THT ZOi was made on behalf of the owner, Dennis O'Neel, by Eugene Harfet, 18740 Wood Duck Circle, Lake Oswego, who had nothing to add to tho staff presentation. PUBLIC TE5TIMOi1Y was confined to a ques,.ion by a neighboring resident, who questioned what was meant by a variance. Howard responded by outlining the ordinance requirements for the granting of a variance, and how this particular request meets those requirements. COMMISSION DISCU3SIO7; AND ACTION: Speaker asked the reason for the 5 foot strip of land attached to the most southern of the four lots involved, separ.atin' Lot 701 from the dedicated half street. Thin was what was left over from previous flag lot accesses to these four lots before it was decided to make a city street which would serve undeveloped property to the north. Bonn t:OVi'') approval of Variance V 6-80, based on staff findings and recornendation. Helmer seconded the motion. Smith raised the question of what would become of the five—foot strip east of Lot 701, expressing concern that it would become a no—man's—land. Mr. Harf,t stated they would be glad to give the land to the owner of Lot 701 In discussion the comnisciion, while it did not fool it proper to mandate the deeding of the 5 foot strip to the adjoining lot, did (.. feel the problem should be resolved among the parties. The motion for approv%l thereupon passed unanimously. 11 STAFF REPORT AGENDA 5. 3 TIGARD PLANNING COMMISSION July 8, 1980 TIGARD SCHOOL DISTRICT ADMINISTRATION OFFICES - BOARD ROOM 13137 SW Pacific Highway, Tigard DOCKET: VARIANCE, V 6-80 (Dennis R. O'NE ' 10175 S. W. Bt.our Blvd. . Suite 211-B Portland, Oregon 97219 May 20, 1980 Tigard Planning Commission 12420 3. W. Main Tigard, Oregon 97223 Gentlemen: I am requesting a variance for lot area on the property legally described on the attachment "A" and as shown on the enclosed drawings. The total area of the property is 36,076 square feet which would be satisfactory for 4 single family lots in this zone of R-7. However, due to the requirements of the Planning Commission (Ref. ZC-5-80) in the letter dated April 22, 1980, half street improvements have to be made which reduce the square footage to 27, 299 square feet. Therefore, in accordance with chapter 18. 76 Variances of the Tigard Zoning Code, this request for a variance is made in that: 1. ) The reduction in square footage is as a result of the Planning Commission action over which applicant has no control. 2. ) Applicants right to full economic benefits of this property will be denied if this variance is refused. . 3. ) This variance will not be injurious to any adjacent property or detrimental to the objectives of any City development plan or policy. 4. ) This is the minimum variance from the provisions and standards of the zoning code which will alleviate the economic hardship. Thank you for your consideration. Yours truly, Dennis R. O'Neel DRO:kms I Attachment "A" Description of a portion of Lot 23, "Ashbrook Farm" , a duly recorded plat in the Northeast k of Section 35, Twp. 1S. , Rng. 1W. , W.M. , Washington County, Oregon, being more partic- ularly described as follows: Commencing at the Southwest Corner of said lot 23, said point being on the centerline of S.
