APPLICATION SUMMARY FILE NAME: DONATION CENTER FENCE CASE NO.: Sensitive Lands Review(SLR) SLR2019-00004 PROPOSAL: The applicant proposes 150 linear feet of six-foot tall chain link fence to be located within the FEMA 100-year floodplain at 10525 SW Hall Boulevard. The fence and associated gate will be located on private property and placed fifteen feet west of the property line with SW Hall Boulevard. As shown on a floodzone map of the property generated on December 24th, 2019, the base flood elevation for this property is at 171 feet above sea level.The fence will be placed at approximately 173 feet above sea level. The proposed fence will be located above the base flood elevation by about two feet. No changes to the landscaping, parking, or building footprint are proposed. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.310, 18.510,and 18.930 SLR2019-00004.DONATION CENTER FENCE 1/5 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 10525 SW Hall Boulevard (WCTM 1S135AA,Tax Lot 2700),which is located south of SW Oak Street,west of SW Hall Boulevard, north of SW Pine Street, and east of SW 95th Avenue. The subject tax lot is located on the southwest corner of the SW Hall Boulevard and SW Oak Street intersection. The .59-acre site contains one 1,116 square foot building and an asphalt parking lot. Adjacent tax lots to the north, south, and west are all zoned Mixed-Use Residential 2 (MUR-2) and the tax lot to the east is zoned Professional/Administrative Commercial (C-P). The subject tax lot and all adjacent tax lots are located within the Washington Square Regional Center Plan District. Several sensitive lands exist on site,including a portion of Ash Creek, a Clean Water Services (CWS) Vegetated Corridor, a Federal Emergency Management Agency (FEMA) 100-year floodplain, the Goal 5 Safe Harbor Zone, and Goal 5 Significant Habitat Areas. While the site does contain a 50-foot Vegetated Corridor (riparian) setback from Ash Creek, the proposed fence will be located outside of setback. The only sensitive land area that will contain the chain link fence and gate will be the FEMA flood zone. A map from FEMA shows that the base flood elevation for this tax lot is approximately 171 feet above sea level. In November 2019, a Nuisance Code Compliance (NCC2019-00233) request was filed for the subject taxlot because of abandoned junk, furniture, and appliances left on the property. The property owner explained to Staff that this site used to be a Goodwill Donation Center that is no longer in service. The property owner placed a six-foot-tall chain link fence around the structure to prevent junk from being abandoned on the site,however junk is continuing to pile up outside of the chain link fence. Proposal: The applicant proposes to place a six-foot-tall chain link fence on the property line adjacent to SW Hall Boulevard to prevent junk from being discarded on the subject tax lot. The fence will be placed at 173 feet above sea level,which is two feet higher than the FEMA base flood elevation for this lot.The chain link fence is proposed to be placed within the FEMA 100-year floodplain and not within the CWS Vegetated Corridor. The applicant's resubmittal from January 2r, 2020 states that the fence will be located 15 feet west of the property line with SW Hall Boulevard. The chain link fence will also contain a 12-foot- wide gate so that the property owner can access the property. The applicant's narrative states that the fence will comply with visual clearance standards in Community Development Code (CDC) 18.930.The subject property is located within the Washington Square Regional Center Plan District, where there are no applicable standards for the applicant's proposal of a six-foot-tall fence to be located in the FEMA 100- year floodplain.The applicant confirmed in their January 21,2020 land use resubmittal that no land form alterations are proposed. Hall Boulevard is an Oregon Department of Transportation (ODOT) maintained road and they approved the proposed fence location on February 24th,2020. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Staff has reviewed the proposal for consistency with the applicable criteria in the following Community Development Code (CDC) chapters. Findings for only the applicable code sections are found below: SLR2019-00004.DONATION CENTER FENCE 2/5 18.310 Nonresidential General Provisions 18.310.020 Fence and Wall Standards Fences and walls may be located within required setbacks. Fences and walls located within required setbacks are subject to the standards in this section. Fences and walls located outside required setbacks are subject to the applicable standards in Chapter 18.320, Commercial Zone Development Standards, or Chapter 18.330, Industrial Zone Development Standards. FINDING:The minimum front setback in the MUR-2 Zone is ten feet and the maximum front setback is twenty feet. The applicant proposes a six-foot-tall chain link fence to be located fifteen feet west of the property line with SW Hall Boulevard,which is maintained by the Oregon Department of Transportation (ODOT). The proposed fence is located within a required maximum setback; therefore, the fence is subject to the standards in this section. This criterion is met. A. Fences and walls in a required front setback may be a maximum of 3 feet in height where abutting a local or neighborhood street and a maximum of 6 feet in height where abutting a collector or arterial street. FINDING: The applicant proposes a six-foot-tall chain link fence to be located fifteen feet west of the property line with SW Hall Boulevard, which is an arterial road maintained by ODOT. This standard is met. C. Fences and walls must meet vision clearance area requirements in Chapter 18.930, Vision Clearance Areas. (Ord. 18-28 §1) FINDING: This standard is addressed in the requirements for Chapter 18.930,Vision Clearance Areas. 18.510 Sensitive Lands E. Administrative sensitive lands review. 1. Administrative sensitive lands reviews within the special flood hazard area(excluding the floodway), drainageway, slopes that are 25 percent or greater, and unstable ground are processed through a Type I procedure,as provided in Section 18.710.050,for the following actions: b. Actions within the special flood hazard area: ii. Any landform alternation involving up to 50 cubic yards of material. FINDING: The applicant proposes a six-foot-tall chain link fence to be located fifteen feet west of the property line with SW Hall Boulevard,which is maintained by ODOT. The proposed location is within the special flood hazard area and outside of the floodway, as defined in CDC 18.30.020.F.7.d, therefore the proposal can be reviewed as a Type 1 procedure. The applicant's proposal has a minimum ground disturbance of up to 50 cubic yards. This criterion is met. 18.510.040 General Provisions for Special Flood Hazard Areas C. Base flood elevation data. When base flood elevation data has not been provided in compliance with Subsection 18.510.040.B, the approval authority will obtain, review and reasonably utilize any base flood elevation and floodway data available from a federal, state or other source, in order to administer Subsections 18.510.040.M and N. SLR2019-00004.DONATION CENTER FENCE 3/5 FINDING:As shown on a floodzone map of the property generated by the applicant on December 24th, 2019,the base flood elevation for this property is at 171 feet above sea level.The fence will be placed at approximately 173 feet above sea level.The proposed fence will be located above the base flood elevation by about two feet.This information will be used in order to administer Subsections 18.510.040.M and N. This criterion is met. E. Resistant to flood damage. All new construction and substantial improvements, including manufactured homes, must be constructed with materials and utility equipment resistant to flood damage. FINDING: The applicant's submittal from December 19th, 2019 states that the chain link fence will be constructed with materials and utility equipment resistant to flood damage.This standard is met. 18.510.070 Sensitive Lands Applications B. Within the special flood hazard area. The approval authority will approve or approve with conditions an application for sensitive lands review within the special flood hazard area when all of the following criteria are met: 1. Compliance with all of the applicable requirements of this title; FINDING: The applicant proposes a six-foot-tall chain link fence to be located fifteen feet west of the property line with SW Hall Boulevard.The nonresidential fence meets the other applicable code chapters of the CDC,as shown in this land use decision.This standard is met. 7. The necessary U.S.Army Corps of Engineers and State of Oregon Land Board,Division of State Lands, and CWS permits and approvals must be obtained; and FINDING: The applicant has been told to check with the U.S. Army Corps of Engineers and State of Oregon Land Board,Division of State Lands,and CWS for any additional permits or authorization to be obtained. This standard is met. 18.930 Vision Clearance Areas 18.930.040 Computations A. Arterial streets. The vision clearance area is not less than 35 feet on each side of the intersection. FINDING: The subject taxlot is located at the corner of SW Hall Boulevard,which is an arterial street, and SW Oak Street,which is a minor collector street.The applicant demonstrates that they will maintain a vision clearance area of 35 feet on each side of the intersection.This standard is met. The provisions of this chapter apply to all development, including the construction of new structures,the remodeling of existing structures,and to a change of use that increases the on-site parking or loading requirements or changes the access requirements. B. When site development review is not required. Where the provisions of Chapter 18.780, Site Development Review,do not apply,the approval authority will approve,approve with conditions,or deny a plan submitted under the provisions of this chapter through a Type I procedure, as provided in Section 18.710.050,using the standards in this chapter. B.Obstructions prohibited.A clear vision area must be maintained free of vehicles,hedges,plantings, fences,wall structures,and temporary or permanent obstructions(except for an occasional utility pole or tree),exceeding 3 feet in height,measured from the top of the curb,or where no curb exists,from the street center line grade. Trees exceeding 3 feet in height may be located in this area,provided all branches below 8 feet are removed. C.Additional topographical constraints.Where the crest of a hill or vertical curve conditions contribute to the obstruction of clear vision areas at a street or driveway intersection,hedges, plantings,fences,walls,wall structures,and temporary or permanent obstructions must be further reduced in height or eliminated to comply with the intent of the required clear vision area. Sanitary sewerage systems.New and replacement sanitary sewerage systems must be designed to minimize or eliminate infiltration of floodwater into the systems and discharge from the systems into floodwater.NA K. On-site waste disposal systems.On-site waste disposal systems must be located to avoid impairment to them or contamination from them during flooding.NA L.Residential construction. 1. New construction and substantial improvement of any residential structure,including manufactured homes,must have the lowest floor,including the basement,elevated at least 1 foot above base flood elevation; NA 2. Fully enclosed areas below the lowest floor that are subject to flooding are prohibited or must be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwater. Designs for meeting this requirement must either be certified by a registered professional engineer or architect,or must meet or exceed the following minimum criteria:NA a.A minimum of 2 openings having a total net area of not less than 1 square inch for every square foot of enclosed area subject to flooding must be provided; b. The bottom of all openings must be no higher than 1 foot above grade;and c. Openings may be equipped with screens, louvers, or other coverings or devices,provided that they permit the automatic entry and exit of flood waters. 3.Manufactured homes must be securely anchored to an adequately anchored permanent foundation system to prevent flotation,collapse,and lateral movement during the base flood. Anchoring methods may include, but are not limited to,use of over-the-top or frame ties to ground anchors. Electrical RECEIVED DEC 1 9 2019 crossover connections shall be a minimum of 12 inches above BFE.NA CITY OF TIGARD PLANNING/ENGINEERING M.Nonresidential construction.New construction and substantial improvement of any commercial, industrial, or other nonresidential structure must either have the lowest floor, including basement, elevated to the level of the base flood elevation, or together with attendant utility and sanitary facilities, must: NA 1.Be floodproofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water;Only a temporary fence in floodplain 2. Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy;NA 3. Be certified by a registered professional engineer or architect that the design and methods of construction are in compliance with accepted standards of practice for meeting provisions of this subsection based on their development or review of the structural design, specifications and plans. Such certifications must be provided to the building official as provided in Paragraph 18.510.030.E.2; and NA 4.Nonresidential structures that are elevated,not floodproofed,must meet the same standards for space below the lowest floor as described in Paragraph 18.510.040.L.2.Applicants flood-proofing nonresidential buildings must be notified that flood insurance premiums will be based on rates that are 1 foot below the floodproofed level(e.g.,a building constructed to the base flood level will be rated as 1 foot below that level).NA N. Subdivisions and partitions in special flood hazard areas. Subdivisions and partitions in the special flood hazard area must meet the following criteria: 1.The design must minimize the potential for flood damage;NA 2. Public utilities and facilities such as sewer, gas, electrical,and water systems must be located and constructed so as to minimize flood damage;NA 3.Adequate drainage must be provided to reduce exposure to flood damage; and NA 4. For subdivisions or partitions that contain more than 50 lots or 5 acres and where base flood elevation data is not available from the Federal Emergency Management Agency(FEMA) or another authoritative source,the applicant must generate base flood elevation data to be reviewed as part of the application. NA O. Recreational vehicles. Recreational vehicles placed on sites within Zones Al-A30,AH,and AE on the flood insurance rate map either: 1. Are on the site for fewer than 180 consecutive days;NA 2. Are fully licensed and ready for highway use:NA a.Are on wheels or jacking system, b.Are attached to the site only by quick disconnect type utilities and security devices,and have no permanently attached additions,or c.Meet the requirements of Subsections 18.510.040.E, F,I,and L and the elevation and anchoring requirements for manufactured homes. P. Critical facilities. Construction of new critical facilities must be,to the extent possible, located outside of the limits of the special flood hazard area. Construction of new critical facilities are allowed within the RECEIVED DEC 19 2019 TIGARD special flood hazard area if no feasible alternative site is available.
