Tax lot 200 is an existing 54.87-acre parcel located in both the City of Beaverton (53.62 acres) and within the City of Tigard (1.25 acres). The subject property was split into three physical pieces by the creation of the SW Scholls Ferry Road right-of-way and by the SW Roy Rogers Road right-of-way by several actions in the past,but it has remained as one legal parcel. When the northern portion of the property was annexed into the City of Beaverton in 2015 and the southern portion of the property was annexed into the City of Tigard,the property became not just physically separated into different pieces,it became jurisdictionally split into two pieces. Representatives of the City of Beaverton and the City of Tigard have discussed the situation with representatives for the applicant and the property owners and have determined that for administrative purposes,a preliminary partitioning of the property was in order. They agreed that the City of Beaverton should be process the preliminary partition with input from the City of Tigard.The Crescent Grove Cemetery Association is the owner of lot 200. They desire to divide the lot allowing for sale of the land within the South Cooper Mountain Heights PUD (SCMH PUD) to the applicant (West Hills Development)while retaining the southern portion of the property that is located within the City of Tigard's River Terrace Community Plan area. The resulting preliminary partition would result in three new parcels: Parcels I and II The area within Beaverton measures 53.23 acres. Two separate parcels are proposed to allow for the potential division of ownership at a later date. Proposed parcel I,42.29 acres, is designated for medium density residential housing by the South Cooper Mountain Heights PD and is planned for attached and detached single-family housing. The 10.94 acres of proposed parcel II are planned to be developed as one project consisting of a group of multi-family buildings. Parcel III The Tigard section of tax lot 200 consists of three separate pieces cut by portions of the public rights of way(ROW) for SW Scholls Ferry Road and SW Roy Rogers Road. The three separate pieces of land would comprise one 1.25 acre parcel. There are currently no plans for development of this land. The COAs included with the city approvals are evidence of the project satisfying the City's standards and requirements. 6. Demonstrate all lots meet ordinance standards for lot site, dimension and frontage. The final plat shall be fully dimensioned and indicate the square footage of each lot. (Planning Division/SF) Response:The approved PUD for the South Cooper Mountain Heights demonstrated compliance with Site Development Standards for all five (5) included residential zoning districts.The proposed preliminary partition involves the R1,R2 and R3 components. Dimensional standards: The RI zone is not accompanied by minimum dimensions set forth by 20.05.15. Additionally the R1 designation is not encumbered by minimum setbacks. Heights are limited to 60 feet. As per the approved SCMH PUD,there are no proposals for buildings exceeding this limit. The R2 and R4 zones are accompanied by geometric requirements. As included within the SCMH PUD, there are lots within the R2 component that are smaller than the typical minimum lot size. Relief from said minimums was granted through the approved PUD. COMPLIANCE WITH THE APPROVAL STANDARDS OF TIGARD COMMUNITY DEVELOPMENT CODE TITLE 18 Below are the responses to the standards of Title 18 that apply to the proposed parcel III of the proposed minor land partition. Other standards of Title 18 are assumed not to be applicable to this review. 18.430.070 Approval Criteria:Final Plat B.Approval criteria. By means of a Type I procedure, the director and the city engineer shall review the final plat and shall approve or deny the final plat approval based on findings that: 1. The final plat complies with the preliminary plat approved by the approval authority and all conditions of approval have been satisfied; Response:The Final Land Division is complies with the Preliminary Partition (LD2016-0008) as approved by the City of Beaverton in coordination with the City of Tigard. 2. The streets and roads forpublic use are dedicated without reservation or restriction other than revisionary rights upon vacation of any such street or road and easements forpublic utilities; Response:The lands in questions are remnants from right of way expansion,with no plans for development.No improvements to the property or adjacent streets are proposed. The site's frontages are with SW Scholls Ferry Road and SW Roy Rogers Road. No dedication is required for lands within the City of Tigard. 3. The streets and roads held for private use and indicated on the preliminary plat of such subdivision have been approved by the city; Response: There are no streets or roads held for private use on the subject property. 4. The plat contains a donation to the public of all common improvements, including but not limited to streets, roads,parks,sewage disposal and water supply systems; Response: There are no common improvements on the subject property for which the donation requirements are warranted. 5.An explanation is included which explains all of the common improvements required as conditions of approval and air in recordable form and have been recorded and referenced on the plat; Response: There are no common improvements on the subject property required as conditions of approval. 6. The plat complies with the applicable Zoning ordinance and other applicable ordinances and regulations; Response:There are no known conflicts with any statutory or ordinance requirements or regulations.The minimum lot area of the R25 zoning district is 1,480 square feet per multi- family unit and 3,050 square feet for a detached single-family unit. Proposed parcel III will be 1.25 acres,or over 50,000 square feet in size.Therefore,parcel III is consistent with the minimum lot size of the R25 district. As such, the"paper"partition has no real effect upon possible compliance with the dimensional standards of the Code or service provision requirements.None of the three physical segments of proposed parcel III will be any more readable for development than they currently area.These segments of parcel III will likely need to be combined with other adjacent parcels to be developable,unless development was something like a stormwater facility or something of that sort. 7.A certification ly the appropriate water district that water will be available to the lot line of each and every lot depicted on the plat or bond, contract or other assurance has been provided by the subdivider to the city that a domestic water system will be installed by or on behalf of the subdivider to the lot line of each and every lot depicted on the plat. The amount of the bond, contract or other assurance by the subdivider shall be determined by a registered professional engineer,subject to any change in amount as determined necessary by the city; Response: There is no development currently on the proposed new parcel III within the City of Tigard,nor is any development currently proposed for that parcel. As such,the state of public facilities is adequate for the proposed parcel. If development were to be proposed for the proposed parcel,sanitary sewer,storm sewer,and public water supply lines will soon be located nearby within the right-of-way for SW Friendly Lane to the south. 8.A certificate has been provided by the city s engineering department that a sewage disposal system will be available to the lot line of each and every lot depicted in the proposed plat; Response:There is no development currently on the proposed new parcel III within the City of Tigard,nor is any development currently proposed for that parcel. As such,the state of public facilities is adequate for the proposed parcel. If development were to be proposed for the proposed parcel,sanitary sewer,storm sewer, and public water supply lines will soon be located nearby within the right-of-way for SW Friendly Lane to the south. 9. Copies of signed deeds have been submitted granting the city a reserve strip as provided by 18.430.040.B; Response: No conditions of approval from the City of Tigard for reserve strip were attached to the approved Preliminary Plat. Accordingly no reserve strip has been granted. 10. The plat contains a surveyor's affidavit by the survyor who surveyed the land represented on the plat to the effect the land was correctly surveyed and marked with proper monuments as provided by ORS Chapter 92[.060] and indicating the initial point of the survey, and giving the dimensions and kind of such monument, and its reference to some corner established by the U.S. survey or giving two or more objects for identifying its location. Response:The attached Final Plat includes the necessary surveyor's affidavit and other required elements. Based upon the above analysis,the proposed portioning of tax lot 200 is consistent with the applicable standards of the City of Tigard for a Final Plt as they would apply to the creation of parcel III as shown on the plans included with this application.
