The cover letter shall clearly identify where in the submittal the required information is found: 1. Prior to occupancy, the applicant shall submit documentation of approval from the State of Oregon Recreational Marijuana Program. 2. Prior to occupancy,the applicant shall submit a site plan and a photometric drawing.These plans shall clearly illustrate how proposed security lighting will meet the standard outlined in '1'DC 18.430.040.G. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 7350 SW Landmark Lane, Suite 120; on the north side of SW Landmark Lane, south and west of SW 72nd Avenue, and east of Fanno Creek. The 1.06-acre site is made up of one (1) tax lot, and contains one (1) existing industrial building, with associated parking and landscaping. City records show the subject tenant space was previously occupied by a general industrial use. The applicant is proposing a new non-retail marijuana facility inside the subject tenant space for marijuana processing, which is also considered a general industrial use under'IDC Chapter 18.60 Use Categories. The site is located in the Heavy Industrial Zone (I-H). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.430 Marijuana Facilities: 18.430.040 Development Standards A. The proposed development complies with all applicable state requirements and requirements of this title. The proposed development complies or can be made to comply with all applicable state requirements and requirements of this Title,as demonstrated by the analysis contained within this decision,and through the imposition of conditions of approval. All necessary conditions must be satisfied prior to occupancy. This standard is met. B. The proposed development meets all of the following site location restrictions. All distances shall be measured at the closest property lines between the proposed site and nearest lot or MAR2018-00001 Process Development Labs,LLC 2 parcel containing the specified use or characteristic. 1. Marijuana facilities are prohibited within the MU-CBD zone. The proposed marijuana facility is not located within the MU-CBD zone;it is located within the I-H zone. This standard is met. 2. The proposed development is not within 1,000 feet of a public or private elementary school,secondary school, or career school attended primarily by minors. Staff reviewed city maps to confirm that the proposed marijuana facility is not located within 1,000 feet of a public or private elementary school, secondary school, or career school attended primarily by minors. This standard is met. 3. Sale-oriented retail and wholesale sales uses open to the public shall be subject to the following restrictions: a. Shall be located on a lot or parcel with frontage along Pacific Highway (Oregon Route 99W); b. Shall not be located within 1,000 feet of another state-licensed retail or wholesale marijuana facility within or outside of city limits;and c. Shall not be located within 500 feet of a public library or Tigard parks and recreation zone. This proposal is for a non-retail marijuana facility for marijuana processing (a general industrial use). Therefore,these standards do not apply. 4. Non-retail uses and wholesale sales uses not open to the public shall not be located within 500 feet of one or more of the following zones or facilities: a. Residential zone; b. Parks and recreation zone; c. Public library. This proposal is for a non-retail marijuana facility for marijuana processing(a general industrial use) at 7350 SW Landmark Lane,Suite 120.Staff reviewed city maps to confirm the proposed facility is not located within 500 feet of a residential zone, the Parks and Recreation Zone (PR), or a public library.These standards are met. D. Hours of commercial operation shall be limited to the hours between 7:00 am and 10:00 pm. General industrial uses with no on-site retail activity are exempt from this restriction. This proposal is for a non-retail marijuana facility for marijuana processing(a general industrial use),with no on-site retail activity.Therefore,this standard does not apply. E. Primary entrances shall be clearly visible from Pacific Highway(Oregon Route 99W). This standard only applies to marijuana facilities for sales-oriented retail and wholesale sales open to the public that are located on SW Pacific Highway. This proposal is for a non-retail marijuana facility for marijuana processing (a general industrial use). Additionally, this proposed marijuana facility is located on SW Landmark Lane,not SW Pacific Highway.Therefore,this standard does not apply. F. The proposed development shall be located inside a permanent building and may not be located within a trailer, shipping container, cargo container, tent, or motor vehicle. Outdoor MAR2018-00001 Process Development Labs,LLC 3 storage of merchandise,plants, or other materials is not allowed. Staff reviewed the applicant's site plan to confirm the proposed marijuana facility is located inside a permanent building. Additionally, the applicant's narrative states there will be no outdoor storage of merchandise,plants,or other materials. This standard is met. G. Parking lots, primary entrances, and exterior walkways shall be illuminated with downward facing security lighting to provide after-dark visibility to employees and patrons. Fixtures shall be located so that light patterns overlap at a height of 7 feet with a minimum illumination level of 1.0 footcandles at the darkest spot on the ground surface. The applicant's materials do not address security lighting. Accordingly, staff has included a condition of approval that requires the applicant to submit a site plan and photometric drawing prior to occupancy.These plans shall clearly illustrate how proposed security lighting will meet the standard outlined above. As conditioned,this standard is met. H. Drive-through marijuana facilities are prohibited. The applicant is not proposing a drive-through marijuana facility; this proposal is for a non-retail marijuana facility within a permanent building.This standard is met. I. The proposed development shall confine all marijuana odors and other objectionable odors to levels undetectable at the property line. The applicant's narrative states that all marijuana odors and other objectionable odors will be limited to levels undetectable at the property line.This standard is met. J. Marijuana or marijuana products shall not be visible from the exterior of the building or structure. Our operation is non-retail and the building is zoned I-H, heavy industrial. City staff has looked at the location and have determined that it meets the 500 feet rule found in the discussed city code. • The proposed site location is approximately 5622 SF of warehouse and office space. Our operation is located inside this building. All operations will be contained within this building and we will not have any storage of merchandise or any materials outside. • Our parking lot accommodates approximately 17 off street parking spaces. Our primary entrance, parking lot and surroundings are well lit and we will also have one camera outside our entrance for security purposes. • We have no drive through services what so ever. • Since we are not growing any marijuana, we are able to mitigate odor concerns by sealing and storing raw material in a sealed room behind a steel door.The only time marijuana is exposed in the open is when we are loading our processing machine. Our machines capacity holds 16 pounds of marijuana at a time. Our previous location was half the size of the proposed site and was located inside a build with multiple tenants. Prior to occupancy,the applicant shall submit a site plan and a photometric drawing.These plans shall clearly illustrate how proposed security lighting will meet the standard outlined in 'I'DC 18.430.040.G. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 7350 SW Landmark Lane, Suite 120; on the north side of SW Landmark Lane, south and west of SW 72nd Avenue, and east of Fanno Creek. The 1.06-acre site is made up of one (1) tax lot, and contains one (1) existing industrial building, with associated parking and landscaping. City records show the subject tenant space was previously occupied by a general industrial use. The applicant is proposing a new non-retail marijuana facility inside the subject tenant space for marijuana processing, which is also considered a general industrial use under TDC Chapter 18.60 Use Categories. The site is located in the Heavy Industrial Zone (I-H). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.430 Marijuana Facilities: 18.430.040 Development Standards A. The proposed development complies with all applicable state requirements and requirements of this title. The proposed development complies or can be made to comply with all applicable state requirements and requirements of this Title,as demonstrated by the analysis contained within this decision,and through the imposition of conditions of approval. All necessary conditions must be satisfied prior to occupancy. This standard is met. B. The proposed development meets all of the following site location restrictions. All distances shall be measured at the closest property lines between the proposed site and nearest lot or MAR2018-00001 Process Development Labs,LLC 2 parcel containing the specified use or characteristic. 1. Marijuana facilities are prohibited within the MU-CBD zone. The proposed marijuana facility is not located within the MU-CBD zone;it is located within the I-H zone. This standard is met. 2. The proposed development is not within 1,000 feet of a public or private elementary school,secondary school, or career school attended primarily by minors. Staff reviewed city maps to confirm that the proposed marijuana facility is not located within 1,000 feet of a public or private elementary school, secondary school, or career school attended primarily by minors. This standard is met. 3. Sale-oriented retail and wholesale sales uses open to the public shall be subject to the following restrictions: a. Shall be located on a lot or parcel with frontage along Pacific Highway(Oregon Route 99W); b. Shall not be located within 1,000 feet of another state-licensed retail or wholesale marijuana facility within or outside of city limits;and c. Shall not be located within 500 feet of a public library or Tigard parks and recreation zone. This proposal is for a non-retail marijuana facility for marijuana processing (a general industrial use). Therefore,these standards do not apply. 4. Non-retail uses and wholesale sales uses not open to the public shall not be located within 500 feet of one or more of the following zones or facilities: a. Residential zone; b. Parks and recreation zone; c. Public library. This proposal is for a non-retail marijuana facility for marijuana processing(a general industrial use) at 7350 SW Landmark Lane,Suite 120.Staff reviewed city maps to confirm the proposed facility is not located within 500 feet of a residential zone, the Parks and Recreation Zone (PR),or a public library. These standards are met. D. Hours of commercial operation shall be limited to the hours between 7:00 am and 10:00 pm. General industrial uses with no on-site retail activity are exempt from this restriction. This proposal is for a non-retail marijuana facility for marijuana processing(a general industrial use),with no on-site retail activity.Therefore,this standard does not apply. E. Primary entrances shall be clearly visible from Pacific Highway(Oregon Route 99W). This standard only applies to marijuana facilities for sales-oriented retail and wholesale sales open to the public that are located on SW Pacific Highway. This proposal is for a non-retail marijuana facility for marijuana processing (a general industrial use). Additionally, this proposed marijuana facility is located on SW Landmark Lane,not SW Pacific Highway.Therefore,this standard does not apply. F. The proposed development shall be located inside a permanent building and may not be located within a trailer, shipping container, cargo container, tent, or motor vehicle. Outdoor MAR2018-00001 Process Development Labs,LLC 3 storage of merchandise,plants,or other materials is not allowed. Staff reviewed the applicant's site plan to confirm the proposed marijuana facility is located inside a permanent building. Additionally, the applicant's narrative states there will be no outdoor storage of merchandise,plants,or other materials.This standard is met. G. Parking lots, primary entrances, and exterior walkways shall be illuminated with downward facing security lighting to provide after-dark visibility to employees and patrons. Fixtures shall be located so that light patterns overlap at a height of 7 feet with a minimum illumination level of 1.0 footcandles at the darkest spot on the ground surface. The applicant's materials do not address security lighting. Accordingly, staff has included a condition of approval that requires the applicant to submit a site plan and photometric drawing prior to occupancy.These plans shall clearly illustrate how proposed security lighting will meet the standard outlined above. As conditioned, this standard is met. H. Drive-through marijuana facilities are prohibited. The applicant is not proposing a drive-through marijuana facility; this proposal is for a non-retail marijuana facility within a permanent building.This standard is met. I. The proposed development shall confine all marijuana odors and other objectionable odors to levels undetectable at the property line. The applicant's narrative states that all marijuana odors and other objectionable odors will be limited to levels undetectable at the property line.This standard is met. J. Marijuana or marijuana products shall not be visible from the exterior of the building or structure. The foot candle readings as shown on the sketch were taken by me with a Calibrated Minolta T-1 Foot Candle Meter. These are absolute readings for a specific point in time. My understanding is all of the fixtures on the back side (LED) are new. These readings do not account for the age of the fixture and any related light losses. When I do a design, I factor in the expected losses over the life of the fixture, which are usually 30% at 50,000 hours of operation for LED's and 20% for dirt accumulation over this same period. Total expected losses over the maintained life cycle would be 46%. Since LED's seldom burn out, if they are not maintained (replaced and or cleaned over the 50,000 hour expected life) and will drop below the designed maintained foot candle level. The Atlas claim of 200,000 hours of life is highly suspect with no supporting LM-79 and LM-80 data. LM-79 and LM-80 data is an accepted standard, which verifies that this fixture meets this IESNA (Illumination of Engineering Society of North America) Standard. Regardless, a 50,000 hour life for this LED fixture is a reasonable expectation. The fixture at the front entrance is Metal Halide and has an expected average maintenance life of 15,000 hours with an expected loss of approximately 30% and a 20% loss for dirt accumulation over at the time of replacement. This lamp is not the same as an LED lamp and will fail sometime before or at the end of its expected average life of 15,000 hours. Above the front entrance, above the loading dock, there is a supplemental fluorescent fixture that produces a high level of light. I did not take a foot candle reading at the loading dock. At the driveway entrance, there is a light pole, most likely maintained by the City of Tigard. The light distribution is partially blocked by trees on the east 2 side of the driveway entrance. While light levels are reasonably good, they can be improved with proper tree pruning. Visibility is about managing contrast within acceptable limits. These fixtures have no glare shielding and are not dark sky friendly. It is more about good visible contrast and not just about foot candle levels. The City of Tigard may want to adopt the National Model Lighting Ordinance Standard to minimize objectionable glare, light trespass and best dark sky practices. Let me know if these light levels are acceptable as is. If not, let me know the minimum standard I need to design to, as well as the exact area that needs to meet this standard and I will produce an acceptable lighting plan for implementation.
