HomeMy WebLinkAboutOrdinance No. 26-04 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL ORDINANCE NO. 26-b y AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE CHAPTER 7.48 REGARDING SPECIAL EVENT PERMITS WHEREAS, Tigard Municipal Code Chapter 7.48 regulates special event permits issued by the City; and WHEREAS, as a result of past confusion, the City wishes to clarify that any traffic control plan is the responsibility of the applicant; and WHEREAS, due to resource constraints, the City is unable to provide public works or police support to special events and therefore wishes to remove such reference from the code. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Tigard Municipal Code Section 7.48.030 is amended as follows (new text in and underline, deleted text in striketla-r-em-g-h): A person who seeks to use public right-of-way or city property for a special event must apply for a permit on the form provided by the city and include any applicable fees. The city-provided form will require, at a minimum, the following: C. The location of any streets or intersections where the applicant proposes to restrict access by pedestrians or vehicles and a traffic control plan. In its sole discretion, the City may require the traffic control plan be prepared by a professional traffic engineer, such as when the street closure includes an intersection or otherwise has more than a de minimis impact on the street system. The traffic control plan must address likely traffic impacts resulting from the proposed special event and demonstrate compliance with the requirements of the Americans with Disabilities Act. City approval is necessary prior to the City issuing a special event permit. SECTION 2: Tigard Municipal Code Section 7.48.050 is amended as follows (new text in and underline, deleted text in £trikcthrough): ORDINANCE No. 26-0-I Page 1 B-: If the applicant requests police or public works services for the special event, the permit must include an agreement to reimburse for such services or to provide up front payment. The agreement will be on a form approved by the city. SECTION 3: If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity does not affect the other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. This City Council hereby declares that it would have adopted this ordinance irrespective of the invalidity of any particular portion thereof and intends that the invalid portions should be severed and the balance of the ordinance be enforced. SECTION 4: This ordinance is effective 30 days after its passage by the council, signature by the mayor, and posting by the city recorder.
