HomeMy WebLinkAboutTigard-Tualatin School District Safe Routes to School 2026-2029 - IG273001 IG273001 INTERGOVERNMENTAL AGREEMENT City of Tigard and Tigard-Tualatin School District Safe Routes to School (SRTS)2026-2029 THIS INTERGOVERNMENTAL AGREEMENT(AGREEMENT) is made and entered into by and between the City of Tigard, hereinafter referred to as the "City," and the Tigard-Tualatin School District, hereinafter referred to as "TTSD."The entities listed above may collectively be referred to as the "Parties." PURPOSE The purpose of this Agreement is to document a framework of cooperation in the Safe Routes to School ("SRTS") Program that is being developed and run by the Parties for the benefit of our youth,their families, and the broader community.The Parties will partner to deliver a SRTS Program ensuring safe pedestrian, scooter, and bike education is provided to students of all backgrounds, delivering a safer environment for youth traveling to and from school, and encouraging the use of transportation options that prioritize community health and shared climate goals. RECITIALS 1. The Parties understand the importance of having safe, accessible routes for students to travel to and from school. 2. The Parties agree that every child who wants to walk, roll, or take school buses or transit to school should know how to do so safely through SRTS education. 3. The Parties recognize the vital importance of SRTS's efforts to increase the number of students who safely walk, bike, roll,take transit, and carpool to school.These efforts yield the following benefits: decreased traffic congestion and improved traffic safety, improved health and fitness, increased physical activity, increased independence, improved neighborhood livability, increased alertness and academic achievement, and improved air quality. 4. The Parties recognize the importance of collaboration in supporting families' ability to choose from a range of transportation options. 5. Strong partnerships and commitments from TTSD are required to develop, promote, and implement effective SRTS programs. 6. The Parties recognize the need for individual school transportation plans. 7. The Parties understand that the way students travel to and from school is connected to the City's and District's climate goals. 8. The Parties acknowledge that the program and administrative support systems impose administrative and infrastructure costs on both Parties. 9. The Parties agree that the responsibilities listed here represent the basic requirements for achieving SRTS Program goals and objectives for the 2026-2029 academic years. TASKS AND DELIVERABLES 1. Task 1:TDM Policy, Planning and Funding TTSD Deliverables: Page 1 of 6 • TTSD will provide feedback and participate in any necessary or desired walking audits and also allow access for the coordinator and other supporting staff to be on site to assess conditions during drop-off and pick up hours. • TTSD will notify the SRTS Coordinator when seeking support to address student-focused campus access issues, especially those impacting students walking, rolling, and biking to campus. TTSD will provide details as requested by City staff regarding the concern. • TTSD will partner with the SRTS Coordinator to develop a survey implementation plan to collect annual student travel/modal data. • TTSD Core Group members will provide feedback on proposed content,timing, and appropriate distribution channel to facilitate timely communication to partner TTSD staff, in addition to facilitating distribution through the appropriate channels. • TTSD will look to partner with the City where possible to advocate for the integration of K- 12 traffic safety education into ODE standards. • TTSD will provide the SRTS Coordinator with timely feedback about the efficacy of SRTS resources and tools, including feedback about proposed changes and additions to existing resources and tools. City Deliverables: • The City will create action plans at three schools and coordinate with TTSD and internal and external partners. • The City may attempt to obtain grant funding to make needed infrastructure improvements in school catchment areas. Further,the City will involve appropriate staff in evaluating and responding to the request, including but limited to the SRTS Coordinator, Planning staff, and Engineering staff. • The SRTS Coordinator will partner with TTSD to develop a survey implementation plan to collect annual student travel/modal data. • Prior to the start of each school year,the City will bring to the Core Group the appropriate SRTS content and timeline for communicating with TTSD staff. The plan can be covered via email correspondence to account for busy summer schedules and the reality of no standing expectation of a summer Core Group meeting. • The City commits to partnering with regional and state partners to advocate for the integration of K-12 traffic safety education into ODE standards. • The SRTS Coordinator will collaborate regionally with program partners and other SRTS Coordinators to learn best practices and share regional resources with TTSD. Further, the SRTS Coordinator will conduct timely and thorough searches of additional SRTS-related resources and tools in response to requests from TTSD. 2. Task 2:Financial Incentive Programs TTSD Deliverables: • Upon request by the SRTS Coordinator, building-level TTSD administrators will identify student needs that necessitate access to adaptive bikes and scooters. Building-level TTSD administrators will communicate the relevant information to the SRTS Coordinator in a timely manner to support the Coordinator in attempting to acquire the appropriate Page 2 of 6 equipment, either through City owned stock or by partnering with Cycle Oregon or another area bike non-profit. • The Core Group will provide feedback on potential incentive programs the SRTS Coordinator surfaces as possible options for use in TTSD schools. • Where helpful, the Core Group will facilitate ongoing communication between staff in the Family Resource Center and the SRTS Coordinator to further fortify this burgeoning partnership. City Deliverables: • When furnished the relevant information by TTSD building-level administrators,the SRTS Coordinator will make every reasonable effort to acquire the equipment best suited to meeting each student's identified needs. • The SRTS Coordinator will research different types of incentive programs to present to district partners, both in the Core Group, and at the building level. The SRTS Coordinator will support district staff in designing and implementing incentive programs wherever interest surfaces. • The SRTS Coordinator will proactively reach out to the Core Group and identified contacts at the Family Resource Center to continue growing the partnership between the FRC and the City's SRTS program. 3. Task 3:Place and Event Based Programs TTSD Deliverables: • TTSD will work with its Teaching and Learning Department,the SRTS Coordinator, and individual elementary schools to promote both 2nd Grade Pedestrian & Scooter Education and 5th Grade Bike Safety Education. • TTSD staff will promote bike rodeo messaging through internal channels. • TTSD will provide feedback and participate in any necessary or desired walking audits and also allow access for the coordinator and other supporting staff to be on site to assess conditions during drop-off and pick up hours. • TTSD will work with the SRTS Coordinator to develop a clear process for the school's PTA/PSO groups to encourage the implementation of Walking School Buses and Bike Trains. • TTSD will provide a venue to host crossing guard trainings and, when requested, help facilitate communication to district partners. • To complete a formal bike parking audit,TTSD building-level administration will grant the SRTS Coordinator access to their respective campuses according to an agreed upon timeline. District-level administration will facilitate that communication where requested, such as by furnishing the correct contact information for a given building-level administrator. City Deliverables: • The SRTS Coordinator will teach 2nd Grade Pedestrian and Scooter Education and 5th Grade Bike Safety Education at elementary schools that opt-in to the program offering. Unless otherwise requested by TTSD staff, education will be provided by the SRTS Coordinator, with Page 3 of 6 support from school faculty. Trainings will include access to a fleet of City bikes for student use along with free helmets for all participants. • The SRTS Coordinator will conduct all bike rodeos and promote them with advance notice to TTSD to amplify turnout among TTSD students. • The City will create action plans at three schools and coordinate with TTSD and internal and external partners. • The SRTS Coordinator will provide best practices and known strategies as well as support when possible with Walking School Buses and Bike Trains. • The SRTS Coordinator will offer and conduct at least one annual Washington County Crossing Guard Training open to all TTSD schools. Schools can opt-in to the training dependent on need. • The SRTS Coordinator will communicate with building-level and district-level administration to align on appropriate timelines to visit each campus and conduct a bike parking audit. 4. Task 4:Community-Centered and Inclusive Programs TTSD Deliverables: • When requested by the SRTS Coordinator, district staff will respond to surveys regarding incentives to help the SRTS coordinator best direct their efforts and resources in support of students. • When available, school-based staff will provide adequate short-term storage,time, and staffing to support helmet distribution. • If elementary schools opt in to optional K-1 Early Bike Education utilizing Metzger's 'All Kids Bike' Strider Fleet,TTSD will support the SRTS Coordinator and will promote in the respective school. City Deliverables: • The SRTS Coordinator will continually evaluate which incentives are most popular with students and ultimately purchase and distribute incentives that enhance student safety. • The SRTS Coordinator will furnish each student who participates in a school-based training with a free and properly fitted helmet as stock permits. • Upon fleet availability and school interest,the SRTS Coordinator will facilitate sharing Metzger's "All Kids Bike" Strider Fleet between elementary schools that opt-in to the program offering and support program development and implementation. GENERAL TERMS 1. Liability and Indemnification. Subject to the limitations of liability for public bodies set forth in the Oregon Tort Claims Act, ORS 30.260 to 30.300, and the Oregon Constitution, each party agrees to hold harmless, defend, and indemnify each other, including its officers, agents, and employees, against all claims, demands, actions and suits (including all attorney fees and costs) arising from the indemnitor's performance of this Agreement where the loss or claim is attributable to the negligent acts or omissions of that party. Page 4 of 6 2. Termination. Any party herein shall have the right to terminate its participation in this Agreement for any reasons whatsoever upon giving the other party thirty(30) days written notice in advance of the date sought for such termination. 3. Assignment/Subcontracting. No party to this agreement shall transfer or assign, in whole or in part, any right or obligation created under this Agreement. 4. No Third-Party Beneficiary. By execution of this Agreement,the parties do not intend there be any third-party beneficiary of the rights or obligations created herein. 5. Non-Discrimination. In the exercise and enjoyment of authority under this Agreement, no party shall discriminate against any personnel because of age, sex, race, creed, religion, color, national origin, marital status, pregnancy,veteran status, any physical, mental or sensory disability, or actual or perceived sexual orientation or any other discrimination prohibited by federal or state law. 6. Entire Agreement.This Agreement contains all of the agreements of the parties with respect to the subject matter covered or mentioned therein and no other prior agreements shall be effective to the contrary. 7. Amendment.The provisions of this Agreement may be amended with the mutual consent of the parties. However, no additions to, or alterations of,the terms of this Agreement shall be valid unless made in writing and formally approved and executed by the parties. 8. Insurance. Each party agrees to maintain insurance levels or self-insurance in accordance with ORS 30.282,for the duration of the Agreement at levels necessary to protect against public body liability as specified in ORS 30.269 through 30.274.
