APPLICATION SUMMARY FILE NAME: Kemp RV Trailer CASE NO.: Temporary Use Permit(TUP) TUP2019-00001 PROPOSAL: The applicant is proposing to have an elderly relative sleep in a Recreational Vehicle (RV) trailer for a period of 12 months at 9430 SW Center Street. The applicant is requesting a temporary use permit because the applicant's relative was recently tested for memory problems and can no longer live alone.The applicant will care for their relative until the relative is moved into a memory care facility. The R-4.5 zone is designed to accommodate detached single-family homes with or without accessory dwelling units at a minimum lot size of 7,500 square feet. Duplexes are permitted conditionally. Some civic and institutional uses are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.440. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. This Temporary Use Permit is valid from February 6, 2019 to February 6,2020.The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 12 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. TUP2019-00001 Kemp RV Trailer PAGE 1 OF 3 SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 9430 SW Center Street; north of SW Commercial Street, south of SW Tangela Court, west of SW Lincoln Avenue, and east of SW 95th Avenue. The approximately .26 acre property has one single-detached house, one detached garage, and one accessory structure. The site contains one driveway located west of the single-detached house that is approximately 15 feet wide by 85 feet long,and a concrete pad to the east of the single-detached house that is approximately nine feet wide by 20 feet long. The proposed RV trailer will be located on this concrete slab that is east of the existing single detached house. Staff conducted a search of city records and found that no previous land use approvals have been issued for this site. The subject property and all adjacent properties are in the Low- Density Residential (R-4.5) Zone. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS CHAPTER 18.440 TEMPORARY USES: B. Unforeseen/emergency situations. The approval authority shall approve or approve with conditions unforeseen/emergency situations when all of the following are met: 1. The need for the use is the direct result of a casualty loss such as fire,wind storm, flood or other severe damage by the elements to a pre-existing structure or facility previously occupied by the applicant on the premises for which the permit is sought;or 2. The use of a mobile or manufactured home on a lot with an existing dwelling unit is necessary to provide adequate and immediate health care for a relative who needs close attention who would otherwise be required to receive needed attention from a hospital or care facility; or 3. The applicant has been evicted within 60 days of the date of the application from a pre- Existing occupancy of the premises for which the permit is sought as a result of condemnation proceedings by a public authority, or eviction by abatement of nuisance proceedings, or by determination of a public body or court having jurisdiction that the continued occupancy of the facilities previously occupied constitutes a nuisance or is unsafe for continued use;or 4. There has been a loss of leasehold occupancy rights by the applicant due to unforeseeable circumstances or other hardship beyond the foresight and control of the applicant; and 5. There exists adequate and safe ingress and egress when combined with the other uses of the property, as required by Chapter 18.920,Access, Egress and Circulation, and Chapter 18.930,Vision Clearance Areas; and 6. There exists adequate parking for the customers of the temporary use as required by Chapter 18.310, Off-Street Parking and Loading; and 7. The use will not result in congestion on adequate streets; and 8. The use will pose no hazard to pedestrians in the area of the use; and 9. The use will not create adverse off-site impacts including noise, odors,vibrations,glare or lights that will affect adjoining use, in a manner that other use allowed outright in the base zone,would not affect adjoining use; and 10. The use can be adequately served by sewer or septic system and water, if applicable. TUP2019-00001 Kemp RV Trailer PAGE 2 OF 3 The approval criteria relevant to this request are B.2 and B.5 through .10. The RV trailer will be located at 9430 SW Center Street, which contains one existing single detached house. The applicant's narrative states that the RV trailer is necessary to provide adequate and immediate health care for a relative who would otherwise need to be placed in a care facility, which meets criterion B.2. The applicant has requested that their relative live in the RV trailer at 9430 SW Center Street for a period of twelve months. The approximately 12 feet wide by 27 feet long RV trailer will be placed on an approximately nine feet wide by 20 feet long concrete pad located on site. In addition to the concrete pad,the lot also contains a 15 feet wide by 85 feet long driveway, which will provide safe egress and ingress to 9430 SW Center Street. The applicant has shown on a site plan that the RV trailer will not be located within the front setback. In addition, staff consulted with city maps to confirm that the RV trailer's location will meet visual clearance requirements for non-arterial streets that are 24 feet or more in width (CDC 18.930.040.B.1). The applicant's site plan shows that there are approximately seven off-street parking spaces available to accommodate both the existing single detached house and the RV trailer(one parking space per dwelling,per CDC Table 18.310.2).As the RV trailer will be located greater than 20 feet behind the site's property line,it will not result in congestion on streets,nor will it pose a hazard to pedestrians in the area. The applicant proposes to utilize the RV trailer for residential use in a designated residential zone(R-4.5); therefore, it is not anticipated that this use will create adverse off-site impacts including noise, odors, vibrations,glare,or lights that would affect neighboring residential properties.Additionally,the RV trailer is equipped with its own septic tank system and water.The applicant's narrative states that the waste will be removed once a month,and that water from an outside hose will attach to the outside faucet. Upon review of the applicant's narrative, site plan, and other materials, staff finds this proposal meets the temporary use approval criteria for an unforeseen/ emergency situation. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A Temporary Use Permit is a Type I procedure. As such,the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first.
