BACKGROUND INFORMATION Site Information and Proposal Description: The subject property (8909 SW Inez Street;WCTM 2S111AA,Tax Lot 13500) is Lot 13 of the approved Irma Dell Butterfield Park Subdivision (Case No. SUB2016-00010),and is located on the north side of SW Inez Street, south of SW Greensward Lane,west of SW 88`''Avenue, and east of SW 90t'Avenue. The lot is located behind Lots 11 and 12, and connects to SW Inez Street via a 28-foot-wide access easement that is shared with Lot 12 and the adjacent property to the west(8915 SW Inez Street;WCTM 2S111AA,Tax Lot 12100).The property is zoned Low- Density Residential (R-4.5), as are surrounding properties. The applicant proposes to construct a new single detached house on the subject property. CDC 18.290.040.A.2 requires the entrance of a single detached house to face the front lot line. The applicant requests an adjustment to have the entrance face the side lot line. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Community Development Code of the City of Tigard requires that all property owners of record within 500 feet of the subject site be notified of the proposal, and be given an opportunity to submit written comments prior to issuance of the decision. Staff mailed notices of this Type II application to affected parties on September 26, 2019.An e-mail was received from a neighbor on October 3,2019,requesting more information about the proposal. City staff responded on October 3,2019 with the requested information. No other public comments were received. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.715 Adjustments 18.715.050 Approval Criteria The approval authority will approve or approve with conditions an adjustment application when all of the criteria in either Subsection 18.715.050.A or B are met. A. Criteria for demonstrating substantial compliance. 1. The proposed adjustment results in development that is generally consistent with the purpose of the development standard to be adjusted; The applicant proposes to construct a new single detached house on the subject property. CDC 18.290.040.A.2 requires the entrance of a single detached house to face the front lot line. The applicant requests an adjustment to have the entrance face the side (western) lot line. The purpose of the entrance design standard in CDC 18.290.040.A.2 is to create an attractive streetscape for pedestrians, and to encourage street visibility or "eyes on the street."Normally, a lot has at least one (1) property line that directly abuts the street. The subject property is unusual because it does not have any direct frontage on a public street; it is located behind two (2) other properties, and connects to SW Inez Street via a 28-foot-wide shared access easement. The property's front (southern) lot line is located more than 140 feet away from a public street; therefore, even if the applicant proposed a house design with the entrance facing the front (southern) lot line,it would still not be visible from the public street. Accordingly, staff finds the entrance design standard in CDC 18.290.040.A.2 is not intended to apply to lots that do not have direct frontage on a public street. Because the new home will be located more than 140 feet away from the public street, the applicant's proposal to have the entrance face the side (western) lot line instead of the front (southern) lot line will have no impact to the pedestrian experience or street visibility. This criterion is met. 2. If more than one adjustment is proposed, the cumulative effect of the adjustments results in development that is generally consistent with the existing development pattern of the NOTICE OF DECISION PAGE 2 OF 4 ADJ2019-00014IRMA DELL BU MRFIELD PARK LOT 13 ADJUSTMENT surrounding area and the overall purpose of the base zone; The applicant is not proposing more than one (1) adjustment. This criterion does not apply. 3. The proposed adjustment utilizes innovative design, results in sustainable development, or addresses a site constraint or unusual situation; The applicant states that the proposed adjustment addresses an unusual situation with the subject property. The situation is unusual because the subject property has no direct frontage on a public street, and the property's front lot line is located more than 140 feet away from a public street. CDC 18.290.040.A.2 requires the entrance of a single detached house to face the front lot line.As detailed in the findings above,the purpose of this design standard is to is to create an attractive streetscape for pedestrians,and to encourage street visibility or"eyes on the street."Staff finds that this standard is not intended to apply to lots that do not have direct frontage on a public street, and the applicant's proposal to have the new home's entrance face the side lot line versus the front lot line will have no impact to the pedestrian experience or street visibility. This criterion is met. 4. The proposed adjustment does not have a greater impact on city-designated sensitive lands than would otherwise occur if the adjustment was not approved; and There are no city-designated sensitive lands located on the subject property or adjacent properties. This criterion does not apply. 5. Any impacts from the proposed adjustment are mitigated to the extent practicable. As addressed in Section 18.715.050.A.1 and A.3,staff finds the applicant's proposal to have the new home's entrance face the side lot line instead of the front lot line will have no impact to the pedestrian experience or street visibility, because the subject property is located more than 140 feet away from a public street. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Community Development Code of the City of Tigard requires that all property owners of record within 500 feet of the subject site be notified of the proposal, and be given an opportunity to submit written comments prior to issuance of the decision. Staff mailed notices of this Type II application to affected parties on September 26, 2019. An e-mail was received from a neighbor on October 3, 2019, requesting more information about the proposal. City staff responded on October 3, 2019 with the requested information. No other public comments were received. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.715 Adjustments 18.715.050 Approval Criteria The approval authority will approve or approve with conditions an adjustment application when all of the criteria in either Subsection 18.715.050.A or B are met. A. Criteria for demonstrating substantial compliance. 1. The proposed adjustment results in development that is generally consistent with the purpose of the development standard to be adjusted; The applicant proposes to construct a new single detached house on the subject property. CDC 18.290.040.A.2 requires the entrance of a single detached house to face the front lot line. The applicant requests an adjustment to have the entrance face the side (western) lot line. The purpose of the entrance design standard in CDC 18.290.040.A.2 is to create an attractive streetscape for pedestrians, and to encourage street visibility or “eyes on the street.” Normally, a lot has at least one (1) property line that directly abuts the street. The subject property is unusual because it does not have any direct frontage on a public street; it is located behind two (2) other properties, and connects to SW Inez Street via a 28-foot-wide shared access easement. The property’s front (southern) lot line is located more than 140 feet away from a public street; therefore, even if the applicant proposed a house design with the entrance facing the front (southern) lot line, it would still not be visible from the public street. Accordingly, staff finds the entrance design standard in CDC 18.290.040.A.2 is not intended to apply to lots that do not have direct frontage on a public street. Because the new home will be located more than 140 feet away from the public street, the applicant’s proposal to have the entrance face the side (western) lot line instead of the front (southern) lot line will have no impact to the pedestrian experience or street visibility. This criterion is met. 2. If more than one adjustment is proposed, the cumulative effect of the adjustments results in development that is generally consistent with the existing development pattern of the NOTICE OF DECISION PAGE 3 OF 4 ADJ2019-00014 IRMA DELL BUTTERFIELD PARK LOT 13 ADJUSTMENT surrounding area and the overall purpose of the base zone; The applicant is not proposing more than one (1) adjustment. This criterion does not apply. 3. The proposed adjustment utilizes innovative design, results in sustainable development, or addresses a site constraint or unusual situation; The applicant states that the proposed adjustment addresses an unusual situation with the subject property. The situation is unusual because the subject property has no direct frontage on a public street, and the property’s front lot line is located more than 140 feet away from a public street. CDC 18.290.040.A.2 requires the entrance of a single detached house to face the front lot line. As detailed in the findings above, the purpose of this design standard is to is to create an attractive streetscape for pedestrians, and to encourage street visibility or “eyes on the street.” Staff finds that this standard is not intended to apply to lots that do not have direct frontage on a public street, and the applicant’s proposal to have the new home’s entrance face the side lot line versus the front lot line will have no impact to the pedestrian experience or street visibility. This criterion is met. 4. The proposed adjustment does not have a greater impact on city-designated sensitive lands than would otherwise occur if the adjustment was not approved; and There are no city-designated sensitive lands located on the subject property or adjacent properties. This criterion does not apply. 5. Any impacts from the proposed adjustment are mitigated to the extent practicable. As addressed in Section 18.715.050.A.1 and A.3, staff finds the applicant’s proposal to have the new home’s entrance face the side lot line instead of the front lot line will have no impact to the pedestrian experience or street visibility, because the subject property is located more than 140 feet away from a public street.
