The applicant must maintain vision clearance for the driveway on the subject property (13740 SW Sandridge Drive;WCTM 2S105DD, Tax Lot 5100), and for the driveway on the adjacent property to the east (13810 SW Sandridge Drive;WCTM 2S105DD,Tax Lot 2500). 2. The applicant must maintain a two-foot clearance around the existing water meter located in the southeast corner of the subject property (13740 SW Sandridge Drive;WCTM 2S105DD,Tax Lot 5100). SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The subject property (13740 SW Sandridge Drive;WCTM 2S105DD,Tax Lot 5100) is located on the northeast side of SW Sandridge Drive, north of SW Bull Mountain Road, and south of SW Fern Street. The property currently contains an existing single detached house with an attached garage,paved driveway, and associated landscaping. The property is zoned Medium-Density Residential (R-7), as are surrounding properties. The applicant requests an adjustment to have a six-foot-tall fence located in the required front setback, abutting a local street. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Community Development Code of the City of Tigard requires that all property owners of record within 500 feet of the subject site be notified of the proposal, and be given an opportunity to submit written comments prior to issuance of the decision. Staff mailed notices of this Type II application to affected parties on June 5, 2019. An e-mail was received from a neighbor on June 9, 2019, requesting more information about the proposal. City staff responded on June 10, 2019 with the requested information. An e-mail was received from the Pacific Crest Homeowners'Association (HOA) on June 10, 2019, stating that the applicant must apply for design review of the proposed fence through the HOA.The HOA policies and procedures are a private matter,and are not regulated or enforced by the City of Tigard; however, city staff forwarded a copy of this e-mail to the applicant. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.715 Adjustments 18.715.050 Approval Criteria The approval authority will approve or approve with conditions an adjustment application when all of the criteria in either Subsection 18.715.050.A or B are met. A. Criteria for demonstrating substantial compliance. 1. The proposed adjustment results in development that is generally consistent with the purpose of the development standard to be adjusted; As outlined in CDC 18.210.020.A, the maximum allowable height for a fence located in the required front setback abutting a local street is three (3) feet tall. The applicant requests an adjustment to have a six-foot-tall fence in the NOTICE OF DECISION PAGE 2 OF 5 ADJ2019-00010 WALDRON FENCE HEIGHT ADJUSTMENT southeast portion of the lot,adjacent to the property's curved front lot line,and located in the front setback area.The purpose of restricting fence height in the front setback area along a local street is to create a safe, comfortable, and attractive streetscape for pedestrians, and to encourage street visibility or "eyes on the street." Normally, with a rectangular interior lot,the front setback only applies to the area immediately adjacent to the front facade of a house. However,because the subject lot is irregularly shaped (triangular,with a long curved front lot line),the front setback abuts the house's front facade (facing west), and the side facade (facing south). Additionally, CDC 18.210.020.13 allows for fences up to eight (8) feet tall located in the side, street side, and rear setbacks. Accordingly, city staff finds the standard outlined in CDC 18.210.O20.A is intended to apply to the area immediately adjacent to the front facade of a house. The front facade of the subject house, and the area immediately adjacent to the front facade, contain existing design features that contribute to an attractive streetscape,including an on-site pedestrian walkway that connects to the public sidewalk, a covered front porch, and existing trees and landscaping. The applicant is not proposing to install a fence near the home's front facade, and instead proposes the adjustment in the southeast portion of the lot, immediately adjacent to the home's southern side facade.Therefore,the existing streetscape will not be impacted by this proposed adjustment, as the home's existing design features will continue to be visible from the public sidewalk. Additionally, the proposed adjustment will not impact visibility of the home's primary entrance on the front facade;therefore,street visibility and"eyes on the street"will be maintained.This criterion is met. 2. If more than one adjustment is proposed, the cumulative effect of the adjustments results in development that is generally consistent with the existing development pattern of the surrounding area and the overall purpose of the base zone; The applicant is not proposing more than one (1) adjustment. This criterion does not apply. 3. The proposed adjustment utilizes innovative design, results in sustainable development, or addresses a site constraint or unusual situation; The applicant states that the proposed adjustment addresses an unusual situation with the subject property. The situation is unusual because the subject lot is irregularly shaped (triangular with a long curved front lot line). As defined in CDC Chapter 18.30 Definitions, the front lot line,in the case of an interior lot,is the property line that abuts the street. Normally,with a rectangular interior lot,the front lot line only abuts the area immediately adjacent to the front facade of a house. However, because the subject lot is irregularly shaped, the front lot line abuts the house's front facade (facing west),and the side facade (facing south),which means the required front setback begins at the northwest property corner, runs parallel along the curved front lot line, and ends at the southeast property corner. As detailed in the previous section, the purpose of restricting fence height in the front setback area along a local street (CDC 18.21O.O2O.A) is to create a safe, comfortable, and attractive streetscape for pedestrians, and to encourage street visibility or"eyes on the street." However,this standard did not account for unusual situations with irregularly shaped lots (such as the subject lot), in which the front setback area applies to both the front and side facades of a house. Furthermore, CDC 18.210.O20.B allows for fences up to eight (8) feet tall located in the side, street side, and rear setbacks. Accordingly, city staff finds the standard outlined in CDC 18.210.02O.A is intended to apply to the area immediately adjacent to the front facade of a house. As stated in the previous section, the applicant is not proposing to install a fence near the home's front facade, and instead proposes the adjustment in the southeast portion of the lot, immediately adjacent to the home's southern side facade. Accordingly, staff finds the irregular shape of the subject lot creates an unusual situation that is addressed by the proposed adjustment. This criterion is met. 4. The proposed adjustment does not have a greater impact on city-designated sensitive lands than would otherwise occur if the adjustment was not approved; and NOTICE OF DECISION PAGE 3 OF 5 ADJ2019-00010 WALDRON FENCE HEIGHT ADJUSTMENT City maps show there are steep slopes (25 percent or greater) in the northwest portion of the subject property. The proposed adjustment will not impact these sensitive lands because the applicant proposes to install the fence only in the southeast portion of the lot. This criterion is met. 5. Any impacts from the proposed adjustment are mitigated to the extent practicable. As addressed in Section 18.715.050.A.1 and A.3, the existing streetscape will not be impacted by this proposed adjustment, as the home's existing design features will continue to be visible from the public sidewalk. Additionally, the proposed adjustment will not impact visibility of the home's primary entrance on the front facade;therefore,street visibility and "eyes on the street"will be maintained. Furthermore, staff has included a condition of approval for the applicant to maintain vision clearance for the driveway on the subject property,and for the driveway on the adjacent property to the east (13810 SW Sandridge Drive;WCTM 2S105DD,Tax Lot 2500).This criterion is met. SECTION VI. OTHER STAFF COMMENTS The City of Tigard Public Works Department was sent a copy of the applicant's proposal, and responded on June 6, 2019. The department noted there is an existing water meter on the southeast corner of the site. The applicant is required to maintain a two-foot clearance from the water meter, and must place the fence accordingly. This requirement has been included as a condition of approval to this decision. SECTION VII. AGENCY COMMENTS Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal, and had no objections. SECTION VIII. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Community Development Code of the City of Tigard requires that all property owners of record within 500 feet of the subject site be notified of the proposal, and be given an opportunity to submit written comments prior to issuance of the decision. Staff mailed notices of this Type II application to affected parties on June 5, 2019. An e-mail was received from a neighbor on June 9, 2019, requesting more information about the proposal. City staff responded on June 10, 2019 with the requested information. An e -mail was received from the Pacific Crest Homeowners’ Association (HOA) on June 10, 2019, stating that the applicant must apply for design review of the proposed fence through the HOA. The HOA policies and procedures are a private matter, and are not regulated or enforced by the City of Tigard; however, city staff forwarded a copy of this e-mail to the applicant. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.715 Adjustments 18.715.050 Approval Criteria The approval authority will approve or approve with conditions an adjustment application when all of the criteria in either Subsection 18.715.050.A or B are met. A. Criteria for demonstrating substantial compliance. 1. The proposed adjustment results in development that is generally consistent with the purpose of the development standard to be adjusted; As outlined in CDC 18.210.020.A, the maximum allowable height for a fence located in the required front setback abutting a local street is three (3) feet tall. However, because the subject lot is irregularly shaped (triangular, with a long curved front lot line), the front setback abuts the house’s front façade (facing west), and the side façade (facing south). Additionally, CDC 18.210.020.B allows for fences up to eight (8) feet tall located in the side, street side, and rear setbacks. Accordingly, city staff finds the standard outlined in CDC 18.210.020.A is intended to apply to the area immediately adjacent to the f ront façade of a house. The front façade of the subject house, and the area immediately adjacent to the front façade, contain existing design features that contribute to an attractive streetscape, including an on-site pedestrian walkway that connects to the public sidewalk, a covered front porch, and existing trees and landscaping. The applicant is not proposing to install a fence near the home’s front façade, and instead proposes the adjustment in the southeast portion of the lot, immediately adjacent to the home’s southern side façade. Therefore, the existing streetscape will not be impacted by this proposed adjustment, as the home’s existing design features will continue to be visible from the public sidewalk. Additionally, the proposed adjustment will not impact visibility of the home’s primary entrance on the front façade; therefore, street visibility and “eyes on the street” will be maintained. As defined in CDC Chapter 18.30 Definitions, the front lot line, in the case of an interior lot, is the property line that abuts the street. Normally, with a rectangular interior lot, the front lot line only abuts the area immediately adjacent to the front façade of a house. However, because the subject lot is irregularly shaped, the front lot line abuts the house’s front façade (facing west), and the side façade (facing south), which means the required front setback begins at the northwest property corner, runs parallel alon g the curved front lot line, and ends at the southeast property corner. As detailed in the previous section, the purpose of restricting fence height in the front setback area along a local street (CDC 18.210.020.A) is to create a safe, comfortable, and attractive streetscape for pedestrians, and to encourage street visibility or “eyes on the street.” However, this standard did not account for unusual situations with irregularly shaped lots (such as the subject lot), in which the front setback area applies to both the front and side façades of a house. Furthermore, CDC 18.210.020.B allows for fences up to eight (8) feet tall located in the side, street side, and rear setbacks. Accordingly, city staff finds the standard outlined in CDC 18.210.020.A is intended to apply to the area immediately adjacent to the front façade of a house . As stated in the previous section, the applicant is not proposing to install a fence near the home’s front façade, and instead proposes the adjustment in the southeast portion of the lot, immediately adjacent to the home’s southern side façade. Accordingly, staff finds the irregular shape of the subject lot creates an unusual situation that is addressed by the proposed adjustment. This criterion is met. 4. The proposed adjustment will not impact these sensitive lands because the applicant proposes to install the fence only in the southeast portion of the lot. This criterion is met. 5. Any impacts from the proposed adjustment are mitigated to the extent practicable. As addressed in Section 18.715.050.A.1 and A.3, the existing streetscape will not be impacted by this proposed adjustment, as the home’s existing design features will continue to be visible from the public sidewalk. Additionally, the proposed adjustment will not impact visibility of the home’s primary entrance on the front façade; therefore, street visibility and “eyes on the street” will be maintained.
