The modification includes removing one tree planned for preservation on Lot 2 (tree 6661). PLAN AND ZONING DESIGNATION: R-7: medium-density residential district. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: The applicable Community Development Code Chapters for the proposed modification is 18.790. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. UFR2015-00002 Hoggans Park Urban Forestry Plan Modification 1 of 3 SECTION III. BACKGROUND INFORMATION Site Information The 1.8 acre,three-parcel site located on the southwest corner of SW Ross Street and SW 81st Avenue and is zoned R-4.5 (low-density residential). The site is relatively flat. The north parcel (8200 SW Ross Street) is currently developed with a single family residence and an accessory structure. The south parcel (15233 SW 81st Avenue) is developed single family residence. The middle parcel (no street address) is developed with an accessory structure. In 2014 a twelve-lot subdivision was approved on the three-parcel site (SUB2014-00006) that would demolish all structures with the exception of the house located at 15233 SW 81st Avenue. The development will be served by the existing SW Ross Street and SW 81st Avenue as well as the extension of SW Norfolk Lane to the east,connecting to SW 81st Avenue. Proposal Description The applicant proposes to modify the Urban Forestry Plan approved under SUB2014-00006. The modification includes removing one Willamette Valley Ponderosa Pine planned for preservation on Lot 2 (tree #6661). This tree was originally proposed for retention, but adequate protection is no longer feasible based on required street and utility improvements. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Urban Forestry (18.790) 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements. An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor (the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual; 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and 4. Meet the supplemental report standards in the Urban Forestry Manual. The application included a revised Urban Forestry Plan Supplemental Report (revised April 20, 2015) by Morgan Holen, the project arborist, a certified arborist and tree risk assessor. The revised plan meets the tree preservation and removal site plan standards, the tree canopy site plan standards, and the supplemental report standards in the Urban Forestry Manual as attested to by the project arborist. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. The proposed modification to the Urban Forestry Plan component of SUB2014-00006 does not meet any of the exemptions of subsection B and therefore shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; UFR2015-00002 Hoggans Park Urban Forestry Plan Modification 2 of 3 The project arborist has provided a report and statement (Supplemental Report, revised April 20, 2015) certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification. Tree 6661 shown on Lot 2 is in generally good condition but adequate protection is no longer feasible due to road improvements unanticipated at the time of application. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist has provided a revised report and statement (Supplemental Report, dated April 20, 2015) certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The project arborist has provided revised plans and a supplemental report showing compliance with 18.790.030,including preservation, protection and canopy standards. This criterion is met. FINDING: As shown in the analysis above, the proposed modification to the urban forestry plan component of SUB2014-00006 meets the applicable approval criteria and can be approved. SECTION V. General Description The existing site consists of two single-family homes, one detached garage,and three sheds,with open space and trees scattered across the site and in a small group in the northwest quadrant of the property. One of the two existing homes will remain on lot 12,while other existing structures are planned for demolition.Twelve residential lots and a new storm water facility are planned for development. In all, 22 existing trees measuring six inches and larger in diameter were inventoried, including 11 different tree species. Douglas-fir(Pseudotsuga menziesii) accounted for 9 (41%)of the inventoried trees.The Douglas-firs comprise the majority of trees located in the small group in the northwest area of the site.These trees appeared in mostly good condition, but are suitable for retention as an intact group only as selective removal would result in negative impacts to the protection of remaining trees. Other inventoried trees include a number of mature and over-mature fruit trees, a small American holly(Ilex opaca), Oregon ashes (Fraxinus latifolia),western redcedars (Thuja plicata)and a scots pine(Pinus sylvestris)with structural defects, and a non-native and invasive European white birch (Betula pendula). The best existing tree is a 44-inch diameter Willamette Valley ponderosa pine (Pinus ponderosa var. willamettensis) located along Ross Street in the front of proposed lot 2.This tree,#6661, has good vigor and crown density and is prominent along the street. It does have forked tops, but they appear stable based on visual assessment from the ground.Although this tree was initially planned for preservation, adequate protection is not going to be feasible based on the required street improvements,which were not accounted for in the previously approved Urban Forestry Plan. First of all,this tree is located in the middle of the public utility easement and all of the existing overhead utilities will be put underground. While it would be possible to install the utilities underground by boring, removal of the tree will allow for the utilities to be installed by digging a trench. Moreover,the face of the tree trunk is less than 5-feet from the future sidewalk and the street will be widened with a new curb approximately 10-feet from the face of the tree. Although the sidewalk could be built with minimal excavation,the street construction requires nearly 2-feet of excavation;the required street excavation within the critical root zone is expected to result in detrimental tree root impacts.Therefore,tree#6661 is recommended for removal for the purposes of construction. Effective Tree Canopy Cover A summary of the effective tree canopy cover by lot and across the overall development site is included as attachment B.Attachment C,the planted tree inventory, describes 25 street trees proposed for planting and the size of the planted storm water facility at Tract A. The required number of street trees is based on the linear right-of-way frontage divided by 40.The total frontage is 1,011 linear feet.Therefore 25 street trees are required and proposed.The proposed street trees comply with the street tree planting standards in Section 2 of the Urban Forestry Manual and with the soil volume standards in Section 12. The table below provides a summary of the effective tree canopy cover by lot and demonstrates that the 15% minimum effective tree canopy cover per lot requirement is satisfied. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual,which illustrate how the Urban Forestry Plan requirements are met. Specifications A. Soil Characteristics and Specifications for Improvement Native soils at the project site consist of moderately well-drained Quatama loam (^'72%)and well-drained Hillsboro loam (-28%),which are both deep and capable of supporting healthy tree growth. No soil improvements are proposed. If soil compaction occurs during construction,the project arborist shall provide additional recommendations as needed. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual. They shall be planted in accordance with the American National Standards Institute (ANSI)standards for tree planting(A300, Part 6)and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock(ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability.
