We purchased the condo above Ms. Kosche's in May 2025. Beginning in August 2025, we commenced a remodel of the condo, which included the following: - Removal of existing carpet and padding. The carpet and padding that was removed was standard quality and thickness (see attached picture), not the three inches of material that Ms. Kosche claims was removed. - Installation of COREtec brand luxury vinyl plank flooring throughout, which features a sound-deadening layer of cork on the underside of each plank. Each plank is 0.315" thick. Prior to commencing the remodel, we consulted with the Fountains HOA to ascertain if any regulations existed that we needed to be aware of. The response was limited to the requirement that any window replacements be of "black" or "bronze" color facing the exterior of the building. All of the work was done by a licensed contractor, Kolt Construction, LLC, Oregon Lic. #247509. Address: 11265 SE 30th Ave, Milwaukie, OR 97222. Phone: 503-481-0666. All construction was completed by early September 2025, with the exception of one window. There were no complaints from Ms. Kosche until January 2026. I assure you that we did not "alter or change" the original construction of the unit. can't imagine that replacing carpet with vinyl plank would qualify as an alteration of the original construction. In an effort to mitigate any "noise" that Ms. Kosche may be experiencing, we have installed area rugs in approximately 75-80% of the condo with "soundproofing" padding underneath (https://a.co/d/04ZCId0C). This, in theory, would enhance soundproofing compared to the previous state of the unit, as the LVP would add an additional layer beneath the rugs and pads. We remove our shoes and only wear soft-soled slippers or socks inside. We do not have pets. We are uncertain how it is possible that we are engaging in any activities that could cause such significant "disturbance." During a joint meeting with the HOA and Ms. Kosche regarding this matter, the HOA indicated that many owners of upper units have installed LVP flooring, and there has not been a single complaint from the owners of the units below. I have copied the Fountains HOA on this letter for their input as well.
