The Good Samaritan Medical Office Buil4'ng is located to the oast of the sit.. A convenience store, insurance and real estate office., and an auto repair center are to the south across SW Shady Lane. 4. We information .and pfovoeal DellsalrILQr1 The subject site is developed with a former service station that has been converted to automonile rental use. Ostby Motor Company operates two businesses, Rent A Wreck and Corporate Auto Rental Service, from the site. A 35 foot tall, 70 square foot per taco freestanding sig:, advertising the Rent A Wreck business is located in the nort hwestnr ri corner of the site (SP 89-122) . In addition, • small freestandlnd rntgn is located near the site's SW Shady Lane F-ontage and another small sign is located on the wall of the former cashier's but under that service canopy. Sign permits have not been obtained for either of these signs. The building on the alto was formerly a Shell Oil service station. The building follows a standard Shell Oil design scheme including a brick chimney -like feature extending ten feet above the roof. The chimney-like feature contains empty sign cabinets on its east and west sides. The sign cabinets formerly housed signs containing the Shell Oil logo. The Sign Code limits wall signs in the C-0 zone to 15 percent coverage of a wall . The walls of the chimney-like featur.r are considered by the Planning Division to be separate from Otho, parallel building walls below the roof which are in different planes than the chimney walls. The applicant requests a Variance to the C-C tone wall area limit to allow a 25 square foct sign on the 70 square foot western facing wall of the chimney like feature. The sign would occupy 36 percent of this wall 's area. The sign would be located in the existing sign cabinet. No signage has been proposed for the existing sign cabinet on the eastern side of the chimney like feature. S- /RIMY a r1d. .NPP_c9n!Re rll! NPO 12, the Oregon State Highway Division, and the City of Tigard Building and ISngineering Divisions have reviewed the proposal and have offered no comments or objections. FINDINGS ANJ CONCLUSIONS The proposed sign would be located in an existing sign cabinet on a chimney-like projection above the roofline of the building. Sign Code Section 18.114.070(H) prohibits the erection of • sign above the roof line of a building. The Sign Code's definition of roof signs (Code Section 18. 114.015(0) (44) ) , however, excepts signs mounted on exiscing architectural features from classification as roof signs. Because the chimney-like feature is an existing integral portion of the building, the proposed sign is to be treated as • wall sign rather than • roof sign (see December 21, 1990 letter to Harold Ostby from Jerry Offer) . The Sign Code allows wall signs in the C-O zoning district to occupy up to 15 percent of a wall's face (Code Section 18. 114.1301C) (1)(b) (i) (1)) . The existing sign cabinet provides area for • 25 square foot sign on the 70 square toot west wall of the chimney-like structure. The sign cabinet takes up 36 percent of the wall 's face. In order to fully utilise the area of the existing sign cabinet, the applicant requests a variance from the 15 percent of wall area site limit for wall signs in the C-0 sone. The applicant asserts that the additional area is necessary to enhance visibility of the sign due to the property's situation at • lower elevation than the SW Oreenburg Road/Highway 217 overpass. In addition, the applicant states that the sign is necessary to adequately identity the second business operating on the property. The following criteria in Section 18.134.050 apply to the request for • variance to the wall sign area limit applicable to the western wall of the applicant's building: (1) The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity. (2) There are special circumstances that exist which are peculiar to the lot else or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same Boning district; (3) The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; (4) Sainting physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parka will not be adversely affected any more than would occur if the developmert were located as specified in the Code; and YINA1. ORDER NO. 90-02 PC - SCE 89-16/V 89-35 OSTRY NTH. CO. - PROS 3 • • (",) The hardship is not self--imposed and the variance requested is the minimum variance which would alleviate the hardship. The goners/ purpose of the 15 percent of wall area limit for wall signs in the (' G tone is to reduce the potential of visual sign clutter along roadways so as to minimise distractions for vehicle drive. Tho proposed variance would not conflict with this purpose eb S. of the relatively small size of the proposed signs, the relatively small number of signs on the site and adjacent properties, and the limited opportunity for additional wall signage on the other west facing wait of the subject building duo to the windows and doors on the other wall an well as its poor visibility from adjacent roadways. The property's low elervation relative to Ureenburq Road limits opportunities for effective signage on other portions of the property thereby presenting a need for use of the chimney- liMe structure for signage. The proposed variance would not affect the •isas permitted on the site or provide an opportunity for installing a sign ifl n location that would not otherwise be permitted. The variance request would only affect the size of signage permitted. No adverse effects upon physical or natural systems are anticipated if the variance is granted. In fact, allowance of the requested variance would be expected to positively affect traffic safety as opposed to a situation whereby the applicant would attempt to communicate the same message on a sign no larger than is permitted without • variance. The proposed larger sign would be much more visible to a motorist trying to locate the business. Lastly, the hardship created by the combination of the Code's limits on wall •ignaqe area as well as the poor visibility of the site is not self- imposed but instead the hardsh_p has been inherited with the applicant's acquisition of the property. Because of the prior existence of the Shell Oil Company logo in the sign cabinet, it would be reasonable for the applicant to have assumed prior to acquiring the site that a similarly eizea sign could be placed in the cabinet without • variance. The Commission therefore finds that Ostby Motor Company's request to allow a 25 square foot sign on a 70 square foot wall (36 percent of wall area as opposed to the 15 percent of wall area normally alowed) satisfies the standards for approval of a variance to a Community Development Code standard. Background Information The subject property was annexed into the City of Tigard in 1969. The property was developed with a service station in 1'►71 . No land use or development applications regarding this property have been reviewed by the Planning Division. In 1984, the property was converted from service station use to an auto rental use. The property is approximately 20 to 25 feat lower than the intersection of Greenberg Road and the on-ramp. Properties surrounding the site are all developed and are also zoned C-O. The Good Samaritan Medical Office Building is located to the east of the site. A convenience store, insurance and real estate offices, and an auto repair center are to the south across SN Shady Lane. 4. Site Information and Proposal Description The subject mite is developed with a former service station that has been converted to automobile rental use. Ostby Motor Company operates two businesses, Rent A Wreck and Corporate Auto Rental Service, from the site. A 35 foot tall, 70 square foot per face freestanding sign advertising the Rent A Wreck business is located in the northwestern corner of t.;e site (SP 89-122) . In addition, a small freestanding rlc;.c is located near the site's SW Shady Lane Frontage and another small sign is located on the wall of the former cashier's hut under the service canopy. Sign permits have not been obtained for either of these signs. The building on the site was formerly a Shell Oil service station. The building follows a standard Shell Oil design scheme including a brick chimney-like feature extending ten feet above the roof. The chimney-like feature contains empty sign cabinets on its east and west sides. The sign cabinets formerly housed signs containing the Shell 011 logo. The Sign Code limits wall signs in the C-O sone to 15 percent coverage of • wall. The walls of the chimney-like feature are considered by the Planning Division to be separate from other parallel building walls below the roof which are in different planes than the chimney walls. The applicant requests a Variance to the C-O sone wall area limit to allow a 25 square foot sign on the 70 square foot western facing wall of the chimney like feature. The sign would occupy 36 percent of this wall 's area. The sign would be located in the existing sign cabinet. No signage hag been proposed for the existing sign cabinet on the eastern side of the chimney like feature. 5. Arra and NPO Comments NP0 02, the Oregon State Highway Division, and the City of Tigard Building and Engineering Division• have reviewed the proposal and have offered no comments or objections. Ho other comments have been received. H. FINDINGS AND CONCLUSIONS The proposed sign would he located in an existing sign cabinet on • chimney- like pro)ection •hove the roofline of the building. Sign Code Section 18. 114.070(H) prohibits the erection of a sign above the roofline of a building. The Sign Code's definition of roof signs (Code Section 18. 114.0I5(C) (44) ) , however, excepts signs mounted on existing architectural STAFF REPORT SCR 99- 16/V 89 15 OSTBY MOTOR COMPANY Page 2 • • features from classification as roof signs. Because the chimney-like feature is an existing integral portion of the building, the proposed sign is to be treated as a wall sign rather than a roof sign (see December 21, 1b90 letter to Harold Ostby treat Jerry Offer) . The sign Code allows wall signs it. the C-O zoning district to occupy up to 15 percent of a wall's face (Coo,. Section 1n.114.130(C) (1) (b) (i) (1)) . The existing sign cabinet provides area for a 25 square foot sign on the 70 square foot west wall of the chimney-like structure. The sign cabinet takes up 36 percent of the wall's face. In order to fully utilize the area of the existing sign cabinet, the applicant requests a variance from the 15 percent of wall area size limit for wall signs in the C-O zone. The applicant asserts that the additional area is necessary to enhance visibility of the sign due to the property's situation at a lower elevation than the SW Oreenburg Road/Highway 217 overpass. In addition, the applicant states that the sign is necessary to adequately identify the second business operating on the property. Th. following criteria in Section 18. 134.050 apply o the request for a variance to the wall sign area limit applicable to the western well of the applicant 's building: (1) The proposed vsriance will not be materially detrimental to the purposes of this Code, b.: in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards) and to other properties in the same zoning district or vicinity. (2) There are special circumstances that. exist which are peculiar to the lot size or shape, topography or other circumstance• over which the applicant has no control, and which are not applicable to other properties in the same zoning district ( 1) The u•o proposed will be the same as permitted tinder this code and City standards will be maintained to the greatest extent thati• reasonably possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not. limited to traffic, drainage, dramatic land forms or park• will not be adversely affected any more than would occur if the development wore located as specified in the Code; and • (5) The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The property's low elevation relative to Oreenburg Road limits opportunities for effective signage on other portions of the property thereby presenting • need for use of the chimney-like structure for signage. The proposed variance would not affect the uses permitted on the site or provide an opportunity for installing a sign in a location that would not otherwise be permitted. The variance request would only affect the size of signage permitted. No adverse effects upon physical or natural systems are anticipated if the variance is granted. In fact, allowance of the requested variance would be expecte] to positively affect traffic safety as opposed to a situation whereby the applicant would attempt to communicate the as message on a sign no larger than is permitted without a variance. The proposed larger sign would be much more visible to a motorist trying to locate the business. Lastly, the hardship created by the combination of the Code's limits on wall signage area as well as the poor visibility of the site is not self-imposed but instead the hardship has been inherited with the applicant's acquisition of the property. Because of the prior existence of the Shell Oil Company logo in the sign cabinet, it would be reasonable for the applicant to have assumed prior to acquiring the site that • similarly sized sign could be placed in the cabinet without a variance. Staff therefore finds that Ostby Motor Company's request to allow a 23 square foot sign on a 70 square foot wall (36 percent of wall area as opposed to the 1S percent of wall area normally allowed) satisfies the standards for approval of a variance to a Community Development Code standard.. The applicant will need to obtain sign permits for all existing signs on the site prior to obtaining • sign permit for the proposed sign on the chimney-like structure. C. Code section 18.114.070 (H) prohibits the erection of a sign above the roof line of a building. The Sign Code's definition of roof signs (code 18.114.015 (C) (44) ) , however excepts signs mounted to existing architectural features from the definition of roof signs. Because the chimney-like feature in an integral portion of the building in existence much in advance of your request to locate the sign upon it, we find that this situation is excepted from the prohibition on roof signs. The City of Tigard allows wall signs in the C-O zone to occupy up to 15 percent. of the wall 's face.
