Call to Order The meeting was called to order at 7 p.m. 2. Approve Minutes of December 27, 1993 Meeting Commissioner Froude motioned to accept the meeting minutes as submitted and Commissioner Pedersen seconded the motion. A voice vote was called for and the motion passed unanimously. 3. Report on Transition Discussions with City of Tigard George Mardikes, Attorney and Commissioner Morgan reported to the Board on their recent meeting with City of Tigard personnel regarding several issues of concern to the Tigard Water District. As a result of that meeting, assistance to the Board in the preparation of a budget was offered. After a brief discussion regarding the budget process, Chair Haunsperger motioned to nominate Lou Ane Mortensen as Tigard Water District's Budget Officer and Commissioner Morgan seconded the motion. A voice vote was called for. The motion passed unanimously with Lou Ane Mortensen abstaining. 4. TWD Transition Responsibilities and Assignments The Board members then discussed the need to reduce legal costs and the dependency on legal counsel's involvement in Board activities. This underscored the district's dependency on support services particularly administrative, accounting, engineering and staff assistance. In addition, the March 31, '94 deadline for the boundary and map changes required for the debt allocation was reviewed and the process to obtain conservative assistance to undertake the division of assets. The financial responsibility of the audit of the Joint Water Agency for July 1, 1993 through December 31, 1993 was briefly discussed. s Tigard Water District Page Two January 10, 1994 5. Priorities of TWD as Member of Intergovernmental Water Board Commissioner Morgan suggested a development of a work program and the establishment of TWD Board priorities for participation in the Intergovernmental Water Board. The following areas were addressed: • Capital Improvement Program (June 30, 1994 deadline) • Water Supply Contract • Asset Allocation • Rate Structure • Water Rules and Regulations • Regional Water Supply Groups 6. Determine Schedule of Board Meetings The Board scheduled future meetings for the first Monday of each month at 7 p.m. with the next meeting February 7, 1993. 7. Chair's Comments Chair Haunsperger thanked Attorney Mardikes and Commissioner Morgan for their time and effort in meeting with city personnel on behalf of the TWD Board. Chair Haunsperger then thanked Leslee Gemmill for her continued support and wished everyone a happy new year. 8. Board of Commissioner's Comments Commissioner Morgan expressed his opinion for a cooperative Board effort and remarked about the importance of reading, understanding and following the Intergovernmental Agreement. 9. Other Business Commissioner Morgan verbalized the need for the Board to be kept informed by the water department on the work accomplished in the unincorporated area. There was brief conversation regarding ways of informing the public that the TWD Board has entered into an agreement with the City of Tigard to represent the unincorporated area residents in water related issues. One way to inform the public is on their water bills. Chair Haunsperger asked Leslee to assist with putting something appropriate together for the Board to review. 10. The request is for qualified consultants to submit a proposal to determine for the water system what assets and liabilities are necessary for system operation and what are not necessary. The consultant will then allocate non-system assets and a proportionate share of system assets to the Tigard Water District, City of Tigard, City of King City, and City of Durham. The allocation of system assets shall be according to the formula agreed upon in the Intergovernmental Agreement. I suggest that the RFP be published in the Daily Journal of Commerce on February 17, 1994, and be sent to at least the following consultants: • Economic and Engineering Services, Inc. • Murray, Smith and Associates, Inc. • Montgomery Watson • CH2M Hill I have not received any suggestions from King City of Durham. attachment H:\login\John_A\TWORFP.mmo TIGARD WATER DISTRICT DRA ll REQUEST FOR PROPOSALS ASSET AND LIABILITY DIVISION REQUEST FOR PROPOSALS The Tigard Water District requests proposals from qualified consultants to classify and allocate assets and liabilities among the Tigard Water District, the City of Tigard, the City of King City and the City of Durham. The objective of this project is to identify assets and liabilities of the water district and classify them as being essential to the water system or unique to a particular entity. Those that are essential to the water system will be apportioned according to a methodology that has been agreed upon by all entities . The District proposes to contract with a qualified consultant to perform services outlined in the Scope of Work. The successful consultant shall have demonstrated expertise in water distribution systemoperation, engineering and financial analysis of water systems, infrastructure assessment, and experience working with a public agency. The successful consultant will work closely with water staff . BACKGROUND The original Tigard Water District provided water service to the Cities of Tigard, King City and Durham as well as areas of unincorporated Washington County. In 1993, the Cities of Tigard, King City and Durham withdrew the territory within their respective boundaries from the Tigard Water District. Operation of the water system has been assumed by the City of Tigard through intergovernmental agreements with all entities . The system will remain intact and be operated as a single system. ORS 222 .540 (4) requires that the district divide assets and liabilities when there is a withdrawal . The intent is to allocate assets and liabilities to the appropriate jurisdiction, but not to phisically separate the system. Methodology for asset and liability allocation has been agreed to by all entities and is identified in the intergovernmental agreements. SCOPE OF WORK 1. The consultant shall, with the help of water staff, identify all real, personal and intangible property. Intangible property includes moneys, checks, deposits, interest, dividends and income. 2 . The consultant shall classify assets into the category of system assets for those that are necessary for operation of the water supply system throughout the service area, or other assets which are not necessary for system operation. 3 . Jurisdictions proportionate share of system assets shall be determined in the following manner: Jurisdictions proportionate interest = (A+B+C) /3 A = Jurisdiction's percentage of current consumption in original district B = Jurisdiction's percentage of current real market value in original district C = Jurisdiction's percentage of current meters in original district 4 . Other assets shall be determined to be the property of the jurisdiction in which it is located. VI . Products The consultant shall deliver to the Tigard Water District at a minimum a detailed plan for asset/liability allocation that includes: • A report that describes the work accomplished, assumptions made, sources of information, methodology and conclusions. • A detailed map and/or list of system assets • A clear identification of each jurisdiction's proportionate share of system assets • A Detailed map and/or list of other assets for each jurisdiction • All background material, working material and interim products • Any mapping shall be high quality and legible for use in determining specific site information. Final maps and graphic material shall be provided in digital form compatible with Autocad or Arc/Info. EXISTING REPORTS/INFORMATION TO BE PROVIDED TO THE CONSULTANT BY THE DISTRICT 1 . PROJECT SCHEDULE Selected consultants may be interviewed by a panel during the week of March 14, 1994 . The consultant should be prepared to start on the project immediately after execution of contract materials. The project will be completed within 90 days . SUBMITTAL REQUIREMENTS The City requires that interested consultants submit five copies of their proposal for meeting this request . The proposal should include: 1 . Description of prior experience and references of one or more governmental entities for which the respondent has prepared a similar plan. Include the name of the organization, a contact person, and a telephone number. 2 . Scope of services that describes the services to be rendered including methodology, estimated time frame, number of hours and staffing for completion of each task. 3 . Name and qualifications for all individuals who will perform work on the project including any sub-consultants. Include the estimated hours to be spent on the project by each individual and the hourly rate for each. 4 . Total fee for each task, itemized on an hourly basis that includes: - Amount of time, hourly rate, and budget to be expended by each staff member; - Amount of budget allocated to materials and expenses . 5. Statement regarding ability to start and complete the project within the defined time frame. 3 6 . If subcontractors are part of the proposal, a statement regarding experience in similar joint projects and how this project will be coordinated. CONTRACT REOUIREMENTS The Tigard Water District's standard form of contract shall be used for this project . The consultant will be required to carry insurance in the types and amounts specified by the District in the contract . BASIS OF AWARD A consultant will be selected on the basis of their experience and qualifications as stated in the proposal, demonstrated in previous work and as determined in subsequent interviews. Factors that will be especially considered include: - Responsiveness to this RFP - Quality of methodology to be used - Recent experience in performing similar services and special knowledge pertinent to this project - Ability to perform all aspects of the project within the stated timeframe - Qualifications of key personnel who will carry out project assignments The District may, at its discretion, choose to proceed with only selected work tasks, or all work tasks described in the proposal. Usually this is not a problem, however, these two properties are located just outside of the Water Department's service area on SW 131st Avenue south of SW Fischer Road, which is also outside of the Urban Growth Boundary(UGB). Both properties are vacant, having no existing house, and are adjacent to properties outside of the service area which are already being served with public water. The last property in this area to gain water service is Tax Lot 1400, 2S 1 16DC. There are several items to consider before making a recommendation. In October 1992, the Tigard Water District passed a resolution that established a policy on granting extra- territorial water service connections. Basically, the resolution states that the Water District will only extend urban level service,this does not include fire service, to existing dwellings outside its service area on a hardship basis. A hardship is defined as having an existing water source which has become contaminated or is insufficient to sustain a reasonable standard of living. The resolution also expressed the Board's desire to limit growth outside of the service area in compliance with Washington County planning designations. I had a lengthy telephone conversation with Ken Martin of the Metropolitan Boundary Review Commission. Ken stated that the Boundary Commission would be definitely opposed to extending urban type services, such as a 6" water main, to rural areas. This is because a 6" water main would foster a large amount of growth outside the UGB. However, the Commission would allow an extra-territorial water service connection because you are limited to the distance that a 1" waterline will serve. Also, he reminded me that if we were to allow these two service connections, that we may be setting a precedent to allow other property owners access to the water system. Specifically those properties located along the west side of SW 150th Avenue and the properties west of the Urban Growth Boundary on SW Bull Mountain Road which historically have been denied service. Another item is that the owner of the public water system will need to make the application to the Boundary Commission for the extra-territorial water service connection. But after discussing the situation with the Boundary Commission, and finding out that at least one of the properties, Tax Lot 1500, is outside of the Cooper Mountain Bull Mountain Critical Ground Water Area. It is feasible, although expensive, to drill a deep well to service the property. Also, the property owners were well aware that they were purchasing property located outside of the UGB and that the property is designated rural residential, having no urban type services. The urban growth line has been drawn, and although we can argue that it should have been moved to include all the properties along SW 131st Avenue, I do have to recommend that the requests to provide water service be denied. WHEREAS, it has been the Board's unwritten policy not to provide water service to out of District properties; and WHEREAS, the Board desires a formal written policy regarding out of District service; and WHEREAS, providing water connections out of district encourages growth outside the Urban Growth Boundary; and WHEREAS, the current Water District boundary is also the Urban Growth Boundary; NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Tigard Water District will not approve any future extra-territorial water service connections, except for those written requests meeting the following criteria: 1. When the Board finds that a hardship exists where the property owner provides proof of a contaminated source of water to an existing single family dwelling; or 2. When proof is provided that the existing source supply for an existing single family dwelling is insufficient to sustain a reasonable standard of living, where insufficient is defined as, but not limited to, an existing well which does not produce adequate usable quantities of water for domestic consumption due to geologic formation. It must be demonstrated that deepening the well will not, in all probability, result in an increase in usable water supply. Documentation is to be provided by a qualified geologist or hydrologist; and 3. Property owner agrees to pay the property's pro rata share of a water main across its street frontage when installed; and 4. At such time that the Urban Growth Boundary is changed (with review expected in the year 2000), the property owner agrees to immediately initiate annexation proceedings into the District; BE IT FURTHER RESOLVED that this Resolution shall take effect immediately. , -- C__ Chair of the Board ATTEST: P f ,-.• ' OR /3, 19'902 Ad nistrative Director Date TIGARD WATER DISTRICT WORK ACCOMPLISHED REPORT Work Accomplished in December • JWA installed 123 3/4" water services one (1) 1" water service to Bull Mountain Meadows, Phase 3, a single family residential development located in the west end of the unincorporated area of the Agency on SW Scholls Ferry Road. The costs associated with installing these water services was charged to line item 52-7310 (water service installations) for an expenditure of $12,572.59. • JWA installed five (5) 5/8" x 3/4" water meters and one (1) 1" water meter within the Tigard Water District service area. This was charged to line item 52-7300 (water meter installations) for a total expenditure of $441.80. Work Accomplished in January • City of Tigard Water Department (COTWD) work crews spent all day Friday, January 28, 1994 and most of the day, Monday, January 31, 1994, cleaning up after the water damage from the High Tor Reservoir spill. The overflow of the reservoir was due to a malfunction in the SCADA system. The contractor for the SCADA installation will be billed for all damages in relation to the flooding of the neighboring home. Estimates of the damage are not available at the time that this report was prepared. • COTWD installed seven (7) 5/8" x 3/4" water meters within the Tigard Water District service area. This was charged to line item 52-73000 (water meter installations) for a total expenditure of $456.20. Work to be Accomplished in February and March • COTWD to install twenty-one 3/4"water services and one (1)water sampling station to serve Hillshire Summit Estates, a single family residential development located in the Tigard Water District service area on the north side of SW Bull Mountain Road east of SW 141st Avenue. Work to be Accomplished in February by Private Contractors • Private contractor to install 1,950 feet of 12"D.O.pipe; 1,070 feet of 8"D.I.pipe;730 feet of 6" D.I. pipe; and 3 fire hydrants to serve 21 single family residences located within the Tigard Water District service area near the summit of Bull,Mountain (Hillshire Summit Estates). sit Tigard Water District January 1994 Work to be Accomplished in March and April by Private Contractors • Private contractor to install 840 feet of 8" D.I. pipe; 40 feet of 6" D.I. pipe; 525 feet of 4" D.I. pipe; and three (3) fire hydrants to serve 18 single family residences located in the Tigard Water District service area on SW Bull Mountain Road, west of SW 150th Avenue (Pleasant View - Phase 2). • Private contractor to install 490 feet of 8" D.I. pipe; 80 feet of 6" D.I. pipe; and one (1) fire hydrant to serve 15 single family residences located in the Tigard Water District service area on the south side of SW Bull Mountain Road at SW 147th Avenue (Continental Heights). A MEMO TO: Jeri DATE: October 8, 1992 FROM: Mike* SUBJECT: Establishing a Written Policy for Extra-Territorial Water Service During the past few weeks, I have had several telephone conversations with a resident of the District expressing their concern that the Water District might allow additional extra-territorial water service connections outside the Urban Growth Boundary. I acknowledged her concerns and stated that the Board of Commissioners had stated publically that they were opposed to any such extra-territorial water services. During this same time period, Audrey Castile had also contacted me and expressed a desire to have a written policy regarding this issue. After looking into the past practices, policy statements, and taking into account the current position of the Board, I feel that it is necessary to have a written policy so that there is no misunderstanding as to what the Board will do regarding extra-territorial water service connections. The written policy is basically the same as what has transpired over the years, except that the written policy defines exactly what kind of criteria must be meant in order to have a hardship case. We could have been hard nosed and flatly denied any extra- territorial water service, but I feel that would not have been in the best interests of the public. There will always be exceptions to the rule, but I believe the exceptions, as described in the resolution, are legitimate and well defined. These exceptions only apply to a property owner with an existing single family residence, and would only be applied if the home owner proves to the Board's satisfaction that a health hazard exists. I have also taken the opportunity to discuss this issue with Ken Martin of the Metropolitan Boundary Review Commission. He stated that he was pleased that we were going to have a written policy and clarified the Boundary Commission's position on annexation. Simply stated, the Boundary Commission will not allow areas outside the Urban Growth Boundary to be annexed into any municipal service area, but they would allow extra-territorial water service connections to existing single family residences if there was a contamination of that property's water supply.
