The R-7 zone is designed to accommodate attached single-family homes, detached single-family homes with or without accessory dwelling units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. BACKGROUND INFORMATION Site Information: The subject parcel was originally approved as Lot 32 of the Handy Acres Subdivision in the year 1945, and is located on SW 135`' Avenue, which is located south of SW Walnut Street and west of SW 134`" Avenue. The site is currently occupied by a detached, single-family home, with an attached three-car garage, and paved driveway. The applicant states that the home is 1,503 square feet in size, however according to the Washington County Assessment and Taxation Report, the home measures 1,942 square feet in size. No previous land use approvals were found that affect the subject property.The site is zoned R-7 (Medium-Density Residential). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.410 ACCESSORY DWELLING UNITS 18.410.030 Approval Standards A.Location.As provided in the use and housing types tables in Chapter 18.110,Residential Zones and Chapter 18.120, Commercial Zones, accessory dwelling units are permitted as limited uses in all base zones where detached, single-family dwelling units are permitted. The site is located within the R-7 Zone,where detached single family dwellings are permitted.Therefore, an accessory dwelling unit is permitted on this property. This standard is met. B. Standards.The approval authority shall approve an application for an accessory dwelling unit when all of the following are met: 1.An accessory dwelling unit may be created within or as an addition to a detached single-family dwelling. For the purposes of this chapter, "addition" means the sharing of a common wall with the primary residence. A garage may not be converted to an accessory dwelling unit unless it is rebuilt as part of the primary structure; The proposed accessory dwelling unit will be located in an existing space above the garage, which is attached to the single-family dwelling. This standard is met. 2. An accessory dwelling unit may not exceed 50 percent of the size of the primary unit, up to a maximum of 800 square feet; The proposed accessory dwelling unit will occupy 746 square feet of the primary unit, which measures 1,942 square feet in size.Accordingly,the accessory dwelling unit is approximately 38%of the size of the primary unit. Therefore, the accessory dwelling unit is less than 50% of the size of the primary unit, and is below the 800-square-foot maximum. This standard is met. 3. The number of residents permitted to inhabit the accessory dwelling unit is regulated by the state building code; The applicant's narrative states the number of residents that will inhabit the accessory dwelling unit will comply with State Building Code regulations. This standard is met. 4. Either the primary or accessory dwelling unit shall be owner-occupied; ADU2018-00001 FENNELLY ACCESORY DWELLING UNIT Page 2 of 4 The applicant, who is also the owner of the primary unit, currently occupies the primary unit. The applicant's narrative states that the primary or accessory dwelling unit will continue to be owner occupied into the future. This standard is met. 5. A primary residence in which an accessory dwelling unit has been created may have only one home occupation; City records for this property show no current home occupation permits on file. This standard is met. 6. In addition to the number of parking spaces required for the primary residence, as provided in Chapter 18.310, Off-Street Parking and Loading, 1 parking space shall be provided for the accessory dwelling unit. This parking space shall be paved or covered; The minimum required off-street parking for the primary residence is one parking space. The accessory dwelling unit is also required to have one parking space. There is currently a three-car garage and paved driveway on the property, which will provide adequate parking for both the primary and accessory dwelling units.The applicant's narrative states that the three-car garage has both a two car overhead door and a one car overhead door. The applicant's narrative also states that the accessory dwelling unit occupant will be allowed to use the one car overhead door garage entrance. This standard is met. 7. The front door of the accessory dwelling unit shall not be located on the front facade of the primary unit unless the door is already existing; The front door to the accessory dwelling unit is located inside of the garage, and is not visible on the front facade of the home. The applicant states that the primary occupant of the accessory dwelling unit will be using either a door located on the back of the garage or the garage door to access the primary accessory dwelling unit entrance. This standard is met. 8. There shall be compliance with all development standards established in the base zone. (Ord. 17-22 §2) Staff reviewed the applicant's materials and determined that the proposed accessory dwelling unit will meet all of the development standards for the R-7 Zone as shown in the table below.
