If you could, please send photos of the top of the tree so that the windstorm knocked the tree over and

Dear Sam,
As I mentioned, the tree is at a 45 degree angle and is being held upright due to the fact it is leaning into
another tree. If the other tree was not there, it would likely have completely fallen on its own. I am not
sure this tree is a candidate for rehabilitation.
We could cover the roots, but the long term viability of tree versus the inherent danger of it coming
down at anytime except being held up by another tree make me skeptical of any situation where the
tree is left on its own.
We will be happy to replace the tree with the same or similar species.

Dear Sam,
Beacon Homes is no longer in existence,they folded shortly after the sub division was
completed.
We (the HOA) held a transition meeting in 2010 with Beacon Homes as mandated by the
Bylaws&CCRs of the Lady Apple Owners Assoc. We registered our HOA as a non-profit

entity and assumed our duties as HOA including required maintenance of Tracts A, C
and D for the last 9 years.As a Board Member and elected President, I signed for the
Lady Apple Owners Assoc as the managing entity.
I attached additional photos of the tree. Perspective is difficult in the pictures, but the
tree is leaning at a 45 degree angle with the root mass exposed and erupting from the
ground. We have not had an arborist inspection of the tree as it does not seem likely the
tree will survive. Our intent is to contract a vendor to drop the tree before it becomes a
greater hazard.
