Prior to building permit submittal,the applicant must apply for,and receive,a new address'for each proposed ADU. If the applicant is unfamiliar with addressing process,the applicant should contact the project planner for more information. SECTION III. BACKGROUND INFORMATION Site Information: The property is located at 7108 SW Locust Street (WCTM 1S136AB,Tax Lot 01601),which is located south of SW Locust Street,east of SW 72"d Avenue, north of SW Mapleleaf Street,and west of SW 69`x' Ave. The site currently contains a split-level,single detached house with an attached two-car garage.The subject property, and all adjacent properties, are zoned low-density residential (R-4.5). The site is not located within any sensitive lands,sewer reimbursement districts,or overlay zones. In March 2019, the applicant applied for a Pre-Application Conference (PRE2019-00014) for a two-lot Minor Lot Partition (MLP) and to confirm that two ADUs would be possible for the site.The applicant has told Staff that the applicant will first apply for ADU land use and then apply for the Minor Land Partition (MLP) at a later date.This review will not include any review for an MLP. Proposal: The applicant proposes to create two(2) attached ADUs at 7108 SW Locust Street.A two-story addition with a building footprint of 1,100 square feet will be added to the north fa4ade of the existing single detached house; this new addition will contain the entirety of ADU number one,a portion of the primary unit, and two (2) one-car garages. APPLICABLE REVIEW CRITERIA AND FINDINGS Findings for only the applicable code sections are found below: 18.220 Accessory Dwelling Units: 18.220.050 Standards A. Number of units. 1. A maximum of 2 accessory dwelling units are allowed per single detached house. FINDING:The applicant is proposing a total number of two attached ADUs.This standard is met. ADU2019-00014:ROSE ADU 2/5 2. A maximum of 1 detached accessory dwelling unit is allowed per single detached house. A second accessory dwelling unit must be attached to the primary unit. FINDING:The applicant is proposing two attached ADUs.ADU number one is located on the second story of the proposed addition to the single detached house,and two bedrooms in ADU number one will share a common ceiling with the primary tout's kitchen;therefore,ADU number one meets the definition of"attached" in CDC 18.30.020.D.14.b. ADU number two will be located on the second floor of the existing single detached house. ADU number two shares a common ceiling with the primary dwelling unit; therefore, ADU number two meets the definition of"attached" in CDC 18.30.020.D.14.b This standard is met. B. Size. 2. The square footage of each attached accessory dwelling unit may not exceed the square footage of the primary unit. FINDING: Upon the completion of all proposed modifications, the primary unit will have an area of 1,634 square feet,ADU number one will have an area of 1,526.25 square feet,and ADU number two will have an area of 1,488 square feet. The area of each ADU does not exceed the area for the primary unit. This standard is met. C. Height. 2. A structure containing an attached accessory dwelling unit may not exceed the maximum height for a single detached house in the base zone. FINDING: The maximum height for a single detached house in the R-4.5 zone is 30 feet. The first attached ADU,which will be located on top of a proposed two-car garage,will have a maximum height of 14 feet. There is no change in height to the second proposed ADU because it is located on the first floor of an existing single detached house. The structure for the proposed ADUs will not exceed the maximum height for a single detached house in the R-4.5 zone. This standard is met. D. Setbacks. Accessory dwelling units must meet the setback standards for a single detached house in the base zone,with the exception that a detached accessory dwelling unit may be located within 5 feet of the rear property line if the accessory dwelling unit is 15 feet or less in height. ADL12019-00014:ROSF ADU 3/5 E. Entrances. Only one attached accessory dwelling unit may have an entrance on the facade facing the front property line. The entrance to a second attached accessory dwelling unit must be oriented to a side, street side, or rear lot line. FINDING:The ADU entrance for ADU number two faces the front property line and the entrance for ADU number one faces the east side lot line.This standard is met. F. Parking. 1. In addition to the number of parking spaces required for the primary unit,a minimum of 1 off-street parking space must be provided for each accessory dwelling unit. Lots within 2,500 feet of a right-of-way that includes transit service are exempt from the additional parking requirement for the accessory dwelling unit. FINDING: A minimum of three off-street parking spaces must be provided for the single detached house and the two proposed ADUs.The site currently contains one two-car garage for the existing single family detached house. The existing two-car garage for the single detached house will be converted into a one car garage and habitable space for the primary unit.The applicant is also proposing the construction of two, one-car garages on the first floor of the addition. After all proposed parking modifications have been completed,there will be a total of three (3) one-car garages on site. The applicant's submittal states that each of the three one-car garages will be assigned to either the primary unit,ADU number one, or ADU number two. This standard is met. G. Home occupations. Type II Home Occupations are prohibited on a lot with two accessory dwelling units. FINDING: The applicant's submittal states that the property owner will comply with this requirement. This standard is met. CONCLUSION: The applicant proposes to create two (2) attached ADUs at 7108 SW Locust Street. A two-story addition with a building footprint of 1,100 square feet will be added to the north fagade of the existing single detached house;this new addition will contain the entirety of ADU number one,a portion of the primary unit,and two (2) one-car garages.The first floor of the single detached house will be designated as the primary unit and the second floor of the split-level detached house will contain ADU number two.The existing two-car garage for the single detached house will be converted into a one car garage and habitable space for the primary unit.After all proposed parking modifications have been completed,there will be a total of three (3) one-car garages on site.The proposal is in compliance with all applicable requirements of this title. The existing home has a two car garage. Half of this garage will be converted to a bedroom for the main house the other half will be retained,be able to accommodate one car and will be used exclusively by the occupant of the ADU 2. ADU 2 A portion of this proposed ADU will be in the lower floor of the existing structure and the remainder of it will be in the lower floor of the proposed structure. This is the reason that the square footage of the existing structure is smaller than the combined square footage of the proposed ADU 2 and the proposed primary unit. I am unable to comment on whether the County records include the area of the un-inhabitable space in the garage of the home in their calculations of the total square footage of the home. C.
