HomeMy WebLinkAboutOrdinance No. 26-01 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL ORDINANCE NO.26- 0 AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE CHAPTER 5.20 REGARDING THE RECOMMENDING BODY FOR LIQUOR LICENSES WHEREAS,the City of Tigard is in the process of modernizing its enterprise systems across the City, including a new permitting system known as Enterprise Permitting and Licensing (EPL);and WHEREAS, through implementation of EPL, the City identified process improvements related to the review of liquor license applications to the Oregon Liquor and Cannabis Commission; and WHEREAS, the current code states that the Chief of Police is the sole representative of the City who is responsible for reviewing and making recommendations on liquor license applications; and WHEREAS, the proposed change allows for a designee to perform this work when the Chief of Police is unavailable to do so; and WHEREAS, the proposed change also aligns with the business license application process managed by the Finance Department and configured for EPL. NOW, THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Tigard Municipal Code Chapter 5.20 is amended to read as follows (new text in bold and underline, deleted text in strik ): 5.20.010. Review of Applications. Review of all new liquor license applications and annual renewal applications will shall be made by the Tigard Chief of Police or designee.Applications for all reviews will shall be made thirty days prior to initial use or expiration date of licenses. 5.20.020. Temporary Liquor License—Time Limitation. Application for all temporary liquor licenses will,hall be made to the Chief of Police or designee. All temporary liquor licenses will shall be in effect for not more than one twenty-four-hour period. 5.20.040. Appeal Process. In the event the Chief of Police or designee issues a recommendation of denial to the Oregon Liquor Control Commission (OLCC), he or she will shall first notify the applicant in writing of their his intent to issue a recommendation of denial within three working days of receipt of the application. The notification will shall include the reason(s) for the intent to recommend denial and a date and time within the next five working days to hear the applicant's appeal, if any.The applicant has shall have the right to be heard and to present witnesses and evidence purporting to refute the reasons ORDINANCE No.26- 0 I Page 1 given by the Chief of Police or designee for a recommendation of denial. The hearing will&hall be administrative in nature and held before the Chief of Police or designee. Rules of evidence do shall not apply. Upon completion of the hearing,the Chief of Police or designee will shall make a finding and shall mail the final recommendation to the OLCC and the applicant within three working days of the hearing date. SECTION 2: This ordinance is effective 30 days after its passage by the council, signature by the mayor, and posting by the city recorder.
