BACKGROUND INFORMATION & PROJECT DESCRIPTION Site Information: The 0.10-acre site is located on the southeast side of SW Grant Avenue, north of SW Johnson Street, south of SW Tigard Street,and directly adjacent to Fanno Creek Trail.The property is currently occupied by a detached, single-family dwelling with an attached garage, and a 196-square-foot accessory structure. The property connects to SW Grant Avenue via a 20-foot-wide easement across an adjacent property (WCTM 2S102BA, Tax Lot 1503). According to the Washington County Assessment and Taxation Report, the existing dwelling with attached garage measures 1,376 square feet in size. The site is zoned Medium-Density Residential (R-12). The property is partially located in the Federal Emergency Management Agency's Special Flood Hazard Area. SECTION IV. PUBLIC COMMENTS The Tigard Community Development Code requires that all property owners of record within 500 feet of the subject site be notified of the proposal,and be given an opportunity for written comments and/or oral testimony prior issuance of the decision. Staff mailed Notices of this Type II Application to affected parties on May 21,2018.No public comments were received. SECTION V. APPLICABLE REVIEW CRITERIA& FINDINGS 18.760 Home Occupations 18.760.040 Approval Standards A. General. All home occupations except those that have proven nonconforming status shall comply with all of the following in addition to the standards for Type I and Type II home occupations provided in Subsections 18.760.040.B and C. 1. Home occupations may be undertaken only by the principal occupant(s) of a dwelling unit. The applicant is the property owner and principal occupant of the residential property in which the home occupation is proposed to take place.This standard is met. 2. There shall be no more than 3 deliveries per week to the residence by suppliers. The applicant will not have more than three (3) deliveries to the residence by suppliers that are directly associated with this home occupation.This standard is met. 3. There shall be no offensive noise,vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. The proposed home occupation is for a law office that will operate Monday through Friday,between the hours of 9 a.m. to 5 p.m. The applicant proposes to see a maximum of six (6) daily clients, and to have one (1) part-time employee. It is anticipated that none of the items listed above will be compromised beyond allowable levels as a result of this project. All activities will be conducted indoors, within an existing attached garage. This standard is met. 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure.The total area that may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 II0P2018-00019 LAW OFFICES OF ERIK NICI IOLSON PAGE 2 OF 6 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25 percent of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet.The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. This home occupation will be operated entirely within an existing 396-square-foot attached garage. The property is currently occupied by a detached, single-family dwelling with an attached garage, and an accessory structure.The combined residence and accessory structure gross floor area is 1,572 square feet; therefore, 25 percent of this combined gross floor area will be utilized for the home occupation. Accordingly,this proposal does not exceed the floor area maximums stated above (528 square feet,or 25 percent of the combined residence and accessory structure gross floor area).The applicant has indicated that any materials or products stored on site will not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. This standard is met. 5. A home occupation shall not make necessary a change in the state building code use classification of a dwelling unit. Any accessory building that is used shall meet state building code requirements. The applicant is not proposing to change the State Building Code use classification of the existing dwelling unit, and the home occupation is not proposed within an accessory building. This standard is met. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in subsection D of this section. Each home occupation shall apply for a separate home occupation permit,if required by this chapter. Staff conducted a search of city records,and found there are no other home occupations at this property. This standard is met. 7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials that in the judgment of the fire marshal pose a dangerous risk to the residence, its occupants, and/or surrounding properties.Those individuals that are engaged in home occupations shall make available to the fire marshal for review the material safety data sheets that pertain to all potentially toxic and/or flammable materials associated with the use. The proposed home occupation is for a law office, and will not involve any storage and/or distribution of toxic or flammable materials that pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Furthermore,Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal to review,and had no objections.This standard is met. 8. No home occupation shall require any on or off-street parking other than that normally required for a residence. This home occupation will not require any on or off-street parking other than that normally required for a residence. The applicant's site plan shows there is an existing paved parking area located in front of the attached garage that is available for use by the applicant and clients. Additionally, on-street parking is permitted on the northwest side of SW Grant Avenue.This standard is met. I IOP2018-00019 LAW OFFICES OF ERIK NICHOISON PAGE 3 OF 6 9. The following uses are not allowed as home occupations: a. Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c. Junk and salvage operations; d. Storage and/or sale of fireworks. The applicant's proposal for a home occupation does not involve any of the activities listed above. This standard is met. 10. There shall be no exterior storage of vehicles of any kind used for the business except that 1 commercially licensed vehicle of not more than 0.75 ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. The applicant is not proposing exterior storage of vehicles of any kind used for the business. This standard is met. C. Type II home occupations. Type II home occupations shall comply with the following: 1. One non-illuminated sign not exceeding 1.5 square feet may be permitted. The sign may be attached to the residence, an accessory structure or placed in a window; The applicant proposes to have one (1) non-illuminated sign not exceeding 1.5 square feet in size. The sign will be attached to the residence,an accessory structure,or placed in a window.This standard is met. 2. No more than 1 outside volunteer or employee who is not a principal resident of the premises; The applicant is the property owner and principal resident of the premises in which the home occupation is proposed to take place.The applicant proposes to have only one(1) part-time employee.This standard is met. 3. No more than 6 daily customers or clients. Customers and clients may not visit the business between the hours of 10 p.m. and 8 a.m. and shall not generate excessive traffic or monopolize on-street parking; and The proposed home occupation is for a law office that will operate Monday through Friday,between the hours of 9 a.m. to 5 p.m.The applicant proposes to see a maximum of six (6) daily clients.This proposal will not generate excessive traffic,and will not require any on or off-street parking other than that normally required for a residence.This standard is met. 4. Storage of materials,goods, and equipment that is screened entirely from view by a solid fence. Storage shall not exceed 5 percent of the total lot area and shall not occur within the front yard or the required side yard setback. (Ord. 17-22 §2) The applicant is not proposing any outdoor storage of materials,goods,or equipment. This standard does not apply. FINDING: The proposed Type II Home Occupation complies with all statutory and ordinance requirements and regulations, as demonstrated by the analysis contained within this administrative decision. OTHER STAFF COMMENTS The City of Tigard Building Division, Engineering Division, and Police Department were sent copies of the applicant's proposal,and had no objections. SECTION VII.
