APPLICATION SUMMARY FILE NAME: Willow Brook Temporary Sales Office CASE NO.: Temporary Use Permit(TUP) TUP2018-00019 PROPOSAL: The applicant is proposing a temporary sales office on Lot 19 of the approved Willow Brook Subdivision. The proposed temporary sales office will be a commercial space located within the garage of a single-family residential unit, and will be converted back into a garage when the space is no longer needed as a temporary sales office. TUP2018-00019 WILLOW BROOK'TEMPORARY SALES OFFICE PAGE 1 OF 3 THIS APPROVAL SHALL BE VALID FOR 24 MONTHS (TWO YEARS) FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is Lot 19 of the Willow Brook Subdivision, which was originally approved as the 113th Avenue Subdivision by the City of Tigard Planning Division on April 13, 2017 (SUB2016-00011 and SLR2016-00008). The granted approval was for a 29 lot subdivision and Sensitive Lands Review. A Public Facilities Improvement Permit (PFI2017-00118) was also submitted with the 113th Avenue Subdivision. On August 17, 2017, the applicant paid to change the subdivision name from the 113th Avenue Subdivision to the Willow Brook Subdivision. The subdivision is located on both the east and west side of SW 113th Avenue, which is located south of SW Durham Road, and east of Pacific Highway. All lots are zoned R-7 (Medium-Density Residential). Lot 19 is also the site of a temporary model home,which was approved on June 12, 2018 (TUP2018-00016). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS CHAPTER 18.440 TEMPORARY USES: 18.440.050 Approval Criteria C. Temporary sales office or model home. The approval authority shall approve or approve with conditions a temporary sales office or model home,when all of the following are met: 1.Temporary sales office. a. The temporary sales office shall be located within the boundaries of the subdivision or property in which the real property is to be sold;and The proposed temporary sales office is to be located within the boundaries of the Willow Brook Subdivision on proposed Lot 19. The real property to be sold includes the subject property. This criterion is met. b. The property to be used for a temporary sales office shall not be permanently improved for that purpose. The applicant proposes to utilize the garage in a single-family residential unit as a temporary sales office. Once the temporary use expires, the commercial space located within the single-family residential unit will be converted back into a garage. The applicant has requested that the approval of the temporary sales office be valid for up to two years. A two-year approval for the temporary sales office is appropriate as it meets the applicant's timeline for sale of the homes. This criterion is met. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City.
