Consensus of Council was to approve the publishing of phone numbers on both sides of an issue. City Administrator requested Council decide whose phone number should be listed for the city. *. MINUTE - A11(;U:,i .'.', 141H i CITY OF TIGARD ORDINANCE NO. 83-,3 AN ORDINANCE ADOPTING FINDINGS, AMENDING 1HE COMPREHENSIVE PLAN MAP (CPA 5-83 Scheckla/Breed/Bissett) AND DECLARING AND EMERGENCY WHEREAS, during; the review and adoption of the City of Tigard Comprehensive Plan Map which was adopted by Ordinance 83-24 on May 9, 1983, the City Council found some conflicts between the Comprehensive Plan Map and existing plan policies ; and WHEREAS, the Tigard City Council on May 9, 1983, (greeted the planning staff to initiate the public hearing process to resolve those conflicts ; and WHEREAS, The proposed Comprehensive Plan Amendment involves property identified by the City Coun..il as being in conflict with the Comprehensive Plan policies ; and WHEREAS, a public haring was held before the Planning Commission on June 21 , 1983; and WHEREAS, the Planning Commission has made certain recommendations to the City Council ; and WHEREAS, the proposed Comprehensive Plan Amendment was reviewed by Neighborhood Planning Organization six (NPO # 6) ; and WHEREAS, after considering the comments of the Planning Commission, the NPO, and individual citizens, the Council believes that the Comprehensive Plan Map should be amended in the form set forth in Exhibit "A" attached hereto and, by this reference, made a part hereof : NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The City Council adopts findings in this case as follows : 1. Ashe Avenue Tigard, Oregon 97223 Re: File No. CPA5-83 Scheckla Zoning Change Dear Tigard City Council : This letter is in response to the Scheckla request and the Tigard Planning Commission's recommendation to designate the Scheckla property located between Durhan Road and the Tualatin River as medium density property. My husband and I reside at 10155 S.W. Jurgens Lane, Sherwood, Oregon. This is on the Tualatin River and is directly across from the property in question. This letter represents not only my husband's and my feelings, but the feelings of ou- neighbors: Mr. R Mrs. Rich Frost, Catherine Rife, and Mr. b Mrs. John Bohlen. We are the only residents located on Jurgens Lane. We oppose the Planning Commission's recommendation to change the comprehensive plan designation from low to medium density. The record of the June 21 , 1983, Tigard Planning Commission meeting will reflect that the recommendation to change the comprehensive plan designation on said prop- ' erty from low to medium density is only a compromise recommendation and is not appropriate to the character of the property. The Scheckla property is geographically located in a bowl upon the Tualatin River. It relates most appropriately and naturally to the land surrounding it on the east, Pick's Landing, and on the south (which is our property across thr Tualatin River) . The properti is rural in nature and is bordered by low density housing. The TigaiJ Planning Commission may easily designate such property on a map as medium density by relating i' to the property located to the north, Summerfield, and to the wet, Highway 99. When physically examining the property, one immediately realizes that such an association is inappropriate. The pastoral and rural character of the property more naturGlly relates to the southern and eastern properties. Medium density designation of the Scheckla property violates the comprehensive land use plan since the following factors are not satisfied. 1 . The Scheckla property is subject to development limitations such as flooding. Tigard City Council -2- July 7, 1983 2. The Scheckla property car. iot be buffered from low density residential area to the east, Pick's Landing. 3. The Scheckla property has been committed to low density development. Lastly, the medium density designation of the Scheckla property is vigorously opposed by all intere ted parties. The only proponants for the medium density desig- nation were the appliLdnts. All surrounding neighbors and interested parties were publicly opposed. Sylvan Ct . ) . I am pleased to see that a common accord appears to have been struck between Pick ' s Landing Homeowners and the Property Owners of the contested property . That is , that it will be zoned Medium Density ( PUD ) with allowance for a ' buffer zone ' between Pick ' s Landing boundary line and any future property development . As you may already realize , many hours of debate have been spent by both sides to arrive at this consensus . What is most important now is that we mend our differences and live as good neighbors . While I ' d be the first one vote that we put this case to rest , there is one more uncertainty I wish to express to the City Council . As I understand it , legal counsel has advised that no formal wording be put on record as to what ' buffer zone ' next to Pick ' s Landing specifically means . The potential problem I see is that by the time the land is actually developed , few will re- member the verbal interpretation of this zone- - as it has been described to me and my neighbors in previous meetings . Even with Medium Density zoning , there is still a possibility that a duplex or common wall dwelling will he erected next to the Pick ' s Landing property line . I wish to briefly state why a duplex or common wall struc- ture is of concern . The reasons are purely economic . While I hope to reside in my present home for many years to come , I may at some time be forced to sell . Since my backyard has no natur- al barrier , a duplex would stand out like a sore thumb and nega- tively impact the value of my home . Therefore , I request that the City Council state that a 100 foot buffer zone next to Pick ' s Landing be single unit , detached family dwellings . This would be sincerely appreciated by those of us who have invested our savings in city property that we trust will be fairly zoned and buffered by the City Council . The property to the west is developed as single family and is designated medium-high adjacent to Durham Road and low adjacent to the Tualatin River (see attached map). The Tualatin River borders the property on the south. The property to the east is developed as single family residential and is designated low density on the Comprehensive Plan. 4. SITE INFORMATION There are existing single family homes and some out buildings on three of the 5 lots. Tax lot 800 is vacant and wooled with approximately 102 of the property in the 100-year floodplain of the Tualatin River. Portions of Tax lots 500 & 700 are also in the floodplain. The land slopes to the Tualatin River. The portion lear the river is heavily wooded. The nor'hern portion of the land is pasture land. B. APPLICABLE PLANNING POLICIES 1 . TIGARD MUNICIPAL CODE Comprehensive Plan Amendment - All of the requirements of the Tigard Municipal Code will be applied to the development of the site during Site Design Review. Included in the Design Review are parking, landscape, access and street improvements. C. CONCLUSIONS The proposed Comprehensive Plan Amendment meets applicable planning policies. The development of the site will be reviewed and approved through Site Design Review. D. RECOMMENDATION Staft recommends approval of the applicants ' request for a comprehensive Plan Amendment based on the following: 1 . We desired a place where our four children could experience a semi—rural existence, free of heavy traffic and general congestion. Had we known there was any possibility of the land bordering our property (16355 SW Sylvan Ct. ) being zoned medium 10 high density, we would have located elsewhere. we recognize the validity of economic concerns as expressed by those with a stake in the property to the west of us. Rut we also feel there are other considerations besides economic gain. A great many families stand to be adversely affected by a change in the zoning pattern. We would hope that the pastoral nature of our neighborhood could be maintained by maintaining the zoning as low lemmoddift density. In addition, we hope that the Tigard Planning Commission represents the interests of families and owners of single—unit dwellings as well as the interests of large landowners and developers. We were transferred to Tigard by my employer. This was my final move since I will shortly be retiring. It was with much excitement and due consideration we had when Sam Gotter Realtors helped us in selecting the just perfect location among those available in the area. The highest consideration for our property selection was never again to be confined to the "shoulder to shoulder" living of Southern California; with the shouting, arguing, loud radios, loud cars, all night parties. We bought in Pick' s Landing, adjacent to the Scheckla property, being assured that it was to be developed in the same manner and density as Pick' s. I have a State Vet loan - the only wad' I could afford the property - and have no further access to another loan, having been m'ved twice before by my employer. Pick' s Landing is a lovely, spacious, quiet neighborhood with natural trees, birds, etc. , ideal for raising a family, relaxing after a stressful day at the office. The Schecklas now want to destroy this serenity by requesting a density from low to medium high. This is the third or fourth time we of Pick' s Landing have had to defend the original zoning of the property. The NPO at the previous hearing has provided sufficient evidence of oi.ner properties more acceptable to the higher density. Schecklas had the opportunity to request a change long before Pick' s was developed, which would have given us homeowners a choice, i.e. of not putting our life savings into a house next to property that would be developed into non-owner occuppied dwellings. As it is, we have no choice, we bought and invested in good faita tEat the Panning Commission was honest and sincere in permanently establisiing the zoning as it was when we bought our house. It is granted that every issue has two sides. The Schecklas concern is over money, which soon will be dissipated. Our concern is of liveability, one of perpetual duration. It contains over 40 acres and is bounded on the north by Durham Road; on the west by the west line of Section 14, on the south by the Tualatin River , and on the east by the Housing Development known as "Pick ' s Landing" . This area is served by sewers which are stubbed off at Pick 's Landing and also by the trunk sewer recently brought north of the Tualatin River just west of 1081.►. (We have access to 108th by way of a 40-foot private road, over which we have an easement for road and utility purposes including sewers. ) The area is also well served by public transportation and main arterial streets. Durham Road intersects Pacific Highway (99W) approximately 1/2 mile from the area, and extends east to connect with I-5. Bus service is availaule at the intersection of Durham Road and Pacific Highway. As Durham the Road corridor develops into one of Tigard 's principal residential areas, public transit will undoubtedly be routed over its entire length. The area is close to both primary and secondary schools. Shoppi,rg is readily available at both the King City and Summerfield commercial districts. These districts include food markets and other retail shops, as well as a full range of financial and professional services including medical and dental care. C�J/ Mr . William A. Monahan June 8, 1983 Page Two The five tax lots, for which reconsideration of development densities is being requested, are almost totally devoid of pre-existing development. These are large tracts which offer the opportunity, especially if developed together, of providing a unique residential environment. A planned unit development utilizing direct access to the Tualatin River as a common recreation area could become one of Tigard' s truly outstanding residential areas. For such a prospect to become a reality, thu low density classification which has been given to this area, must be changed to medium high density or at least medium density. The economic realities are t.aat it is no longer possible to provide the amenities which we envision in the context of a large lot development. Large lots are n., longer as desirable as they once were. People are more willing to share the outdoors in common with their neighbors, e.g. King City, Summerfield, Charbonneau to name just a few e/amples. These developments have been responsive to the needs of an increasingly larger segment of the population and they have shown that high density development does not mean low quality. Quite the reverse: as large lot developments, these projects could not have supported the extraordinary common amenities which they now provide. And the same thing is true for the larger community. It has been well documented that the cost per household of urban services rises rapidly as density decreases. These principles are also recognized in the Tigard Development Plan. Among the findings in the Housing Section of the Comprehensive Plan is the statement : "The rapid increase in housing and land cost over the last several years has excluded many house- holds from obtaining suitable housing to meet their needs. " One of the "implementatio.' strategies" designed to reduce housing costs , states: "The City shall seek ways to minimize the cost of housing by encouraging a variety of home ownership alternatives, such as, but not limited to, townhouses and condominiums. Monahan June 8, 1983 Page Three One of the principle policies of the public transportation section of the Comprehensive Plan is that: "That City shall encourage the expansion and use of public transit by locating land intensive uses in close proximity to transitways. " And this is further restated as an implementing strategy: "The City shall propose land use densities, within the Comprehensive Plan, along transit oriented corridors that support public transporta%.'_on service. " A basic policy of the Comprehensive Plan is that the housing densities shall be provided in accordance with applicable Locational Criteria. The residential Locational Criteria enumerated in the Comprehensive Plan specifically provides that low deLisity residential should be restricted to, "Areas which are committed to low density development and not shown on the 'Buildable Land In ,entory ' as vacant land. " The area in question is vacant and listed on the Buildable Land Inventory. According to the Comprehensive Plan Locational Criteria , this area should not be designated for low density development.
