DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section N. UFR2019-00005 Summerbrook—Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site Information: The subject properties are Lots 13 and 15 of the Summerbrook Subdivision (Case No. SUB2017-0009), which was approved by the City of Tigard Hearings Officer in June 2018. This approval was for 15-lot subdivision, located on the east side of SW 1215` Avenue, north of SW North Dakota Street, and south of SW Springwood Drive. The properties are zoned R-4.5 (Low-Density Residential), as are adjacent properties. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.420.060.F.Urban forestry plan modification. Except as exempted in Paragraph 18.420.060.F.1, an application to modify the urban forestry plan component of a land use approval is processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Paragraph 18.420.060.F.2. The applicant proposes to modify the Urban Forestry Plan approved under the Summerbrook Subdivision (Case No. SUB2017-00009). Specifically, the applicant proposes to remove two (2) trees on Lot 13 and one(1)tree on Lot 15 that were originally proposed for preservation,in order to accommodate larger building footprints for new homes. The removal of these trees is not exempt from the Type I Urban Forestry Plan Modification. Therefore, this application is subject to the approval criteria outlined below.Additionally,the applicant proposes to modify the location of tree protection fencing,and to plant two (2) new Oregon White Oaks. 2. Approval criteria. The approval authority will approve or approve with conditions the modification to the urban forestry plan component of a land use approval when all of the following are met: a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that led to the proposed modification; The project arborist has provided a revised report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. During land use review, the applicant provided estimated building footprints for the proposed new homes on Lots 13 and 15. The applicant has now completed final building plans for the proposed new homes, and the building footprints are larger than the ones proposed during land use review. Accordingly, the applicant proposes to remove two (2) trees on Lot 13 and one (1) tree on Lot 15 that were originally proposed for preservation, in order to accommodate the larger building footprints. Additionally, the applicant proposes to modify the location of tree protection fencing, and to plant two (2) new Oregon White Oaks. This criterion is met. b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification. This criterion is met. c. The project arborist or landscape architect demonstrates compliance with Subsection 18.420.060.B through a modified urban forestry plan. (Ord. 18-28 §1) The project arborist submitted a revised Urban Forestry Plan and supplemental report that demonstrate UFR2019-00005 Summerbrook—Urban Forestry Plan Modification 2 compliance with CDC 18.420.060.B,including tree preservation, protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Summerbrook Subdivision meets all applicable approval criteria. In addition, in reviewing the recorded plat I recognized minor changes in the square footage of each lot/tract and adjusted the Effective Tree Canopy Cover Summary accordingly.This resulted in slight changes to the per lot/tract canopy cover percentages, although the minimum effective tree canopy cover requirements continue to be satisfied. Lots were also renumbered,so the new numbers are noted. This memorandum addresses the criteria regarding modifications to the Urban Forestry Plan component of an approved Land Use Permit contained in Section 18.420.060 of the City's Community Development Code.The complete revised Urban Forestry Plan is enclosed. Section 18.420.060.F.2 provides the approval criteria for modifications to the Urban Forestry Plan components of an approved land use permit. Each of the pertinent criteria are addressed below. a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modifications because a smaller building footprint was assumed on both lots 1 and 3.The critical root zones of trees#11176 and#11702 are well within the allowable building envelopes at lots 1 and 3, respectively, and protection is not feasible since the proposed homes will encompass the entire buildable areas.Tree#11703, also on lot 3, must be removed because it is not suitable for preservation once exposed by the removal of adjacent tree#11702. The proposed location of tree protection fencing is adjusted at lots 1 and 3 to continue to protect the remaining trees.Two new Oregon white oaks are proposed to be planted on lots 6 and 11. The enclosed modified Urban Forestry Plan provides complete documentation of the proposed modifications. b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and There is no practicable alternative to the proposed modifications because the developer is allowed to utilize the entire allowable building envelop and by doing so, adequate protection cannot be provided for the trees proposed for removal. The proposed modifications are not exempt from the Type 1 process because the condition and preservation ratings of the three trees now proposed for removal have not changed and effective canopy cover decreased from the original approval.A$764 application fee will be required to process the Urban Forestry Plan modification. This report describes the existing trees located on the subject site, provides arborist recommendations for tree removal, retention and protection, and describes the effective tree canopy cover needed to meet City requirements.This report is based on observations made by International Society of Arboriculture Board Certified Master Arborist (PN-6145B) and Qualified Tree Risk Assessor Morgan Holen during site visits conducted on August 9, 2017 and January 9, 2018, and subsequent coordination with Emerio Design.This report was modified on March 20,2019 to remove three trees that were originally proposed for preservation in order to accommodate larger building footprints for new homes.Accordingly,the location of tree protection fencing has been modified and two new Oregon White Oaks are proposed to be planted.Also,following land use approval, lots were renumbered and lot sizes changed slightly with the final plat;these changes are accounted for in this modified report. Changes are identified in bold underlined type. General Description The site is located at 10900 SW 121'Avenue in Tigard, Oregon. The site is zoned R-4.5 and does not contain any flood plain, drainage hazard areas, or significant natural resources.An existing church building and paved parking lot are separate from the subdivision site.The subdivision site is primarily an undeveloped open field,with one existing house that will be demolished for site development.The project proposes a 15-lot single family residential subdivision with new streets and a water quality tract. In all,46 trees of 18 different species are included in the inventory.A complete description of individual trees is included in the enclosed existing tree inventory data (attachment A).The existing trees are scattered across the site, but predominately located near the existing home and along property boundaries.Two of the inventoried trees are located off-site; other off-site trees directly adjacent to the site are not included in the inventory data, but are shown for protection on drawings. Off-site trees with canopies overhanging the project site are planned for protection during site development. Of the 44 inventoried trees located on-site, 38 are planned for removal for the purposes of site development and six are planned for preservation in the rear of proposed lots 1, 2, 3,and 10 (modified lot numbers 15, 14, 13 and 5, respectively).Tree protection fencing should be installed at the dripline of protected trees at a minimum, and the contractor should coordinate with the project arborist prior to adjusting tree protection fencing where minor encroachments may be needed for construction. Work that is necessary beneath protected tree driplines should be monitored and documented by the project arborist. Effective Tree Canopy Cover A summary of the effective tree canopy cover by lot/tract and across the overall development site is included as attachment B.Attachment C,the planted tree inventory, describes 50 individual trees proposed for planting. Urban Forest Plan-Supplemental Report Summerbrook 15-Lot Subdivision,Tigard,OR February 2,2018 I Modified:April 7,2019 Page 2 of 5 The six existing trees to be retained all received condition and preservation ratings greater than 1 and provide double canopy cover credit,which equates to 7,665 square feet. The required number of street trees is based on the lineal street frontage divided by 40.The total frontage is 1,860-lineal feet.Therefore,47 street trees are required, as is proposed.The proposed street trees are hedge maples (Acer campestre) or raywood ashes (Fraxinus oxycarpa 'Raywood'),which provide 707 square feet of canopy credit each.The proposed street trees provide the closest and best spacing possible, and comply with the street tree planting standards in Section 2 of the Urban Forestry Manual and with the soil volume standards in Section 12. One additional tree is proposed to be planted in the rear of Tract B,the water quality tract, in order to satisfy the effective tree canopy cover requirements.The proposed tree is an Oregon white oak (Quercus garryana), which provides 1,963 square feet of canopy cover.This native species tree receives 1.25 times canopy cover credit,for a total of 2,454 square feet. With the proposed modification,canopy credit is no longer provided for three existing trees now proposed for removal to accommodate larger building footprints:tree 11176 on lot 1 (modified lot number 15)and trees 11702 and 11703 on lot 3 (modified lot number 13). In order to maintain a minimum 40%effective tree canopy cover for the overall development site,two additional Oregon white oaks are now proposed to be planted in the yards of lots 6 and 11 (modified lots numbers 1 and 6, respectively).These trees provide 4,908 square feet of canopy credit at 1.25 times 1,963 square feet each. The table below provides a summary of the effective tree canopy cover by lot and demonstrates that the 15% minimum effective tree canopy cover per lot requirement is satisfied. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual,which illustrate how the Urban Forestry Plan requirements are met. Specifications A. Tree Protection Specifications 1. Tree Protection Zone.The Tree Protection Zone (TPZ)shall be established at the dripline of protected trees as a minimum. If infrastructure must be installed closer to protected trees, the TPZ may be established within the dripline area if the project arborist determines that the trees will not be unduly damaged. The contractor is responsible for coordinating with the project arborist prior to working beneath protected tree driplines. 2. Protection Fencing.All trees to be retained shall be protected by 5-foot tall metal fencing unless otherwise approved by the city manager or designee. Protection fencing shall be secured to steel posts placed no further than 8-feet apart and shall be installed at the edge of the TPZ. 3. Special Protection. In addition to tree protection fencing,silt fencing shall be installed outside of the tree protection fencing as special protection for Port-Orford-cedars which are highly susceptible to root disease. Do not trench silt fencing in per manufacturer's specifications; instead, roll the base of the silt fence in a straw wattle and stake it taught to the ground. 4. Preconstruction Conference.The project arborist shall be on site to discuss methods of tree removal and tree protection prior to any construction. 5. Pruning.The project arborist can help identify if and where pruning is necessary once trees planned for removal have been removed and the site is staked and prepared for construction. Pruning shall be performed by a Qualified Tree Service. 6. Tree Protection Zone Maintenance.The protection fencing shall not be moved, removed, or entered by equipment except under direction of the project arborist. 7. Storage of Material or Equipment.The contractor shall not store materials or equipment within the TPZ. 8. Excavation. Excavation beneath protected tree driplines shall be avoided if alternatives are available. If excavation is unavoidable,the project arborist shall evaluate the proposed excavation to determine methods to minimize impacts to trees.All construction beneath the dripline of protected trees shall be under the on-site technical supervision of the project arborist. 9. Surfacing.Where surfacing is proposed within the TPZ, coordinate with the project arborist to provide recommendations for adjustments to protection fencing and to monitor construction.Avoid excavation and use a modified profile to build up from existing grade. This profile includes a layer of permeable geotextile fabric on the ground surface and clean crushed rock to raise the grade as needed. Surfacing may include asphalt, concrete, or other materials. If excavation is necessary,work shall be performed under arborist supervision. Following construction and where landscaping is desired, apply approximately 3-inches of mulch beneath the dripline of protected trees, but not directly against tree trunks. Shrubs and ground covers may be planted within tree protection areas. If irrigation is used, use drip irrigation installed at native grade (no trenching) only beneath the driplines of protected trees. 11. Tree Protection Inspection.The project arborist shall inspect and verify the location of protection measures prior to construction, monitor tree protection measures regularly, and provide biweekly written reports to the City during periods of active construction. 12. Final Report.After the project has been completed,the project arborist shall provide a final report that describes the measures needed to maintain and protect the remaining trees. B. Soil Characteristics and Specifications for Improvement Native soils at the project site are-48%deep and moderately well drained Quatama loam, ^'40%deep and somewhat poorly drained Aloha silt loam, and—12% relatively shallow and poorly drained Huberly silt loam. Prior to the installation of new trees,the landscape contractor should excavate to a depth of 36-inches and backfill with amended topsoil.Topsoil amendments should be determined by the landscape contractor. If soil compaction occurs during construction,the project arborist should provide additional recommendations as needed. C. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual.They shall be planted in accordance with the American National Standards Institute (ANSI)standards for tree planting(A300, Part 6) and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock(ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability. Root barriers shall be installed according to manufacturer's specifications when a street tree is planted within 5-feet of any hard surface paving or utility box. Irrigation to be design/build by the landscape contractor.
