APPLICATION SUMMARY FILE NAME: Twality Middle School/ Templeton Elementary School CASE NO.: Minor Modification CUP2018-00007 PROPOSAL: The applicant requests a minor modification to an approved conditional use for Twality Middle School (located at 14650 SW 97th Avenue) and Templeton Elementary School (located at 9500 SW Murdock Street). Specifically,the applicant proposes to: reduce the footprint and height of the approved Twality building; remove an approved covered play area located at the southern end of the building, and replace it with an auxiliary gym; modify the approved east elevation for this building;modify the proposed building materials;remove an approved access lane located at the southern end of the Twality campus;modify the Twality parking lot; and relocate an approved trash and recycling area. The applicant also proposes a temporary parking area on the Twality campus that will be utilized during construction. The R-4.5 zone is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request,subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION MUST BE SATISFIED: Unless noted otherwise, the staff contact shall be Lina Smith,Assistant Planner; (503) 718-2438 or LinaCW,tigard-or.gov. 1. The applicant must submit a revised tree canopy site plan and supplemental report for review and approval by the City of Tigard Planning Division. These revised materials must reflect any proposed changes to the previously approved Urban Forestry Plan from Case Nos. PDR2017-00002, CUP2017-00003, and ADJ2017-00014. Unless the proposed changes are exempt under CDC 18.520.070.B, the applicant must also apply for a Type I Modification to the previously approved Urban Forestry Plan. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at Twality Middle School(14650 SW 97th Avenue;WCTM 2S11IAC,Tax Lot 2700) and Templeton Elementary School (9500 SW Murdock Street; WCTM 2S11IAC, Tax Lot 2901). The schools are located north of SW Sattler Street, south of SW Inez Street,west of SW 92"Avenue,and east of SW 97th Avenue. In December 2017, the City of Tigard Planning Commission approved a Planned Development and Conditional Use Permit at the project site (Case Nos. PDR2017-00002, CUP2017- 00003, and ADJ2017-00014). This approval was for a 160,000-square-foot education building on the Twality campus, and a 75,000-square-foot education building on the Templeton campus. The site is zoned Low-Density Residential (R-4.5). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.740 Conditional Use: 18.740.020.0 Minor modification of approved or existing conditional use. 2. An application for a minor modification shall be processed through a Type I procedure, as provided in Section 18.710.050The approval authority shall approve or approve with conditions the minor modification application when all of the following are met: a. The proposed development is in compliance with all applicable requirements of this title; and In December 2017, the City of Tigard Planning Commission approved a 160,000-square-foot education building on the Twality campus (Case Nos. PDR2017-00002, CUP2017-00003, and ADJ2017-00014). The applicant proposes to modify this approval by reducing the building footprint from 160,000 square feet in size to 145,000 square feet in size,reducing the building height to 44 feet(to the top of the parapet), CUP2018-00007 Twality/Templeton 2 removing a covered play area located at the southern end of the building, and replacing it with an auxiliary gym. Staff reviewed the applicant's materials to confirm these modifications comply with all applicable requirements of this Title, and the approved development standards for Case Nos. PDR2017-00002, CUP2017-00003, and ADJ2017-00014, including minimum setbacks and the maximum building height of 51 feet. The applicant proposes to modify the design of the eastern building facade, in order to incorporate a larger, open courtyard. Additionally, the applicant proposes minor modifications to the exterior building design and materials. Staff reviewed the applicant's materials to confirm these modifications comply with all applicable requirements of this Title, and the approved development standards for Case Nos. PDR2017-00002, CUP2017-00003, and ADJ2017-00014. The applicant proposes to remove an approved access lane located at the southern end of the Twality campus. The applicant's narrative states this access lane was originally intended for school maintenance vehicles,and was provided for convenience only.This access lane was never designed as a primary access point to and from the site; accordingly,removing it will not have any impacts to off-site traffic. The applicant proposes to remove parking spaces from the southern end of the Twality campus, and relocate them to the main Twality parking lot(located in the northwest corner of campus).As determined in Case Nos. PDR2017-00002, CUP2017-00003, and ADJ2017-00014, the total minimum off-street parking requirement for Twality Middle School and Templeton Elementary School is 180 spaces. Staff reviewed the applicant's site plan to confirm that even with the proposed modification, there will still be adequate off-street parking,with 236 spaces provided: 100 spaces on the Twality campus,and 136 spaces on the Templeton campus. The applicant proposes to relocate an approved trash and recycling area, so it will be closer to the kitchen and southwest driveway on the Twality campus. The applicant submitted documentation of approval from the franchised hauler, Pride Disposal, for the new location. Additionally, staff reviewed the applicant's elevation drawings to confirm the new trash and recycling area will be screened from view by an approximately seven-foot-tall opaque fence with an access gate (CDC 18.320.050.D.4). The applicant proposes to create a temporary gravel parking lot that will only be utili7ed during construction and renovation at the Twality campus. The parking lot will be located east of the existing track and field. The following are the regulations that apply to permanent gravel parking and parking accessory to approved temporary uses: CDC 18.310.040 General Design Standards H. Parking space surfacing. 3. Parking areas to be used primarily for the storage of fleet vehicles or construction equipment may be surfaced in gravel when authorized by the approval authority at the time the land use approval is given. The director may require that the property owner enter into an agreement to pave the parking area: (a) within a specified period of time after establishment of the parking area; or(b) if there is a change in the types or weights of vehicles utilizing the parking area; or (c) if there is evidence of adverse effects upon adjacent roadways, water courses, or properties. Such an agreement shall be executed as a condition of approval of the plan to establish the gravel parking area. Gravel-surfaced parking areas may only be permitted consistent with the following: a. Gravel parking areas shall not be permitted within 100 feet of any residential zone or residentially-developed area; b. Gravel access or parking areas shall not be allowed within 100 feet of any water course; c. Gravel parking areas shall not be allowed within 100 feet of any public right-of-way; and d. A driveway that connects a gravel parking area with any public street shall be paved. CUP2018-00007 Twality/Templeton 3 4. Parking areas to be used in conjunction with a temporary use may be surfaced in gravel when authorized by the approval authority at the time the temporary use is approved. The approval authority shall consider the following in determining whether or not the gravel-surfaced parking is warranted: a. The request for consideration to allow a parking area in conjunction with the temporary use shall be made concurrently with the temporary use application as provided in Section 18.440, Temporary Uses. b. The applicant shall provide documentation that the type of temporary use requested will not be financially viable if the parking space surface area requirement is imposed, and c. Approval of the gravel-surfaced parking area will not create adverse conditions affecting safe ingress and egress when combined with other uses of the property. The proposed gravel parking lot is neither a permanent gravel lot nor accessory to a temporary use. It is a temporary gravel lot to be used only during construction. As such, it does not fall clearly under either criterion. However,the location of the gravel lot is greater than 100 feet from any residentially-developed areas, water courses, or public rights-of-way, and it connects to a paved driveway. The lot is temporary and will not create adverse conditions affecting safe ingress and egress when combined with other uses of the property,and is necessary for the school construction project to be financially viable.Accordingly, the lot is allowable under the current regulations as a temporary lot during construction.Additionally,the Building Official will review the proposed gravel parking lot for compliance with all applicable ADA standards at the time of building permit submittal. Upon review of the applicant's materials, staff finds that all other requirements of this Title are not applicable. This criterion is met. b. The modification is not a major modification as defined in subsection A of this section. The applicant is not proposing any of the changes outlined in TDC 18.740.020.B.2. Therefore, this proposal is not a major modification.This criterion is met. CONCLUSION: The proposal is a minor modification of an approved conditional use and is in compliance with the applicable requirements of this Title. SECTION V. The City concurred that the replacement of the Urban Forestry Fund trees is separate from the Type I application, and the applicant should coordinate separately with the City (Brian Rager) on compliance with the associated MOU. The applicant will follow up separately with the City on this issue. B. The City indicated that the applicant needs to demonstrate compliance with the Urban Forestry section of the TDC (Chapter 18.520) with specific documentation. This includes a final calculation of final tree canopy proposed to demonstrate compliance with the 30% minimum tree canopy cover for parking areas and 25%overall. However, staff indicated in the meeting that this requirement can be a condition of approval for this Type I Modifications application (CUP2018-00007), and does not need to be provided as part of the application prior to the decision. The applicant's landscape architect (Nick Wilson) will provide this documentation to the City as part of the associated condition of approval in the decision for CUP2018-00007. Therefore, there is no change in the number of permanent parking spaces proposed. D. In the meeting, the applicant clarified for the City that the proposed temporary parking lot is also part of the modifications application. Because the Commons/lunchroom was built in 2004 and major seismic improvements were made to the gym in 2011, that section of the building is not being considered for the rebuild. Project Description and Application The applicant requests several minor changes to the approved application under Planned Development Review PDR2017-00002), Conditional Use Permit(CUP2017-00003) and Adjustment(ADJ2017-00014). The initial application and subsequent approval under these approved land use cases proposed both new construction and renovation at both the Twality Middle School and the Templeton Elementary School. The original application was approved by the Tigard Planning Commission on December 11, 2017 for a Type Ill Conditional Use Permit(CUP) and Planned Development, with a Type II Adjustment for a reduction in the minimum bicycle parking requirements. This application and request for modifications is for Twality Middle School only. The 145,000 square-foot education building on the Twality campus and the 75,000 square-foot education building on the Templeton campus are both intended for classrooms, administrative offices and common areas with associated on-site parking, connective walkways and landscaping. Twality is a major addition of 125,000 square feet and remodel of 20,000 square feet. The property is zoned R-4.5, which allowed the proposed changes as a School in the R-4.5 Zoning District as a Conditional Use. The applicant also received approval of a Concept Plan that was part of the concurrent Planned Development application. The proposed Templeton Elementary School is 204.67 feet from the front setback along SW Murdock Street and the end of SW SW Murdock Street. Both of the school buildings are also over 30 feet from any applicable side and rear setbacks. In addition, the applicant was approved for a Planned Development that allowed reductions in the setbacks as part of that application. The setbacks established under the Planned Development proposal superseded the setback standards in this Chapter. As demonstrated by the attached Plan Set in Exhibit C, the proposed revisions will not reduce existing approved setbacks for the original approval. Therefore, this proposal does not meet the change threshold for a Major Modification. g. An elimination of project amenities by more than 10 percent where previously specified provided such as: i. Recreational facilities, Response: The proposed modifications include the removal of the covered playground. The attached Plan Set demonstrates that the existing Active Use Facilities (recreational facilities) occupy approximately 146,000 square feet and the proposed covered playground occupies approximately 5,000 square feet. The covered playground only covers approximately 3.4% of the overall recreational facilities. Overall, proposed landscaping will continue to be proposed based on the Concept Plan and Landscape Plan approved as part of the previously approved Planned Development Review(PDR2017-00002) and Conditional Use Permit(CUP2017- 00003). Since existing screening and/or buffering is maintained with this proposal, it does not meet the change threshold for a Major Modification. iii. Landscaping provisions. Response: As indicated above, none of the trees included in the original approval will be removed in order to accommodate the proposed modifications. Overall, proposed landscaping will continue to be proposed based on the Concept Plan and Landscape Plan approved as part of the previously approved Planned Development Review(PDR2017-00002) and Conditional Use Permit(CUP2017-00003). Since existing screening and/or buffering is retained with this proposal, it does not meet the change threshold for a Major Modification. 3. When the proposed modification to the conditional use is a major modification, a new conditional use permit application shall be submitted in compliance with this chapter. Response: As indicated above in the findings for change thresholds associated with determination of Minor or Major Modification, this proposal is classified as a Type I Minor Modification of an existing conditional use, and does not required a New Conditional Use or a Major Modification. C. Minor modification of approved or existing conditional use. 1. Any modification that is not within the description of a major modification as provided in subsection B of this section shall be considered a minor modification. Response: In the responses provided above, the applicant has demonstrated that the proposed modifications do not meet the change thresholds for a Major Modification. 2. An application for a minor modification shall be processed through a Type I procedure, as provided in Section 18.710.050. The approval authority shall approve or approve with conditions the minor modification application when all of the following are met: a. The proposed development is in compliance with all applicable requirements of this title; and b. The modification is not a major modification as defined in subsection A of this section. Response: The applicant has submitted a proposal to modify the previously approved Planned Development Review (PDR2017-00002) and Conditional Use Permit(CUP2017-00003) through the City's Type I procedure. The applicant's narrative and exhibits in this Type I application request minor changes to the approved application. The previously approved application complies with all applicable requirements of this title. Through minor modifications, the applicant is confirming compliance with the applicable requirements of the Title that were reviewed and approved through the Planned Development Review(PDR2017- 00002) and Conditional Use Permit(CUP2017-00003). Compliance with specific modifications are indicated below for the following: Tigard High School Cardno Type I, Minor Modification 10 Submitted: November 14,2018 • Reduction in overall building size from 160,000 square feet to 145,000 square feet. • Reduction in maximum building height from 51 feet to 41 feet. • Removal of covered play area at south side of building. • New auxiliary gym at south side of building, replacing the covered play structure. • Reduction and shift of northern building edge to be further away from the north property line and setback. • Revisions to east elevation of building. Classroom wing height reduced from three-stories to two-stories and rotated to face north-south with a courtyard in-between two wings. • Revisions to materials selections. CMU masonry replaced by a high-density fiber cement panel. • Revisions to south side access lane. The convenience access lane for District maintenance was deleted. Finally, as discussed in the responses provided above, the proposed development does not meet the threshold for a Major Modification. The submitted Plan Set and Elevations indicate that the existing and proposed modifications will either reduce the areas previously proposed, or otherwise insignificantly affect the previously approved application under Planned Development Review(PDR2017-00002) and Conditional Use Permit(CUP2017-00003). Based on the responses in the narrative and attached exhibits, the proposed development is classified as a Type I Minor Modification. D. Approval period. Conditional use approval shall be effective for a period of 1.5 years from the date of approval. The approval shall lapse if: 1. Substantial construction of the approved plan has not begun within a 1.5 year period; or 2. Construction on the site is a departure from the approved plan. (Ord. 09-13) Response: As required, the applicant will fulfill all issued conditions of approval. E. Phased development approval. As part of the approval process, the approval authority shall approve a time schedule for developing a site in phases over a period of time of 1 year, but in no case shall the total time period for all phases be greater than 3 years without reapplying for conditional use review. The criteria for approving a phased conditional use review proposal is that all of the following are met: 1. The public facilities shall be constructed in conjunction with or prior to each phase. 2. The development and occupancy of any phase shall not be dependent on the use of temporary public facilities. A temporary public facility is any facility not constructed to the applicable city or district standard. 3. The phased development shall not result in requiring the city or other property owners to construct public facilities that were required as part of the approved development proposal. Response: The applicant is not proposing a phased development with this Minor Modification. 18.910.100 Storm Drainage A. General provisions. The director and city engineer shall issue a development permit only where adequate provisions for stormwater and floodwater runoff have been made, and: 1. The storm water drainage system shall be separate and independent of any sanitary sewerage system; 2. Where possible, inlets shall be provided so surface water is not carried across any intersection or allowed to flood any street; and Tigard High School Cardno Type I, Minor Modification 11 Submitted: November 14,2018 3. Surface water drainage patterns shall be shown on every development proposal plan. Response: An updated Stormwater Report will be submitted to the City of Tigard mid-December for the Public Facilities Infrastructure (PFI) Permit. This updated report includes all of the proposed modifications included in this application. The original Preliminary Stormwater Report(and associated calculations) both convey and outline compliance with the City of Tigard and Clean Water Services' (CWS) Design & Construction Standards. A conveyance network of underground piping will both treat and convey runoff to public storm mains located at the perimeter of the site and in public-right-of-way. The storm drainage system is completely separate from the sanitary sewer system. B. Easements. Where a development is traversed by a watercourse, drainageway, channel or stream, there shall be provided a stormwater easement or drainage right-of-way conforming substantially with the lines of such watercourse and such further width as will be adequate for conveyance and maintenance. Response: As shown on the Existing Conditions Plan and the Site Plan in the Plan Set, there are some existing easements at various locations on the site. No known watercourses, drainageways, channels or streams traverse the site. C. Accommodation of upstream drainage. A culvert or other drainage facility shall be large enough to accommodate potential runoff from its entire upstream drainage area, whether inside or outside the development, and the city engineer shall approve the necessary size of the facility, based on Clean Water Services requirements. Response: The onsite conveyance system will be designed to Clean Water Services standards. The public storm sewer facility downstream of the site has been analyzed and will function to those standards after development. See attached Drainage Report for details. D. Effect on downstream drainage. Where it is anticipated by the city engineer that the additional runoff resulting from the development will overload an existing drainage facility, the director and engineer shall withhold approval of the development until provisions have been made for improvement of the potential condition or until provisions have been made for storage of additional runoff caused by the development in compliance with Clean Water Services requirements. Response: A downstream analysis was conducted and additional runoff from the site will not impede the function of the existing public storm sewer facility downstream of the site. See updated Drainage Report for details. III. CONCLUSION Based on the above findings, the applicant has demonstrated compliance with applicable sections of the Tigard Community Development Code. Therefore, the applicant requests that the submitted Minor Modification to the previously approved Planned Development Review(PDR2017-00002) and Conditional Use Permit(CUP2017-00003) be approved. These requirements will need to be met to ensure our access: • The gates need to be hinged in front of the enclosure walls to allow for the full 20' width. This will also allow for the 120 degree opening angle that is required. • No center post at the gate access point. • The gates need cane bolts and holes put in place for the gates to be locked in the open and closed position. The holes for the gates to be held open need to be at the full 120 degree opening angle. • There must be 25' of overhead clearance. • There must be 75' of unobstructed access to the front of the enclosure (no parking island, parked vehicles, light pole, buildings, etc.).
