DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section W. UFR2018-00008 Willow Brook Subdivision—Urban Forestry Plan Modification 1 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject site is the Willow Brook Subdivision (Case No. SUB2016-00011), which was approved by the City of Tigard Planning Division in July 2017. This approval was for a 29-lot subdivision, located south of Durham Road on both sides of SW 113th Avenue. The site is zoned R-7 (Medium-Density Residential) and borders Tigard's city limit on the south. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.520.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Application A. Approval process. Except as exempted in Subsection 18.520.070.B, an application for a modification to the urban forestry plan component of an approved land use shall be processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Subsection 18.520.070.C. The applicant proposes to modify the Urban Forestry Plan originally approved under Case No.SUB2016- 00011. Specifically, the applicant proposes to modify the approved plan due to the requirement to alter the western street configuration from a stubbed public street to a cul-de-sac and private street tract. Additional trees were added there and at the bridge crossing. The approval authority shall approve or approve with conditions the modification to the urban forestry plan component of an approved land use application when all of the following are met: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist has provided a revised report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The applicant has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.520.030. (Ord. 17-22 §2) U1a2018-00008 Willow Brook Subdivision—Urban Forestry Plan Modification 2 The applicant submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with TDC 18.520.030, including tree preservation, protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above and the materials submitted for the modification, the proposed modification to the Urban Forestry Plan Component of the approved Willow Brook Subdivision meets all applicable approval criteria. The most notable revision resulted from the request by the City to incorporate a cul-de-sac on the west end rather than a dead-end public street as shown in the original engineering plans.The proposed street trees at the dead-end had to be relocated and they were redistributed about the site. There is no practicable alternative to the ensuing modifications in the previously approved urban forestry plan. During the initial land use process, sixty-four street trees were proposed;the final engineering drawings include nine additional street trees for a total of seventy-three street trees. Additional trees were added near the western cul-de-sac and private street. • Trees were added at the bridge crossing. • On the eastern side of the site trees on the south side of the roadway were eliminated (there are no lots fronting this curb line). • On the western side of the site the side yard facing SW 113th Avenue has fewer trees. Based on my review of the revised street tree plan and discussions with Emerio Design, I approve the new street tree layout. This revision conforms to the intent of the relevant city code sections and the original urban forestry plan (Urban Forestry Report—Supplemental Report, SW 113th Subdivision, Tigard, OR,January 23, 2017). The revised street tree plan has triggered a Type 1 review. I believe that the conditions in Code section 18.520.070.B.2. are satisfied.The Approval Criteria in Code section 18.520.070.C.are also satisfied. The most notable revision resulted from the request by the City to incorporate a cul-de-sac on the west end rather than a dead-end public street as shown in the original engineering plans. The proposed street trees at the dead-end had to be relocated and they were redistributed about the site. There is no practicable alternative to the ensuing modifications in the previously approved urban forestry plan. During the initial land use process, sixty-four street trees were proposed; the final engineering drawings include nine additional street trees for a total of seventy-three street trees. Additional trees were added near the western cul-de-sac and private street. • Trees were added at the bridge crossing. • On the eastern side of the site trees on the south side of the roadway were eliminated (there are no lots fronting this curb line). • On the western side of the site the side yard facing SW 113th Avenue has fewer trees. Based on my review of the revised street tree plan and discussions with Emerio Design, I approve the new street tree layout. This revision conforms to the intent of the relevant city code sections and the original urban forestry plan (Urban Forestry Report—Supplemental Report, SW 113th Subdivision, Tigard, OR,January 23, 2017). The revised street tree plan has triggered a Type 1 review.
