All discussions within this session are confidential; therefore, nothing from this meeting may be disclosed by those present. Representatives of the news media are allowed to attend this session, but must not disclose any information discussed during this session. TIGARD WATER DISTRICT BOARD OF COMMISSIONERS MEETING Monday, July 28, 2003 Members Present: George Rhine, Beverly Froude, Norm Penner, and Janet Zeider Staff Present: Twila Willson Visitors Present: Paul Owen 1. Call to Order Commissioner George Rhine called the meeting to order at 7:05 p.m. 2. Roll Call and Introductions Commissioner Rhine called the roll and Marc Delphine was absent. 3. Approval of Minutes—May 28, 2003 & June 23, 2003 Commissioner Norm Penner motioned to approve the minutes of the May 28th Intergovernmental Water Board (IWB) meeting, Commissioner Beverly Froude seconded the motion, and the vote to accept the minutes was unanimous. Commissioner Froude motioned to approve the minutes of the June 23rd meeting, Commissioner Penner seconded the motion, and the members voted unanimously to accept the minutes. 4. Visitor's Comments - None 5. Oath of Office for Appointed Board Members Twila Willson administered the Oath of Office to Commissioners George Rhine, Beverly Froude, Norm Penner, and Janet Zeider and each signed the Oath of Commissioner. Commissioner Zeider stated that she had not received the letter from the Washington County Elections Office regarding her write-in vote selection and Twila Willson said she would contact them as to the status of the letter. 6. Water Supply Update Dennis Koellermeier was unable to attend the meeting. 7. IWB Update— Norm Penner Commissioner Penner stated that Commissioner Dick Winn had recently been appointed to replace Jan Drangsholt as the representative from King City for the IWB. Tigard Water District Minutes - 1 - July 28,2003 I The water conservation program is working very well for the Tigard water system area. The landscape rebate program has turned out to be a huge success with many citizens responding to the conservation rebate program. Commissioner Penner explained the graph that Mr. Wegner distributed at the meeting which indicated where Tigard's water comes from and the percentages. • 59% - Bull Run (Portland) • 29% - City of Beaverton (JWC) • 5% -Tualatin Valley Water District (TVWD) • 4% -ASR Recovery • 2% -Well #2 • 1% -Tualatin Commissioner Penner reported that the recent Intergovernmental Water Board meeting included a joint meeting with the Tigard City Council where Ed Wegner made a presentation about the long term water supply source options. • Mr. Wegner reported that the Bull Run Water Agency was dead; however the negotiations for the wholesale contract renewal with the City of Portland continue to proceed. • Joint Water Commission (JWC) negotiations continue forward with the partnership option. Representative Wu is pushing for the Bureau of Land Management (BLM) to move on the dam raise. • Recommendations were made to staff to continue negotiating with both water sources. • Councilman Brian Moore urged investigating the Willamette River as a water source and not to disregard that as a third option. Commissioner Froude expressed a concern as to who would ultimately pay for the expensive reservoir covering projects that the City of Portland would be undertaking and requested that this issue and Portland's timetable should be topics that Dennis Koellermeier report on at the next TWD Meeting. 8. Non Agenda Items Twila Willson distributed a copy of the invoice received from Washington County for the May election fees. She stated that the invoice had been approved and payment was being processed. Commissioner Rhine recommended the election officers, however following discussion it was decided to postpone the elections of officers until the next meeting when all members could be present. Commissioner Rhine stated that he was not necessarily expressing a desire to step down as the Chair of the Tigard Water District Board of Commissioners. Commissioner Penner expressed neutral feelings about continuing to serve as the TWD representative on the IWB. Tigard Water District Minutes -2- July 28,2003 • Commissioner Froude made the recommendation that board members should contact staff if they were unable to attend TWD meetings. Commissioner Penner requested that the alternate, Commissioner Froude, attend the IWB meeting on September 10, 2003, as he would be out of town. 9. Set next meeting date The next meeting date was scheduled for Monday, October 27, 2003, at 7:00 pm. 10. Adjournment Commissioner Janet Zeider motioned to adjourn the meeting and Commissioner Froude seconded the motion. At 7:41 p.m. the board unanimously voted to adjourn the meeting. Tigard Water District Minutes -3 - July 28,2003 MEMORANDUM Amy TO: Craig Prosser, Finance Director FROM: Dennis Koellermeier, Assistant Public Works Director RE: Bull Mountain annexation impacts on the Tigard Water District DATE: September 3, 2003 Per your request The Public Works Department, in cooperation with your staff, have evaluated the impacts that the potential annexation of the Bull Mountain area into the City of Tigard would have on the Tigard Water District. We have concluded that significant impacts will occur, and will need to be resolved in a cooperative agreement between the City and the District. Background The Tigard Water District is an ORS 450 organization comprised of approximately 3,500 accounts and roughly bounded by Barrows Road on the north, Tigard City limits on the east, Beef Bend Road on the west and King City on the south. The district is located completely inside the Urban Growth Boundary. The District is a part of the Intergovernmental Water Board, which is comprised of King City, Durham, Tigard, and the Tigard Water District. The Tigard Water District is comprised of those properties that are inside the Urban Growth Boundary but outside the city limits of any of its partner city's, an area commonly referred to as the unincorporated area. Our analysis looked at two major impacts, the first being financial and the second being institutional. Financial Impacts By prior agreement, the district's only revenues are comprised of 1% of total water sales that occur within it's boundaries. All water sales are billed and managed by the City of Tigard, and this 1% is remitted on an annual basis. The attached table was developed to tabulate the financial impacts of annexation of the Bull Mountain area into the City of Tigard. In summary, the Tigard Water District is comprised of approximately 3500 accounts which produce total annual sales of approximately $1,842,350. These sales would generate approximately $18,000 of revenues, based on the 1% of sales formula. When the Bull Mountain annexation is complete, total accounts remaining in the District will be approximately 524, which would generate approximately $945,130 in annual sales, which would generate $9,450 of revenue for the district, based on the 1% remittance formula. Thus the financial impacts of the annexation would be a reduction of approximately $ 8,970 in annual revenues to the district. Institutional Impacts As mentioned previously,the Tigard Water District is located entirely within the Urban Growth Boundary. From a practical matter, as Tigard and King City annex lands into their boundaries, those lands are withdrawn from the boundaries of the District. Thus the district is shrinking. The Bull Mountain annexation plan indicated that approximately 2,935 of the total 3,500 accounts will leave the District. This represents approximately 83% of the current accounts and 48.6% of the current annual revenue. All remaining TWD area is within the UGB, and will also be annexed some time in the future. At that time the district will cease to exist. The District Board has discussed this scenario, and has been briefed by the City Attorney on the process of dissolving the district should the need develop. In summary, the Bull Mountain annexation would not necessarily cause the Tigard Water District to dissolve. A customer base of approximately 524 accounts would remain within current district boundaries. Those 524 accounts could be annexed into either King City or Tigard in the future. From a practical matter the Tigard Water District Board may choose to dissolve the District following procedures clearly laid our in state law. That decision would rest with the Board.
