City- owned parks, open space, and recreational facilities located in a plan district may retain or receive other than a PR zone designation if it better furthers the goals of the plan district. In addition, other public agencies may request a PR zone designation for areas that meet the purpose of the zone. See Chapter 18.795, Map and Text Amendments. (Ord. 17-22 §2) MU-CBD: mixed-use central business zone: The MU-CBD zone is designed to provide a pedestrian-friendly urban village in downtown Tigard. A wide variety of commercial, civic, employment, mixed-use, multifamily, and attached single-family residences are permitted. In addition to the standards of this chapter, development within this zone is subject to the standards of Chapter 18.650, Tigard Downtown Plan District. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request for a Temporary Use Permit, subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL PRIOR TO OCCUPANCY THE FOLLOWING CONDITIONS SHALL BE SATISFIED: 1. Applicant must maintain visual clearance areas,as required by the standards in'I'DC Chapter 18.930. THIS APPROVAL SHALL BE VALID AUGUST 18,2018 SECTION III. BACKGROUND INFORMATION Site and Vicinity Information: The event is located at 13005 SW Hall Boulevard and 8720 SW Burnham Street. These two lots make up 1.55 acres in total,and contain a 15,000 square foot skate park that is owned by the City of Tigard.The skate park is considered a Community Services use, and the nearby Tigard Niche building is considerd an office use,as described in TMC 18.60,Use Categories.The two lots also contain 88 parking spaces and associated landscaping. The applicant proposes to locate the temporary skateboarding event at the Tigard Skate Park, and eight booths will be located throughout both lots.The 13005 SW Hall Boulevard property is split zoned with both the Parks and Recreation (PR) and Mixed-Use Central Business District (MU-CBD) zones. The 8720 SW Burnham Street property is zoned as Mixed-Use Central Business District (MU-CBD). Adjacent properties to the north, south, and west are zoned as Mixed-Use Central Business District (MU-CBD), whereas adjacent properties to the east are zoned as Tight Industrial (I-L). Proposal Description: The applicant is requesting a Temporary Use Permit for a skating event on August 18, 2018. Activities will take place within the Tigard Skate Park, and also in eight booths located at 8720 SW Burnham Street and 13005 SW Hall Boulevard. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS The following section includes only the approval criteria that are applicable to the proposed temporary use. 18.440 Temporary Uses: 18.440.030 Types of Temporary Uses A. Seasonal or special event. This type of temporary use is a use that by its nature will last less than 1 year. Examples of this type of use are those associated with the sale of goods for a specific holiday, activity or celebration, uses associated with construction or seasonal use. This type of use does not apply to businesses seeking a temporary or interim location. These types of temporary uses include: TUP2018-00018 XTREME AMATEUR GAMES PAGE 2 OF 4 3. Use associated with festivals or celebrations or special events; The proposed skateboarding event at the Tigard Skate Park is a special event that will occur only on August 18, 2018. This qualifies as a special event and must be approved through Temporary Use review. 18.440.050 Approval Criteria A. Seasonal and special events. The approval authority shall approve or approve with conditions seasonal and special events when all of the following are met: 1. The use occurs only once in a calendar year and for no longer a period than 30 consecutive days, except as provided in paragraph 6 of this subsection; The proposed skateboarding event at the Tigard Skate Park is a special event that will occur only once in the calendar year, on August 18, 2018.This criterion is met. 2. The use is permitted in the applicable base zone; This proposal is for a community services use, which is permitted by right in the both the PR and the MU-CBD Zones. This criterion is met. 3. The applicant has proof of the property owner's permission to place the use on the property; The application included the property owner's signature and a document signed by Steve Martin,who is the Public Works Division Manager, approving the use of the property for the event. This criterion is met. 4. There will be no parking utilized by the customers and employees of the temporary use that is required to meet the minimum parking requirements for the other use(s) on the property, as required by Chapter 18.310, Off-Street Parking and Loading; There will be no parking utilized by the customers and employees of the skateboarding event that is required to meet the minimum parking requirements for the other use on the property because the other use is the offices of the City of Tigard, which are closed on the day of the event. All of the parking on the site is available for the use of event patrons. .This criterion is met. 5. The use will provide adequate vision clearance, as required by Chapter 18.930, Vision Clearance Areas, and shall not obstruct pedestrian access on public rights-of-way; The applicant's site plan demonstrates that vision clearance would not be adversely impacted by the skating event, which will not be located within any public right-of-way. Accordingly, this temporary use will not obstruct pedestrian access. In order to ensure that objects associated with the event do not violate vison clearance standards, Condition 1 in Section II above requires the applicant to maintain clear vision areas. As conditioned, this criterion is met. SECTION VII. (Ord. 17-22 §2) 18.930.020 Applicability A. Applicability. The provisions of this chapter shall apply to all development including the construction of new structures, the remodeling of existing structures and to a change of use that increases the on- site parking or loading requirements or changes the access requirements. B. When site development review is not required. Where the provisions of Chapter 18.780, Site Development Review, do not apply, the approval authority shall approve, approve with conditions, or deny a plan submitted under the provisions of this chapter through a Type I procedure,as provided in Section 18.710.050,using the standards in this chapter. (Ord. 17-22 §2) 18.930.030 Vision Clearance Requirements A. At corners. Except within the MU-CBD zone, a vision clearance area shall be maintained on the corners of all property adjacent to the intersection of two streets,a street and a railroad,or a driveway providing access to a public or private street. B. Obstructions prohibited. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure or temporary or permanent obstruction (except for an occasional utility pole or tree), exceeding 3 feet in height,measured from the top of the curb,or where no curb exists, from the street center line grade, except that trees exceeding this height may be located in this area, provided all branches below 8 feet are removed. C. Additional topographical constraints. Where the crest of a hill or vertical curve conditions contribute to the obstruction of clear vision areas at a street or driveway intersection, hedges, plantings, fences, walls, wall structures and temporary or permanent obstructions shall be further reduced in height or eliminated to comply with the intent of the required clear vision area. (Ord. 17-22 §2) 18.930.040 Computations A. Arterial streets. On all designated arterial streets the vision clearance area shall not be less than 35 feet on each side of the intersection.
