HomeMy WebLinkAboutOrdinance No. 26-11 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL ORDINANCE NO. 26- 0U AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE 2.40 REGARDING ELECTION FILING PROCEDURES WHEREAS,with the adoption of the new City Charter in 2025,there is no longer a requirement for a seated Council member to resign their seat in order to run for the office of Mayor; and WHEREAS, state law now requires an incumbent to file at least 7 days prior to the standard filing deadline if running again for the same office; and WHEREAS, this ordinance amends Tigard Municipal Code 2.40 to reflect these updates in Charter and statute. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Tigard Municipal Code Chapter 2.40 is amended as shown on Exhibit A(additional text in underline and deleted text in strik ough) SECTION 2: This ordinance shall be effective 30 days after its passage by the council, signature by the mayor, and posting by the city recorder. Date ORDINANCE NO. 26- of Page 1 Exhibit A 2.40.010 Petition—Form. 1. The form of nominating petition for all candidates for elective positions within the City shall must substantially conform to the form designated by the Secretary of State. 2. A prospective candidate to an elective city office,hall be by must submit a petition signed by at least 20 qualified electors who arc.Such qualified electors shall be duly registered voters under the laws of Oregon and shall-be currently eligible to vote at any regular or special election of the City of Tigard. 3. A person filing a nomination petition shall must pay a fee, which `hall be tendered at the time of filing the completed nomination petition form with the City Recorder. The fee amount will be set by Resolution of the Tigard City Council. 2.40.020 Certificate of Nomination. The City Recorder will certify the nominations to County Elections, in accordance with the time and content requirements of state law, in addition to stating the offices and the terms of office for which the candidates are nominated.The City Recorder will prepare and deliver a certificate of nomination to each qualified candidate nominated. 2.4 030 Filing Date3 "sr. shall be the thirty first day preceding the date the City Recorder is required by law to transmit to the County Clerk a list of the offices to be filled and the names of the persons to appear on the ballot; and shall submit a resignation in the form required by the Charter; and 1. 2. For an incumbent holder of a public office who intends to seek reelection for an additional term of the same public office, a completed nomination petition for candidacy must be filed with the City Recorder no earlier than 120 days and no later than 77 days before the election. An incumbent candidate who was appointed to the public office to which they are seeking election is subject to the same filing deadline as non-incumbent candidates. Within five days after receiving a completed nomination petition, the City Recorder will verify the signatures. Upon verification that the signatures are valid, the City Recorder will provide a form to the nominee stating that the correct number of signatures have been submitted and that the signatures are valid. 2. Within five days after receipt of the form from the City Recorder verifying the petition is valid, the nominee must accept or decline the nomination. 2.40.050 Filing Dates—Extension In Case of Weekend or Holiday. In the situation where one of the dates listed in Sections 2./10.030 and 2.10.010 Section 2.40.045 falls on a weekend or legal holiday, the time will be extended to /1:00 p.m. on the following workday; however, this extension skull does not change any of the other prescribed dates.
