TIGARD CITY COUNCIL
ORDINANCE NO. 26- 10
AN ORDINANCE REPEALING TIGARD MUNICIPAL CODE CHAPTER 5.16 REGARDING SOUND TRUCKS
WHEREAS, Tigard Municipal Code Chapter 5.16 was adopted in 1981 to address the threat to peace and
comfort caused by the use of sound amplifying equipment operated as mobile units from trucks and cars;
and
WHEREAS, the requirements of this ordinance, including pre-registration with the City Recorder, raises
concerns about the constitutionality of the ordinance and its public purpose; and
WHEREAS, the repeal of this chapter will not limit the City's ability to enforce existing noise regulations.
NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Tigard Municipal Code Chapter 5.16 is deleted in its entirety, as shown on Exhibit A.
SECTION 2: This ordinance shall be effective 30 days after its passage by the council, signature by the
mayor, and posting by the city recorder.

Exhibit A
For the purposes of this chapter, the words set out in this section shall have the following
meanings:
"Person" includes the singular and the plural and also means and includes any person, firm,
corporation �osociation cl rh partnership societr nr any other form of ssociation or

organization.
"Sound amplifying equipment "means any machine or device for the amplification of the human
voice, music or other sound.
"Sound amplifying equipment" shall not be construed as including standard automobile radios
when used and heard only by occupants of the vehicle in which installed or warning devices on
authorized emergency vehicles or horns or other warning devices on other vehicles used only for
traffic safety purposes.
"Sound truck" means any motor vehicle, horse drawn vehicle or other vehicle having mounted

No person shall use, or cause to be used, a sound truck with its sound amplifying equipment in
operation in the City of Tigard before filing a registration statement in writing with the City
(1) Name and home address of applicant;
(2)Address of place of business of applicant;
(3) License number and motor number of the sound truck to be used by applicant;
(4) Name and address of person who owns the sound truck•

(5) Name and address of person having direct charge of the sound truck;
(6) Names and addresses of all persons who will use or operate the sound truck;
(7) The purpose for which the son end trr uck will be r used;

(10) The number of days of proposed operation of the sound truck;
(11)A general description of the sound amplifying equipment which is to be used;
(12)The maximum sound producing power of the sound amplifying equipment to be used

All persons using or causing to be used, sound trucks, shall amend any registration statement
filed pursuant to Section 5.16.020 within forty eight hours after any change in the information
therein furnished.
The City Recorder shall return to each applicant under Section 5.16.020, one copy of the
registration statement duly certified by the City Recorder as a correct copy. The certified copy of
the application shall be in the possession of any person operating the sound truck at all times
shown to any policeman of the City of Tigard upon request.
Use of sound trucks in the City of Tigard with sound amplifying equipment in operation shall be
subject to the following regulations:
{1) The only sounds permitted arc music or human speech;
when no operations shall be authorized. The permitted four hours of operation shall be
four thirty p.m. and six thirty p.m.;
must be operated by a person other than the driver of the sound truck;

(6) The human speech and music amplified shall not be profane, lewd, indecent, or
slanderous;
{7) The volume of sound shall be controlled so that it shall not exceed sixty DBA at any
distance one hundred feet or more from the sound truck, and so that the volume is not
