' . • • . • MEMORANDUM CITY OF TIGARD TO: Don Bohn, Code Enforcement Officer June 27, 1991 FROM: Greg Berry, Utilities Engineer SUBJECT: 14865 SW 74th In response to your request dated June 24, 1991, I investigated the fill at this address. I understand that there were complaints about filling within the floodplain or wetland in violation of Division of State Land Permits and City Sensitive Lands Permits. The fill was permitted by SL 9-85 that required the construction of an overflow channel for Fanno Creek within the floodplain. This permit also required a hydraulic and soils report as well as dedication of the floodplain. All work required by this permit has • been completed except for the dedication of the floodway. The • owner tells me he plans to dedicate the floodplain once all site improvements have been completed. He expects that this work will be completed within a year. All recent work has been confined to upland areas, consequently there is no violation of the DSL or Sensitive Lands Permit. Moreover, all of this work is exclusively regulated by the fill permit . The Sensitive Lands Permit file did not contain a fill permit, but the owner assures me that he has kept the originally issued fill permit in effect . The Contractor and the owner have stated that the pUrpoSe of the current work is to complete the fill as shown on the Sensitive Land8 Permit and the fill permit. On June 26, 1991, Carl Vieweg and I met with the contractor on the site. He pointed out the one load that had been dump onto the site and said that all other work was limited to grading in preparation for more fill to be placed on the site. He also explained that the purpose of the rocks along the heel of the slope along the creek was to control eroaion. We also noted that brush and similar material appeared to be under the toe of the fill along area designated on the plane as a natural area to be preserved. After reviewing the Sensitive Lands Permit file, viewing the site, and speaking with the owner and the contractor, I recommend that the 1:wilding Division revieW the fill permit to determine if it remains valid, that inspedtion Of the fill i8 being conducted aa required in the soils report, and that erosion controls conforms to • current StandardS. First, condition number one: The Engineering Division has reviewed avid approves the site grading improvement plan and; also, the Corp of Engineers permit plan; said plans being that which is referred to in condition one as a 'public improvement plan.' These cross-sections (see Figures 1 and 2) indi- Icate a main channel which is approximately 8 feet deep and fairly flat in grade. In fact, the survey of elevations of the stream bottom do not provide an accurate sloethe high water did not permit thalweg strThe computed slope from the Tigard I Master Drainage Plan was used. Also, the surface elevation of the 100-year storm was computed for the project site based upon the HCC-2 printout provided by the city of Tigard and the distance downstream from Bonita Road. r,' , Once the cross-sections Were plotted, areas Within each section Were. , identified Which could be related to depth of flow through mathematical I relationships (refer to computer printouts). C. equalled the computed conveyance factor. Since only the existing section geometry was used, this enabled the determination of the floodway width at the 100-year storm elevation by adjusting; the top width until the existing floodway elevation (as calculated) was achieved. Once the "existing" floodway was determined for the section's, it was possible to evaluate the change the proposed overflow channel would have on the floodway. In both sections, the existing floodway boundary was adja cent to the proposed overflow channel . Since the channel is designed to convey high waterflows, the floodway was widened to include the overflow channel . By holding the floodway width to include the overflow channel and varying the flow depth until the conveyance factor was approximated agaih, a new flow depth was determined which would approximate the 100-year storm ,,, elevation if the overflow channel Were constructed. FINDINGS The increased cross-sectional area available to convey storm flows and the reasonable widening of the floodway causes an approximate drop in the gt surface elevation of 1 foot for the 100-year flood floW. { Since the Overflow channel is at an elevation of about 124 and the stream bed is at an elevation of 120, there Will be little effect on low Water conditions which would occur during the summer and much of the winter ILmonths. Water surface elevation in mid-August, 1985, was recorded at 121.1 and on February 17, 1985; the elevation Was 123.4 Which occurred after aIL I. moderately heavy rainfall . E. At survey station 2+38 the existing floodway Was determined to be 169 feet Wide and encompassed the main channel and a portion of the overflow channel . The floodway on section 7+82 Was 148 feet wide and includedthe k only Main stream and the edge ofroposed overflow channel . Fill and excavation work should not occur between October 1st and April 30th because of potential erosion or flooding problems, c. A hydrologic study prepared by a registered engineer including • cross sections and an analysis of the backwater curve at high and ' low flows should be submitted for review before the issuance of permits, d, A geotechnical report prepared by a soils engineer Will be necessary relating to the landfill areas prior to issuing building permits, e, The necessary approvals must be obtained from the Division of State Lands and the U.S. Army Corps of Engineers, The Building Inspection DiVigioh indicates that a civil engineer should • be involved to ensure the suitability of the fill areas for building construction, Tualatin Rural Fire Protection District has no objection to the proposal • but notes that further review will be necessary when specific plans Per the warehouse and office building are formulated. NPO fig has no objection to the application provided that all engineering • requirements related to Sensitive Lands approval are followed and that the developer retain as many houglas fir trees as possible, 8, FINDINOS AND CONCLUSIONS • Section 18,84,040 of the Community DevelopMent Code contains SiK 1 criteria that must be addressed in order to approve a request within the 100—year flood plain, 1, Land 'Porn alterations shall preserve or enhance the flood plain storage function and maintenance of the zero—Foot rise floodway shall net result in any narrowing of the floodway boundary, 1 , 2, The land form alteration or development within the 100—year flood plain shall be allowed only in an area designated as commercial or industrial on the Comprehensive Plan Land Use Map, STAFF ROORT — SL -BL — PAG54 2 C 3, The land form alteration or development is not located within the floodway. 4, The land form alteration or development will not result in any increase in the elevation of the zero—foot rise floodway. 5, The land form alteration or development plan includes a pedestrian/bicycle pathway in accordance with the adopted 3, pedestrian/bicycle pathway plan, 6. The plans for, the pedestrian/bicycle pathway indicate that no pathway will be below the elevation of an average annual flood, Although some additional information will be necessary, the Engineering division is satisfied that no encroachment or development will occur within the zero—foot rise floodway. The property is zoned I—P and this proposed land form alteration is appropriate. The proposed grading plan will allow for the installation of a bicycle/pedestrian path at a later date, The City has not required the installation of the path when it would represent an isolated segment without any legal access, • The City has a policy of requiring the dedication of the Fahho Creek flood plain for open space purposes, 1h commercial and industrial zones, the City requires the dedication of all land which remains within the 100—year flood plain after a plan for modifying the flood plain boundary is approved. Policy 3,2,3 of the Tigard Comprehensive Plan supports this greenway dedication requirements. C. RtCOMMtNDATION Based upon findings and conclusions noted above, the Planning staff recommends approval of SL B-85 subject to the following conditions; 1.
