The final Construction Permit(s) is attached. This Construction Permit includes the
Construction Drawing(s) and all necessary terms and conditions.
You have until the date specified, October 16, 2003, on the Construction Permit(s)
to complete installation of the approach(es).
As set forth in OAR 734-051-0250, your contractor must advise ODOT (please contact
the District 02A Office at (503) 229-5002) at least 48 hours in advance of
commencing construction. Construction of the approach must conform to the terms
of the Construction Permit and exhibits attached to the Construction Permit. I have
attached a copy of OAR 734-051-0280, which addresses applicant liability and control
during construction of approaches.
You must notify the District 02A Office when construction of the approach is
completed. ODOT will inspect the completed approach and advise you in writing
whether or not the approach has been constructed in a satisfactory manner. If the
approach was constructed in a satisfactory manner, a Permit to Operate, Maintain and
Use an Approach can be issued.
If the approach was not constructed in a satisfactory manner, ODOT will provide in a
written notice a list of all specific deficiencies that must be satisfactorily corrected before
a Permit to Operate, Maintain and Use an Approach can be issued.

140.301 Construction Plans are approved in general only. The District Manager or representative may require field changes. When revisions are made in the
field, as-constructed drawings must be submitted to the District.
150.101 The permit and all specifications, details,typical drawings and standard drawings attached to the permit shall take precedence over all plans,
drawings and specifications produced by the Architect or Engineer representing the Applicant or Contractor.
150.102 The following ODOT documents or subsequent revisions there to,where applicable and not otherwise superseded by the permit language herein,
shall be incorporated for use in this permit: Standard Specifications For Highway Constructions (1996), Supplemental Standard Specifications for
Highway Construction (1998), Highway Design Manual (1993), and relevant Metric Standard Drawings. ODOT shall have authority over the
acceptance of all materials and workmanship performed under this permit as stated in section 00150.00 of the Standard Specifications For Highway
Constructions (1996).
150.151 "Applicant shall be responsible for locating and preserving all existing survey monumentation within the work area in accordance with ORS 209.150
and/or 209.155. If a monument or its accessories are inadvertently or otherwise disturbed or destroyed, applicant shall be responsible for all costs
and coordination associated with its reestablishment by a professional licensed surveyor."
150.201 Within 48 hours before beginning permit work and again after completing permit work, the Applicant (or agent) shall notify the District permitting
respresentative.
150.401 Applicant(or agent) shall furnish "as constructed" drawings, to this office, within 45 calendar days of the completion of the permitted activity. The
drawing media shall be 11"X 17" and reproducible or Microstation®compatible.
150.402 Applicant shall hire a certified testing inspector to monitor construction and assure compliance with the specifications and provisions contained in this
permit
150.411 Applicant (or agent) shall have on the job site, at all times, a copy of the permit and all attachments. The permit shall be readily available for
inspection.
150.501 The permitted work is located within the Oregon Utility Notification Center(OUNC) area. The OUNC is a utilities notification system to notify owners
of utilities about excavation work performed in the vicinity of their facilities. The utilities notification system telephone number is 1-800-332-2344.
150.701 Maintain all existing highway signs. If any signs are damaged due to Contractor's operations, replace those signs before the end of that work shift-
Avoid operations whose methods, conditions, or timing may injure people or damage properties. Damage includes staining surfaces with such things
as mud and asphalt. When damage occurs, the District Manager will determine if it is to be corrected by repair, replacement, or compensatory
payment. If compensatory payment is required, the District Manager will determine the amount.
150.702 Do not park on state right-of-way unless permitted by the District Manager. Comply with ORS 810.230, 810.160.
150.703 Remove all dirt and debris from the highway at the end of each work shift or more frequently if a hazard to the traveling public exists or as directed by
the District Manager.

170.303 Applicant shall be responsible and liable for(1) investigating presence/absence of any legally protected or regulated environmental resource(s) in the
action area; (2) determining any and all restrictions or requirements that relate to the proposed actions,and complying with such, including bur not
limited to those relating to hazardous material(s),water quality constraints,wetlands, archeological or historic resources(s) state and federal
threatened or endangered species,etc; (3)complying with all federal, state,and local laws, and obtaining all required and necessary permits and
approvals.
If the applicant impacts a legally protected/regulated resource, applicant/permittee shall be responsible for all costs associated with such impact,
including, but not limited to all costs of mitigation and rehabilitation, and shall indemnify, and hold harmless ODOT for such impacts and be
responsible and liable to ODOT for any costs or claims that ODOT may have.
200.021 The work area during construction or maintenance performed under the permit provisions shall be protected in accordance with the current Manual
on Uniform Traffic Control Devices for Streets and Highways, US Department of Transportation, and the Oregon Department of Transportation
supplements thereto. Flaggers must have certification and must carry proof indicating their completion of an approved workzone traffic control
course. All traffic control devices shall be maintained according to the ATTSSA Quality Standards for Work Zone Traffic Control Devices handbook.
220.021 When an abrupt edge is created by paving or excavation,the Applicant (agent) shall protect the traffic using the signing"ABRUPT EDGE DETAIL"
and the"TYPICAL ABRUPT EDGE SIGNING DETAIL"configurations detailed on Standard Drawing RD900. Modify Standard Drawing RD900 as
described in§00220.40(d) of the Oregon Standard Specifications for Highway Construction.
- In areas of cold-plane pavement removal,grind around all existing utilities (valves and manholes). If the pavement is not replaced in the same
work shift, place a temporary taper of pavement on all sides of each utility to provide an even surface across the entire paved width.
- For approach construction operations, backfill the excavation at the end of each shift, or use other methods as approved by the Engineer to
provide a traversable surface across the entire pavement width during non-work hours.
225.051 Submit the following in writing five days before the permitted activity.
- Proposed Traffic Control Plan (TCP) showing all Traffic Control Measures(TCM). Include the proposed order and duration of all TCM. Do not
start work on any stage of construction until all TCM are in place and the TCP is operating satisfactorily.
320.401 During construction, any ground that is disturbed shall have any plants designated as noxious weeds removed or sprayed using the"best practices"
as set out by the Oregon Department of Agriculture.
330.001 All rock shall be produced from an ODOT Certified material source.
330.411 Native material found to be unsatisfactory for compaction shall be disposed off of the project and Department controlled property. The site shall be
shaped to drain, contoured, trimmed and seeded with native grasses in a manner satisfactory to the District Manager.
330.421 Only earth or rock shall be used as fill material. The site shall be shaped to maintain existing drainage, contoured, trimmed and seeded with native
grasses in a manner satisfactory to the District Manager. r.
330.701 Areas of disturbed cut and fill slopes shall be restored to a condition suitable to the District Manager or representative.
- Trim and finish all roadbeds, ditches, and other excavations and embankments to the lines, grades and cross sections established.
- Clean up any debris and foreign matter of all kinds on the entire right-of-way area.
- Finish the subgrade to within+/-0.02m and free of ruts, depressions and irregularities.
- Remove all litter,debris and obstructions.

445.002 Culvert pipe shall be reinforced concrete. Culvert must be installed according to ODOT§ 002410.000.
445.411 Replacement Paving- Comply with the provisions of§00445.41(a-2) of the Standard Specifications for Highway Construction 1996.
(2) Replacement Surfacing:
a.Aggregate Base-After pipe has been installed and the trench backfilled to proper elevation according to Section 00405, for pipes 1800 mm and
less in diameter and Section 00510 for pipes over 1800 mm in diameter, place and compact aggregate base or foundation material to a thickness of
450 mm or the thickness of the removed aggregate base,whichever is greater.
759.001 This work consists of furnishing, placing, and finishing portland cement concrete(concrete) curbs, islands, traffic separators, driveways, walks,
monolithic curb and sidewalks, miscellaneous surfaces, and stairs with metal handrail according to these specifications and in close conformity to the
lines, grades, and dimensions shown or established. These items in this section will be collectively referred to as"structures". Refer to
Miscellaneous Portland Cement Concrete Structures§00759.00.
861.400 Apply striping to the lines and locations shown in the ODOT Traffic Line Manual or as directed. Propose variations in standard layouts to handle
unusual conditions, subject to approval.
Place permanent striping prior to traffic being allowed on the pavement.
Immediately clean up paint dribbled beyond the cutoff. Avoid tracking of new paint.All areas where striping has been tracked through will be
reviewed by the District Manager for cleaning up and retracing at the Contractor's expense.
940.001 Install signs in conformance to Standard Drawing TM100.
1040.001 Before any planting, submit for the District Manager's approval a landscaping plan. All plantings shall be no more than 3 feet in height. Plantings
that are not maintained or encroach upon the public right-of-way shall be removed by ODOT at the permitee's expense. If the permittee desires to
landscape the public right-of-way(from back of sidewalk to property line), obtain a permit from this office.
1040.002 Areas from the back of sidewalk to the property line may be used for landscaping by obtaining a separate ODOT Miscellaneous permits from this
office. Any other uses such as parking or storage requires a land rental or lease agreement by the department. No curbs, signs, posts or other
structures shall be placed on the right of way without written authorization from the District Manager or representative.
1120.601 All irrigation systems installed on the right-of-way are to be maintained by the applicant/property owner. All such irrigation systems shall have a main
shut-off valve accessible to ODOT crews. Submit"as-constructed" plans to the District Engineer showing the main shut-off valve.
1.000 This permit is for the future Wall Street. Current environmental circumstances have delayed actual public street improvement. Public street
improvement will be addressed in future when environmental concerns are met. This access will serve as the main and only access to the Library
upon construction.Access format will be changed per OD9T approved plans. Wall Street improvements when applicable will be approved by ODOT
as project moves forward.

We have reviewed the applicant's proposal to relocate the existing City library to a new location on
Hall Blvd- ODOT has permitting authority for this facility' and an interest in ensuring that the proposed
land use is compatible with its safe and efficient operation. To ensure compatibility with state
standards and requirements, we request the City of Tigard require the mitigation measures outlined
below through conditions of approval_
ODOT Standards
According to the Oregon Highway Plan (1999), Hall Blvd is classified a District Urban highway_ The
posted speed in this section is 40 miles per hour. Based on speed and classification, the access
spacing standard is 500 ft The mobility standard is 0.99 volume to capacity (v/c) ratio.
Local Approval Criteria

18.330.030 Approval Standards and Conditions of Approval
A. Approval standards- The Hearings Officer shall approve, approve with conditions, or deny an
application for a conditional use or to enlarge or alter a conditional use based on findings of fact
with respect to each of the following criteria:

ODOT Issues and Requirements
At this time, the applicant proposes to construct a private approach road to the highway to serve the
proposed library use. ODOT is in agreement with City staff that the main driveway for the library can
eventually function as a joint access between the library and the Fanno Pointe development
immediately to the south. The Fanno Pointe development currently is approved with a separate
driveway onto Hall Blvd., but is required to be converted to an emergency vehicle access only when
either Wall Street is constructed or when a joint driveway can be constructed_ There is a drainage
resource that crosses the path of the driveway needed to provide joint access (or future Wall St.
alignment)that requires approval from various resource agencies before a crossing can be
constructed. The resource is not in the way of providing access into the library, but precludes a joint
access with the Fanno Pointe access at this time. If the Wall St. construction were to move forward
within the same construction window as the library project, ODOT will expect that access to both
properties will come entirely from Wall St.
The Fanno Pointe development was conditioned to cover the costs of half street improvements for a
three lane section along their property's highway frontage. It is our understanding that the city-Mil be
constructing these improvements in conjunction with Hall Blvd improvements required of the library
project. ODOT typically requests the City require frontage improvements along the entire length of a
site's highway frontage. The library site's frontage is approximately 1300 SF, the applicant has
proposed only to construct improvements from the bridge to Wall St which is approximately half the
site's actual highway frontage.
The applicant has submitted an ODOT approach road permit application for the proposed library
highway access. According to OAR 734 Division 51, the change of use of the property requires that all
access to the property be reviewed. The applicant proposes to close the two existing accesses and
leave in place the access to an old house just north of the library which is planned to be.converted to
an office use. The applicant will need to obtain permits from ODOT for both the library and the existing
house.
Based on our review of the Traffic Impact Study prepared by DKS Associates, Sep 2002, we have
identified capacity deficiencies on Hall Blvd at the main library access and the McDonald St
intersection that are triggered by the traffic generated from the library project.The Hall Blvd/library
access will operate above the mobility standard .99 v/c ratio with the library traffic. The applicant
proposes a signal to mitigate the capacity problem. While a signal adequately addresses the capacity
problem,the proposed curvature in the driveway design and the lack of a joint access may make it
difficult to obtain approval froth the State Traffic Engineer.The City's best chances for obtaining signal
approval would be to straighten the alignment of the driveway and provide access to the Fanno Pointe
development
The McDonald St intersection is currently operating above the standard at a v/c ratio of 1.0. With the
library traffic, the intersection will operate at a v/c ratio of 1.1. In conditional use cases where a facility
is already operating beyond the mobility standard, ODOT's practice has been to require mitigation to
maintain the intersections current operations in order to avoid further degradation. According to the
traffic study, a southbound right turn lane would adequately mitigate for the degradation in operation
caused by the addition of site traffic at this intersection. Due to right of way constraints construction of
a southbound right turn lane at the McDonald St. intersection may involve the relocation of signal
poles and the realignment of the Hall Blvd mainline to fit into the existing right of way. There are no
programmed projects to make this improvement-
in sum, the applicant proposes to do frontage improvements along the property's highway frontage
from the bridge to the library access and install a traffic signal. Based on conversations with Brian

Rager, City Development Review Engineer, the cost of these improvements is extremely close to the
total amount the City can require for transportation improvements. To meet the standards of the
Tigard Development Code, frontage improvements are needed north of the bridge to the property line
and a southbound right turn lane is needed at the McDonald St intersection.
To meet the intent of the City and State requirements, the City has committed to putting the remaining
improvements into the next City of Tigard Capital Improvement Plan (2004-2009). In order for ODOT
to be satisfied that funding will be identified and the improvements will be done in a timely manner, we
request that the City require this commitment as a condition of approval that must be met prior to
occupancy.
Recommended Conditions of Approval
ODOT recommends the land use decision include the following Conditions of Approval to address
applicable state and local approval criteria and ODOT permit requirements:
1. An ODOT approach permit is required for the library access and the existing house access to the
state highway'_ The applicant shall obtain a temporary ODOT approach permit for construction as
shown on the plans_
2. The applicant shall obtain approval from the State Traffic Engineer and install the library access
signal prior to occupancy.
3. Frontage improvements for a three lane section shall be constructed along the property's highway
frontage from library access to the bridge and along the Fanno Point property frontage to current
ODOT/ADA standards_
4_ Prior to occupancy, the City shall include in the CIP (2004-2009) update a project to construct a
southbound right turn lane at the, McDonald St/Hall Blvd intersection and a project to construct
frontage improvements for a three lane section on Hall Blvd from the north end of the bridge to the
north property line.
5. An ODOT permit is required to perform all work in the highway right of way
6. An ODOT drainage permit is required for connection to state highway drainage facilities4.
Connection will only be considered if the site's drainage naturally enters ODOT right of way. The
applicant should provide ODOT District 2A with a preliminary drainage plan. The plan should show
any drainage impacts to the highway right of way.
A drainage study prepared by an Oregon Registered Professional Engineer is usually required if:
A. Total peak runoff entering the highway right of way is greater than .05 cubic meters per
second; or
B. The improvements create an increase of the impervious surface area greater than 1,000
square meters.

other libraries. This provided enough documentation for ODOT to accept the trip generation-
methodology that was used in the original TIS.
Total Conditions (2005}
With the addition of library traffic, the intersection of Hall Boulevard/McDonald Street is expected to
degrade to a v/c of 1.10 in the PM peak hour_ The addition of the traffic generated by the library is
expected to also degrade the operations at the library approach on Hall Boulevard to a v/c that
exceeds ODOT's mobility standard.
The TIS.proposed two mitigation measures that would improve the intersections that will fail under
total traffic conditions. Those measures were the installation of a southbound right-turn lane on Hall
Boulevard at McDonald Street and installation of a traffic signal at the proposed library approach to
Hall Boulevard.
Installation of a southbound right-turn lane on Hall Boulevard at the McDonald Street intersection
would improve operations of that intersection as well as greatly reduce queuing of the right-turning
vehicles southbound on Hall Boulevard. It appears that the southbound right-turn lane would reduce
the v/c ratio for total traffic conditions to below ODOT's mobility standard. Therefore, a southbound
right-turn lane would adequately mitigate for the library's traffic impacts. Conceptually, this mitigation
seems acceptable; however, this mitigation would need to meet ODOT design standards and final
approval_ Construction of a southbound right-turn lane may involve relocation of signal poles and
even realignment of the Hall Boulevard mainline to fit the additional lane into the existing right-of-way.
The City has proposed that a signal be installed at the library approach to Hall Boulevard (future Wall
Street intersection). A signal would adequately mitigate for the operational problems anticipated at
this intersection in 2005 with the addition of the library traffic. Progression analysis, provided by DKS
Associates, indicates that the addition of a signal at the joint access to the library and Fanno Pointe
(and, in the future, to Wall Street)would be acceptable from a signal system operations standpoint.
The intersection only marginally meets signal warrants for 100%warrants_ It was determined that the
100%warrants are applicable, not the 70% warrants, due to the fact that the posted speed on Hall
Boulevard is 40 mph. ODOT Region 1 Staff could support the signal application if the approach to the
library were shared with the Fanno Pointe development to the south. The proposed signal must meet
the ODOT State Traffic Engineer's approval in order to be installed.

150.701 Maintain all existing highway signs. If any signs are damaged due to Contractor's operations, replace those signs before the end of that work shift-
Avoid operations whose methods, conditions, or timing may injure people or damage properties. Damage includes staining surfaces with such things
as mud and asphalt. When damage occurs, the District Manager will determine if it is to be corrected by repair, replacement, or compensatory
payment. If compensatory payment is required,the District Manager will determine the amount.
150.702 Do not park on state right-of-way unless permitted by the District Manager. Comply with ORS 810.230, 810.160.
150.703 Remove all dirt and debris from the highway at the end of each work shift or more frequently if a hazard to the traveling public exists or as directed by

170.303 Applicant shall be responsible and liable for(1) investigating presence/absence of any legally protected or regulated environmental resource(s) in the
action area; (2)determining any and all restrictions or requirements that relate to the proposed actions, and complying with such, including bur not
limited to those relating to hazardous material(s),water quality constraints, wetlands, archeological or historic resources(s) state and federal
threatened or endangered species, etc; (3) complying with all federal, state, and local laws, and obtaining all required and necessary permits and
approvals.
If the applicant impacts a legally protected/regulated resource, applicant/permittee shall be responsible for all costs associated with such impact,
including, but not limited to all costs of mitigation and rehabilitation, and shall indemnify, and hold harmless ODOT for such impacts and be
responsible and liable to ODOT for any costs or claims that ODOT may have.
200.021 The work area during construction or maintenance performed under the permit provisions shall be protected in accordance with the current Manual
on Uniform Traffic Control Devices for Streets and Highways, US Department of Transportation, and the Oregon Department of Transportation
supplements thereto. Flaggers must have certification and must carry proof indicating their completion of an approved workzone traffic control
course. All traffic control devices shall be maintained according to the ATTSSA Quality Standards for Work Zone Traffic Control Devices handbook.
220.021 When an abrupt edge is created by paving or excavation, the Applicant (agent) shall protect the traffic using the signing "ABRUPT EDGE DETAIL"
and the"TYPICAL ABRUPT EDGE SIGNING DETAIL"configurations detailed on Standard Drawing RD900. Modify Standard Drawing RD900 as
described in §00220.40(d) of the Oregon Standard Specifications for Highway Construction.
- In areas of cold-plane pavement removal, grind around all existing utilities (valves and manholes). If the pavement is not replaced in the same
work shift, place a temporary taper of pavement on all sides of each utility to provide an even surface across the entire paved width.
- For approach construction operations, backfill the excavation at the end of each shift, or use other methods as approved by the Engineer to
provide a traversable surface across the entire pavement width during non-work hours.
225.051 Submit the following in writing five days before the permitted activity.
- Proposed Traffic Control Plan (TCP) showing all Traffic Control Measures (TCM). Include the proposed order and duration of all TCM. Do not
start work on any stage of construction until all TCM are in place and the TCP is operating satisfactorily.
330.001 All rock shall be produced from an ODOT Certified material source.
330.411 Native material found to be unsatisfactory for compaction shall be disposed off of the project and Department controlled property. The site shall be
shaped to drain,contoured,trimmed and seeded with native grasses in a manner satisfactory to the District Manager.
330.421 Only earth or rock shall be used as fill material. The site shall be shaped to maintain existing drainage, contoured, trimmed and seeded with native
grasses in a manner satisfactory to the District Manager.
330.701 Areas of disturbed cut and fill slopes shall be restored to a condition suitable to the District Manager or representative.
- Trim and finish all roadbeds, ditches, and other excavations and embankments to the lines, grades and cross sections established.
- Clean up any debris and foreign matter of all kinds on the entire right-of-way area.
- Finish the subgrade to within +/-0.02m and free of ruts, depressions and irregularities.
- Remove all litter, debris and obstructions.
390.001 Slope stabilization in areas of erosion shall be inlaid with an approved rip rap material.

400.001 Permission is required for any person(s) seeking to change drainage patterns which increase peak flow rates or pollutant loads to ODOT RAN. The
impacts created by the development must be mitigated to maintain the water quality and peak surface runoff at the existing level. All of the proposed
improvements shall comply with the Clean Water Act, Oregon Drainage Law, NPDES regulations,Total Maximum Daily Load (TMDL) limitation
guidelines, and the Endangered Species Act. Erosion control measures shall be taken to prevent impacts to highway right-of-way, during and after
construction.
400.002 Applicant shall submit a Drainage Study of the site whenever the total peak runoff entering ODOT RAN is greater than 0.05 m3/s or the improvements
create an increase of impervious surface area by greater than 1,000 m2. The drainage study, prepared by a licensed professional engineer, shall
show impacts to ODOT right-of-way before and after construction, and shall demonstrate that all practicable steps will be taken to minimize the
impact of storm water volume,flow rate and water quality to the highway right-of-way.
The drainage study shall include:
(a) Site Plan
(i) Buildings, landscape areas, and impervious areas such as parking lots and sidewalks.
(ii) Contours of site before development.
(iii) Contours of site after development.
(iv) Flow paths for before and after development.
(v) Details of proposed and existing drainage systems.
(vi) Details of the proposed detention and/or water quality system(s).
(b) Calculations
(i) Time of concentration.
(ii) Include description and reference for all coefficients.
(iii) Include rainfall distribution information used (IDF curve, isopluvials, etc).
(iv) Peak runoff from the undeveloped site during the design storm.
(v) Storage and volume calculations for detention system.
(vi) Storage, volume, and retention time calculations for water quality facilities.
(vii) Calculations that show outlet structures will limit the peak outflow to the allowable outflow.
Also include the following Miscellanous Reports:
(1) Maps detailing utility locations before and after development in and along the highway;
(2) Hazardous Material collection and/or treatment system report.
(3)Temporary Erosion Control Plan
(4) Temporary Pollution Control Plan
400.003 An advance deposit of$ (Order to Render Service) is required for ODOT Hydraulics Engineer(Geo-Hydro Section)to review the
Drainage Study calculations. The amount listed is the estimated cost for the review. The Applicant is responsible for the entire costs of review.
405.001 Control Density Fill (CDF) shall be used as surface back fill material in place of crushed rock in open trenches that affect the travel portions of the
highway. A 3/4"-0 rock will be used for the aggregate. The amount of concrete used shall not exceed 3% of the total mixture's weight. Maximum
compressed strengths must not exceed 100-150 psi.

405.102 Trench backfill shall be according to Standard Drawing RD300.
405.131 Comply with the provisions of§00405.13 and §00405.41 of the Standard Specifications for Highway Construction 1996.

- Drainage facilities and fittings are installed.
-Class A or B bedding, if required, has reached initial set.
-The installation has been inspected and approved by the Engineer.
Then backfill with material conforming to§00405.13 and the details shown or as directed.
Place the materials in layers no greater than 150 mm thick and in a manner that equalizes pressures on the structure and minimizes stresses.
Before placing backfill material, condition, aerate, or wet the material so that the moisture content of each layer is within-4%to +2% of optimum
moisture content.
Thoroughly tamp and compact all trench backfill with machine or pneumatic operated tampers of a size and type that will obtain the required density.
Compact the top 1-m of trench backfill material within the roadway and shoulders, and a 2:1 slope line projected from each subgrade shoulder, to not
less than 95% of maximum density. Compact all other trench backfill material to not less than 90% of maximum density. If the material is not density
testable, each layer will be observed for deflection or reaction under the compaction equipment to verify that no soft or pumping areas remain.
Compact until there is no perceptible deflection under the compaction equipment.
Density tests will be made according to§00330.43.
Under the haunches of pipe and in areas not accessible to the mechanical tampers, or to testing, compact with hand method as required to ensure
intimate contact between the backfill material and the pipe or structure and to provide thorough compaction.
Backfill either to the top of trench, surrounding ground level or upper limit of excavation as directed. Dispose of excess excavated material not used
in backfill work according to §00330.
445.002 Culvert pipe shall be reinforced concrete. Culvert must be installed according to ODOT§ 002410.000.
759.001 This work consists of furnishing, placing, and finishing portland cement concrete (concrete) curbs, islands, traffic separators, driveways, walks,
monolithic curb and sidewalks, miscellaneous surfaces, and stairs with metal handrail according to these specifications and in close conformity to the
lines,grades, and dimensions shown or established. These items in this section will be collectively referred to as "structures". Refer to
Miscellaneous Portland Cement Concrete Structures§00759.00.

WORKSITE

®7. The stopping and parking of vehicles upon State Highway right of way for the maintenance of adjoining property or in
furtherance of any business transaction or commercial establishment is strictly prohibited.
08. All grass and small brush within the work area shall be rotary or flail mowed to ground level prior to the beginning of work
to facilitate clean up. Disturbed areas shall be reseeded with grass native to the area in an appropriate seeding time.
®9. The spreading of mud or debris upon any State Highway is strictly prohibited and violation shall be cause for immediate
cancellation of the permit. Clean up shall be at the applicant's expense.The highway shall be cleaned of all dirt and debris at the
end of each work day,or more frequently if so determined by the District Manager or representative.
®10. Permittee shall replace any landscape vegetation or fences that are destroyed. Any damage that is not fully recovered
within 30 days (weather permitting)shall be replaced by ODOT at the expense of the permittee.A"plant establishment"shall be
understood to be part of the planting work to assure satisfactory growth of planted materials. The plant establishment period will
begin when the original planting and all landscape construction has been completed and approved. The length of the
establishment period will be one calendar year or as defined in the Special Provisions.
011. Applicant will install and maintain landscaped area as shown on the attached drawings. Planting shall be limited to low
growing shrubs, grass or flowers that do not attain sufficient height to obstruct clear vision in any direction.The Commission or
Engineer shall have the right to remove said landscaping at any time such removal may appear to the Commission to be in the
public interest,without liability or loss, injury,or damage or any nature whatsoever.

and 9:00 AM,or 3:00 PM and 6`00 PM(Monday thru Friday)without prior authorization of the District Manager or representative.

DRAINAGE
017. On site storm drainage shall be controlled within the applicant's property.No blind connections to existing state facilities.
018. Excavation shall not be done on the ditch slopes. Trench excavation shall either be at ditch bottom or outside the ditch
area. (Minimum depth at bottom of ditch-36", minimum depth at the outside of ditch-42".)
®19. Only earth or rock shall be used as fill material and shall slope so as no to change or adversely affect existing drainage.
Fine grade and seed the finished fill with native grasses to prevent erosion.
020. A storm drainage study will be required by a registered engineer meeting the standards of the National Pollution
Discharge Elimination Systems (NPDES)when any of the following conditions apply:

development site is 1 acre or larger in size and directly or indirectly affects state facilities,
or as directed by the District Manager or representative.

®24. All water discharged to an ODOT drainage system will be treated prior to discharge.All requests for connection to an
ODOT storm sewer will meet any requirements of the National Pollutant Discharge Elimination System that could include: local
jurisdiction approval of on site water quality treatment facilities,development of an operation and maintenance plan for any on site
water quality treatment facility as determined by local jurisdiction.
EXCAVATION/CONSTRUCTION
025. Open cutting of pavement shall only be allowed in areas specifically approved by District Manager or representative.
026. Trench backfill shall be according to the attached typical drawing, marked as Exhibit B
027. Open cutting of the highway will be allowed with construction in accordance with OAR 734-55-100.All excavation in paved
areas shall be backfilled and the roadway surface patched before the end of each shift. In special cases where steel plates are
allowed, said plates shall be pinned and a temporary cold patch applied to the edges.The permittee shall be fully responsible for
monitoring and maintenance of temporary patching and steel plating.
028. Compaction test will be required for each open cut per ODOT Standard specification for Highway Construction.Tests
shall be conducted every 50' LF per_2' Lift of a continuous trench by standard AASHTO T99 method.At the discretion of the
District Manager or representative, results of such test shall be provided to District Manager or representative at applicants'
expense.

1E130. Surface restoration shall be a minimum of 8"of hot AC,or match existing AC depth, compacted in 2"lifts,whichever is
greater.
®31. All rock shall be from an ODOT Certified material source.
®32. Any area of cut or damaged asphalt shall be restored in accordance with the attached "T"type drawing. For a period of 2
years following the patched paved surface,the applicant shall be responsible for the condition of said pavement patches, and
during that time shall repair to the District Manager or representative satisfaction any of the patches which become settled,
cracked, broken,or otherwise faulty.
033. An overlay to seal open cut area shall be completed prior to the end of the construction season,or when minimum
temperature allows per ODOT Standard specification for Highway Construction. Typical overlay shall be 1 '/2"deep and cover the
affected area from edge of pavement to edge of pavement,and taper longitudinally 50' : 1".Taper may be adjusted by the District
Manager as required. For a period of two years following this patching of the surface,the applicant shall be responsible for the
condition of said pavement patches,and during that time shall repair to the District Manager or representative's satisfaction any of
the patches which become settled,cracked, broken or otherwise faulty.
034. Highway crossing shall be bored or jacked. Bore pits shall be located behind ditch line or in areas satisfactory to the
District Office. Unattended pits shall be protected by a 6-foot fence or shall be backfilled or steel plated and pinned.

035. Applicant shall install a"tracer wire"or other similar conductive marking tape or device, if installing any non-conductive,
unlocatable underground facility, to comply with the Oregon Utility Notification Center, One Call System (per OAR 952-01-0070
(6).
036. Trench backfill outside of ditch line or in approved areas can be native soil compacted at optimum moisture in 12" layers to
90%or greater of the maximum density.
®37. Native material found to be unsatisfactory for compaction shall be disposed of off the project, and granular backfill used.
038. Trench backfill in rock slope or shoulder shall be crushed 1"-0 or%4'-0 size rock compacted at optimum moisture in 12"
layers to 95%of maximum density by standard AASHTO T99 method.
039. Where excavation is on fill slope steeper than 2:1 slope protection shall be used with 4"size rock laid evenly to a minimum
depth of 12"
1140. No more than 300'of trench longitudinally along the highway shall be LEFT open at any one time and no trench shall be
left in an open condition overnight.
041. Areas of disturbed cut and fill slopes shall be restored to a condition suitable to the District Manager or representative.
Areas of erosion to be inlaid with an acceptable rip rap material.
042. All underground utilities shall be installed with a 3'or more clearance from existing or contract plans guardrail post and
attachments.All non-metallic water,sanitary and storm sewer pipe shall have an electrically conductive insulated 12-guage copper
tracer wire the full length of the installed pipe using blue wire for water and green for storm and sanitary sewer piping.
®43. Any area of cut or damaged concrete shall be restored in accordance with the attached Typical Section-Pipe Section
under sidewalk.
044. Signs and pedestals shall be placed as near the highway right-of-way line as practical. In no case shall pedestals and line
markers be located within the highway maintenance area.
045. No cable plowing is allowed within the lateral support of the highway asphalt(i.e. at 6'lower than the edge of the asphalt,
no plowing with 9'of the edge of the asphalt).
046. All pipe and bridge attachment hardware shall be submitted to the ODOT Operations Structural Coatings Coordinator for
approval.
047. Expansion joints of an ODOT approved type to be located in the closed proximity with the expansion joints of the
structure. ODOT Bridge Office Practice Manual attached.
048. Adhesive anchors only are acceptable for support brackets. For a list of acceptable adhesive anchors or more information,
see the ODOT Bridge Office Practice Manual.

1151. Applicant shall be responsible and liable for(1)investigating presence/absence of any legally protected or regulated
environmental resource(s)in the action area; (2)determining any and all restrictions or requirements that relate to the proposed
actions, and complying with such, including bur not limited to those relating to hazardous material(s),water quality constraints,
wetlands, archeological or historic resources(s)state and federal threatened or endangered species,etc; (3)complying with all
federal, state, and local laws, and obtaining all required and necessary permits and approvals.
®52. If the applicant impacts a legally protected/regulated resource, applicant/permittee shall be responsible for all costs
associated with such impact, including, but not limited to all costs of mitigation and rehabilitation, and shall indemnify, and hold
harmless ODOT for such impacts and be responsible and liable to ODOT for any costs or claims that ODOT may have.
®53. Plans are approved in general only and do not relieve the applicant from completing the construction improvements
satisfactory to ODOT. Field changes may be required by the District Manager or representative.When revisions are made in the
field, as built drawings will be submitted to the District Office.
