education(5th Grade): Elementary schools have the opportunity to include a Bike Safety Education course for their 5th grade classes. The course is flexible and will include a mix of classroom and outdoor lessons, spanning roughly one to two weeks. The Safe Routes to School Coordinator will collaborate with a teacher at each partner school to present the lessons, and The City of Tigard will loan bikes to each school from its fleet. TIGARD Release and Consent Form Dear Parents/Guardian, Your child has been given the opportunity to participate in the Bicycle Safety Education Program at your school.The Program is an award-winning,comprehensive curriculum offered by The Tigard-Tualatin School District in partnership with the City of Tigard Safe Routes to School Program that will teach traffic safety through classroom activities and on-the-bike skills practice.Students will learn skills such as helmet use,hand signals,traffic signs,and maneuvering through intersections and out of driveways.The bicycle training will be presented on the school grounds and may also incorporate travel on surrounding community streets,led by The City of Tigard's Safe Routes to School Coordinator,teaching staff,and school volunteers. Participants must agree to follow the rules set out in class,on school grounds,and on any rides that occur off campus in order to stay as safe as possible. The purpose of the Bicycle Safety Program is to teach safety and skills in an effort to reduce the risk of bicycle injuries.However all travel involves the chance of an accident that may result in serious injury or death.The City of Tigard,The Tigard-Tualatin School District,volunteers,participants,and family helpers cannot eliminate the chance that a participant may be injured in spite of taking every effort to be safe. Participating families must assume any and all risks and hazards associated with this program by signing a release and waiver of rights contained below in exchange for being allowed to participate All participants must have this consent and release form signed by a parent or legal guardian.The following conditions apply: 1. All participants will be taking part in physical activity,mainly cycling.Individuals in average health will be able to comfortably participate;it shall be each individual's responsibility to be sure they are in a healthy condition. 2. Bicycle riding will occur both on the school grounds and on-streets, therefore, all activities are potentially dangerous. Participants must adhere to the rules set out in class in order to assume responsibility for their risk. 3. Neither the Tigard-Tualatin schools nor the City of Tigard will assume legal liability for any program participants.Participants must possess their own. 4. If my child is taking the course using his/her own bicycle and/or helmet I agree to inspect the bicycle and/or helmet prior to the course to ensure these items are safe for my child's use.
