The MU-CBD zone is designed to provide a pedestrian-friendly urban village in downtown Tigard. A wide variety of commercial, civic, employment, mixed-use, apartments, and rowhouses are allowed. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.440 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request for a Temporary Use Permit. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FROM APRIL 26,2019 TO APRIL 26,2020. BACKGROUND INFORMATION Site Information: The subject property(12555 SW Hall Boulevard;WCTM 2S102AD,Tax Lot 300)is located on the northwest side of SW Hall Boulevard, northeast of SW Commercial Street, and south of SW Scoffins Street. The property contains a two-story office building that was damaged by fire on April 2, 2019. The property is located in the Mixed-Use Central Business District Zone (MU-CBD), and the Tigard Downtown Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.440 Temporary Uses: 18.440.030 Types of Temporary Uses B. Unforeseen or emergency situations.This type of temporary use is a use that is needed because of an unforeseen event such as fire,windstorm,flood,unexpected health or economic hardship, or due to an eviction resulting from condemnation or other proceedings. Examples of this type of temporary use include: 1. A mobile home or other temporary structure for a residential purpose in a residential zone; 2. A mobile home or other temporary structure for a business purpose in a commercial or industrial zone; and 3. Use of an existing dwelling or mobile or manufactured home during the construction period of a new residence on the same lot. On April 2, 2019, a fire occurred at 12555 SW Hall Boulevard, and damaged the office building located on site. The applicant proposes to utilize a temporary structure as an office during reconstruction of the pre- existing office building. This proposal meets the description of a temporary use due to an unforeseen or emergency situation,as outlined above.Accordingly,this Temporary Use Permit is being processed through a Type I procedure. 18.440.050 Approval Criteria B. Unforeseen or emergency situations. The approval authority will approve or approve with conditions unforeseen or emergency situations when all of the following are met: 1. The need for the use is the direct result of a casualty loss such as fire,wind storm, flood, or other severe damage by the elements to a pre-existing structure or facility previously occupied by the applicant on the premises for which the permit is sought; or 2. The use of a mobile or manufactured home on a lot with an existing dwelling unit is necessary to provide adequate and immediate health care for a relative who needs close attention who would otherwise be required to receive needed attention from a hospital or care facility;or 3. The applicant has been evicted within 60 days of the date of the application from a pre- existing occupancy of the premises for which the permit is sought as a result of condemnation proceedings by a public authority, or eviction by abatement of nuisance proceedings, or by determination of a public body or court having jurisdiction that the continued occupancy of the facilities previously occupied constitutes a nuisance or is unsafe for continued use;or 4. There has been a loss of leasehold occupancy rights by the applicant due to unforeseeable circumstances or other hardship beyond the foresight and control of the applicant; and The applicant proposes to utilize a temporary structure as an office at 12555 SW Hall Boulevard. The need for this use is a direct result of a fire that occurred at the subject site on April 2,2019,and damaged the pre- existing office building. This proposal meets the description of a temporary use due to an unforeseen or TUP2019-00007 Harris-McMonagle Associates,Inc. 2 emergency situation.This criterion is met. 5. There exists adequate and safe ingress and egress when combined with the other uses of the property, as required by Chapter 18.920, Access, Egress and Circulation, and Chapter 18.930,Vision Clearance Areas; and The site contains a pre-existing office building that was damaged by fire on April 2,2019.There are no other uses on the subject site. Staff reviewed the applicant's site plan to confirm that the location of the proposed temporary structure will not impact the existing points of ingress and egress to the site. Additionally,vision clearance requirements do not apply to the site because it is located in the MU-CBD Zone (CDC 18.930.030.A).This criterion is met. 6. There exists adequate parking for the customers of the temporary use as required by Chapter 18.410, Off-Street Parking and Loading; and The proposed temporary structure will be approximately 360 square feet in size.Based on the minimum off- street parking requirements in CDC Table 18.410.3 and for the Tigard Downtown Plan District (CDC 18.650.130.B), the temporary use is required to have a minimum of one (1) parking space. There will be adequate parking at the subject site because the applicant's narrative states that seven (7) parking spaces will be provided. This criterion is met. 7. The use will not result in congestion on adjacent streets; and The proposed temporary structure will be fully contained on the subject site. Additionally, the property contains adequate on-site parking, and existing points of ingress and egress for vehicles. Therefore, the proposed temporary use will not result in congestion on adjacent streets.This criterion is met. 8. The use will pose no hazard to pedestrians in the area of the use; and Staff reviewed the applicant's site plan to confirm the proposed location of the temporary structure will not impact the public sidewalk or any on-site pedestrian access points.This criterion is met. 9. The use will not create adverse off-site impacts including noise, odors,vibrations,glare, or lights that will affect adjoining uses in a manner that other uses allowed in the base zone would not affect adjoining uses; and The applicant proposes to utilize the temporary structure for an office use,which is allowed outright in the MU-CBD Zone.Accordingly,the proposed temporary use will not create adverse off-site impacts including noise,odors,vibrations,glare, or lights that will affect adjoining uses. This criterion is met 10. The use can be adequately served by sewer or septic system and water,if applicable. The applicant's narrative states that the proposed temporary structure can be adequately served by sewer and water.Additionally, sewer and water connections to the temporary structure will be reviewed by the City of Tigard Building Division at the time of building permit submittal.This criterion is met. The reason for this TUP is because the building was broken into, burglarized and set fire to, there by rendering the building un-useable at this time. All equipment was either stolen, consumed by fire or compromised by indirect fire and water damage. The temporary office trailer is 10' x 36' and will be located adjacent to and at least 6.00 feet from the northeasterly property line, as shown on the attached sketch in Red. The trailer will occupy 3 parking spaces leaving 7 spaces available. The office trailer may be on the site 6 to 9 months depending on the final outcome of the building condition and whether it is to be rebuilt or removed and a new building constructed. Code Section CD 18.440.050.B, response: 1. The reason for the TUP is the result of a Burglary and fire in the building that has rendered the structure unusable. 5. The access to the site will remain in its present condition and locations. The siting of the office trailer will not impede the sight lines from the driveway accesses and onsite vehicle circulation will not be affected. 6. The trailer will occupy 3 parking spaces leaving 7 spaces available. 7. All use of the office trailer will be upon the subject property, no offsite parking has ever been used or needed as this is not a drive up commercial use, it is an engineering office. 8. The office trailer will not impede any general public pedestrian use of any public facilities and will not pose a hazard to any pedestrian use upon the property. 9. The use of the office trailer will not affect the use of the adjacent property in any way shape or form. The trailer will be adjacent to the existing parking area of the adjacent business to the north of the subject site. There will not be any outdoor uses that are inconsistent with the prior use of the existing building on a day to day basis as allowed by the base zoning of MUCBD. 10. The dry utilities are available adjacent to the location of the office trailer. The water can be served via a hose connection and the sewer discharge will be tapped into the building sewer outlet.
