FACTS General Information: Case: Conditional Use (CU 9-82) NPO #2 Request: For a Conditional Use Permit to locate a Beauty School in a C-3 General Commercial Zone. See Attachment A. Recommendation: Based on informatiol% submitted by the applicant, applicable planning policies and staff's site inspection, staff recommends approval of Conditional Use request CU 9-82 with the conditions on, page 3 of this Staff Report. • Applicant: Phagans Beauty School Owner: BXN Corp. 12750 S.W. Pacific Hwy. 10125 S.W. Beav/Hills Hwy. • 4 Tigard, Oregon 97223 Beaverton, Oregon 97005 4 • • Location: 8820 S.W. Center (Washington County Tax Map 1S1 35DD Lot 4900) Lot Area: .27 acres Present Zoning Designation: C-3 (General Commercial) • Public Notices Mailed: Notices were mailed to 12 surrounding property owners. No response has been. received. NPO Comment: NPO #2 is inactive at this time. Vicinity Information: Surrounding land uses are a8 follows North and East - Tigard Plaza Commercial Shopping Center South and West - General Commercial Development Site Information: At present, there is a 5,068 square foot building on the site which will b remodeled to accomodate the proposed Beauty School. There are 17 parking spaces n on the site to accomodate customers. The owner of the school has a lease agreement with Tigard Plaza to lease 35 parking spaces for use by the 35 students attending the school. Public water and sewer are available to the site. There is a problem with uncontrolled access and egress at the site; there are not sidewalks and the existing curbs are not to City standards. Development of curbs and sidewalks to City standards could ireato problems or cars manuevering in the parking lot on the site. Presently, cars backing 6 4 • STAFF REPORT . CU 9-82 L` Page 2 out of spaces on the S.W. Center Street side of the building back into the right-of-way to make turning movements out of the parking space. Further, there is a lack of sidewalks in the area and there is a need to separate pedeotrian travelways from vehicle traffic. B. APPLICABLE PLANNING POLICIES 1. LCDC Statewide Planning Goals: a. Citizen involvement - The intent of this goal is to insure the opportunity for citizens to be involved in all phases of the Planning Process. On May 17, 1982, notices were mailed to T,ropert,y owners within 250 feet of the subject property giving the time and date of the public hearing on this issue• On Times. May 13, 1982 a public notice was published in the Tigard Tim b. Land Use Planning - All applicable LCDC goals and policies, NPO #2 policies and Tgard Municipal Code Sections were considered in reviewing this proposal. c. Public Facilities - Pub.. ^ Facilities including water, sewer and storm drainage are available to the site. � .• d. Transportation - Neither S.W. 87th nor S.W. Center Street are improved to City standards in front of the property. On site circulation could be improved. The City's Engineering Division is willing to workwith the to that t improvements willmake both pedestrian and circulation on site, as well l as in the public right-of-way, safe and functional. 2. ' . . • , BEFORE THE HEARINGS OFFICER FOR THE CITY OF TIGARD IN THE MATTER OF THE APPLICATION FOR A ) ) # CONDITIONAL USE PERMIT TO LOCATE A BEAUTY , No. SCHOOL IN A C-3, GENERAL COMMERCIAL ZONE; ) CUP 9-82 ) Phagans Beauty School, Applicant. ) The above-entitled matter came before th , Hearings Officer at the regularly scheduled meeting of May 27 . 1982; and The applicant applied to the City for a conditional use permit to operate a beauty school on property located at 8820 S.W. Center Street, City of Tigard, Oregon, and more spe- cifically described as Tax Lot 4900, 151 35DD, Washington County, Oregon, property zoned C-3 / General Commercial; and The Hearings Officer conducted a public hearing at • which time testimony, evidence and the planning department staff • report were received, and it appearing from the evidence that the request should be allowed; and The applicant requested that the HearingS Officer waive the requirement, as set forth in the staff report, that the appli • cant make improvements to S.W. center and 87th Streets as a condi- tion of approval, citing the hardship associated with the estima- •, ted cost of $6000. 00 for such improvements. The Hearings Officer has reviewed the staff recommendation, Section 18. 72 of the Tigard • Municipal Code relating to Conditional Uses, and Section 15 of the Tigard Municipal Code, and finds that it is the clear intent of the Code to require street improvements at the time of permit .1°4 • , approval, regardless of the nature of the permit. It is apparent • that the City finds that the time the property owner received the benefit of the new use, i.e. lease payments , is an appropriate time for the property to be brought up to Code. Generally, the property owner would absorb the costs of such improvements; if the applicant in this situation neglected to negotiate that term with the Lessor, that is unfortunate, but it is to the entire City's benefit to have the streets brought up to standard; and • The Hearings Officer adopts the Findings and Conclusions contained within the staff report, a copy of which is attached hereto and incorporated by reference hereih, and marked ' Exhibit A" ; therefore IT IS HEREBY ORDERED: Conditional Use Permit 9-82 is approved subject to the following conditions: 1. The applicant shall submit Public Improvement Plans and an agreement for half-street improvement:s to S.W. Center and S.W. 8/th Streets to the City' s engineering department for approval. Standards for street improvements are attached as part of the , 4k, staff report and are incorporated by reference herein. (See Attachment "B") . Should the applicant wish to occupy the premises prior to such improvements, it shall submit a bond, in a form satisfactory to the City, in a sum not less than 150% of the esti- , mated dusts for said improvements, guaranteeing the completion of said improvements. 2.
