APPLICATION SUMMARY FILE NAME: Jaguar Land Rover CASE NO.: Urban Forestry Review(UFR) UFR2018-00006 PROPOSAL: The applicant proposes to modify the Urban Forestry Plan approved under the Jaguar Land Rover Site Development Review (Case No. SDR2017-00005). Specifically, the applicant proposes to change the tree preservation plan, provide additional trees,and to meet the stand-grown tree standards of the Urban Forestry Manual rather than the open-grown tree standards used under the original approval. These changes are necessary for the applicant to meet the requirements of their Clean Water Services service provider letter (SPL 17-002745). APPLICANT: Mildren Design Group 7650 SW Beveland Street Suite 120 Tigard,OR 97223 OWNER: Macerich, Inc. 401 Wilshire Boulevard Santa Monica,CA LOCATION: 10125 SW Washington Square Road;Washington County Tax Lot 1S135BA 00101. ZONING DESIGNATION: MUC: mixed-use commercial. The MUC zoning district includes land around the Washington Square Mall and land immediately west of Highway 217. Primary uses permitted include office buildings,retail,and service uses.Also permitted are mixed-use developments and housing at densities of 50 units per acre. Larger buildings are encouraged in this area with parking under,behind,or to the sides of buildings. Mall Subdistrict: B. Subdistricts. The sub-area identified on Map 18.670.A and described below has different land use and development regulations. 1.Mall Subdistrict. In addition to the land uses permitted in TABLE 18.120.1 USE TABLE: COMMERCIAL ZONES for the MUC zone, motor vehicle sales/rental may be permitted as a stand-alone use provided all outdoor vehicle sales inventory is screened from view from adjacent public roadways by a mixture of both opaque screens and UFR2018-00006 jaguar Land Rover—Urban Forestry Plan Modification 1 evergreen landscaping,and complies with all other applicable development standards. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.520 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF SITE/BUILDING PERMITS: The applicant shall prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to the COMMUNITY PLANNING DIVISION,ATTN: SCHUYLER WARREN 503-718-2437. The cover letter shall clearly identify where in the submittal the required information is found: 1. Prior to site work, the applicant shall provide a tree establishment bond for all trees to be planted per the approved urban forestry plan.The total bond amount shall be equivalent to the city's average cost to plant and maintain a tree per the applicable standards in the Urban Forestry Manual for a period of two years after planting multiplied by the total number of trees to be planted and maintained. 2. Prior to site work,the applicant shall provide a fee to cover the city's cost of collecting and processing the inventory data for the entire urban forestry plan for all stand-grown and open-grown trees. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject site is a part of the Washington Square Mall development and is under the common ownership of Macerich, Inc. with other mall properties. The site most recently included a movie theater and a restaurant. Both of these businesses have closed,and the movie theater has since been demolished. The former restaurant building is proposed to be demolished prior to construction of new buildings to house a Jaguar Land Rover automobile dealership. In order to better accommodate development on the site, Macerich submitted a separate lot line adjustment application that is coincident with the lease line of the proposed use. This application, approved on November 8,2017,also had the effect of separating the development site from an adjoining restaurant, the Thirsty Lion. UFR2018-00006 jaguar Land Rover—Urban horestry Plan Modification 2 The proposed development includes an automobile dealership and accessory uses including parking, storage, and motor vehicle service and repair. The applicant proposes construction of a 64,432-square- foot main building that includes the showroom, associated offices,repair and maintenance areas, and a two-story parking garage.A separate 1,435-square-foot pavilion building is proposed along the frontage of Greenburg Road. Development associated with the use as an automobile dealership was approved with conditions under a site development review application (SDR2017-00005). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Chapter 18.520 Urban Forestry Plan: 18.520.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect)or a person that is both a certified arborist and tree risk assessor(the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; Applicant's Statement: The Urban Forestry plan updates were coordinated by the project landscape architect,with support from the project developer,architect,environmental services consultant,and civil engineer. Staff Response: This standard is met. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual; Applicant's Statement: The Tree Preservation Plans approved as part of SDR2017-00005 depicted the removal of 79 trees and the preservation of 2 trees. The modified Tree Preservation Plans depict the removal of 65 trees and the preservation of 16 trees. The reduction in tree removal and increase in tree preservation was the result of the change in landscape design to comply with the CWS vegetated corridor enhancement and mitigation requirements. Staff Response: The applicant has provided evidence that all of the tree preservation and removal standards in the Urban Forestry Manual have been met. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and Applicant's Statement:Applicant is required,at minimum,to provide 30% (10,002 SF) tree canopy cover over the parking areas, and 33% (64,498 SF) tree canopy cover over the non-parking site areas. The Landscape Plans approved as part of SDR2017-00005 included 30% (10,002 SF) of tree canopy cover over the parking areas,and 27% (52,335 SF) of canopy cover over the non-parking site area. The Urban Forestry plan modifications now depict a 37% (12,388 SF) tree canopy cover over the parking areas, and a 45% (88,840 SF) tree canopy cover over the non-parking area site. Tree Canopy Cover requirements have been exceeded. UFR2018-00006 Jaguar Land Rover—Urban Forestry Plan Modification 3 Staff Response: The applicant has demonstrated that the tree canopy standards of the Urban Forestry Manual have been met. 4. Meet the supplemental report standards in the Urban Forestry Manual. Applicant's Statement: The Urban Forestry Plan - Supplemental Report Requirements described in Section 10 Part 3 of the Urban Forestry Manual requires the project arborist or landscape architect to address all items in part 3.B through P. Between the responses contained in this Urban Forestry Modification Summary and the modifications to the Landscape Plans, Tree Preservation and Removal Plans, and the Tree Canopy Site Plans, applicant believes the Supplemental Report standards have been met with this Summary Memo. Staff Response: The applicant has submitted landscape plans and a supplemental report detailing compliance with the standards of Section 10, Part 3 of the Urban Forestry Manual. Staff has reviewed the submitted materials and found them to contain adequate information to demonstrate compliance with the standards of the Urban Forestry Manual. The applicant was conditioned in SDR2017-00005 to provide a tree establishment bond and an inventory fee under conditions 6 and 7. These conditions are now superseded as a result of the modified Urban Forestry Plan; therefore, new conditions for the payment of the tree establishment bond the inventory fees are required. CONDITION: • Prior to site work, the applicant shall provide a tree establishment bond for all trees to be planted per the approved urban forestry plan.The total bond amount shall be equivalent to the city's average cost to plant and maintain a tree per the applicable standards in the Urban Forestry Manual for a period of two years after planting multiplied by the total number of trees to be planted and maintained. • Prior to site work,the applicant shall provide a fee to cover the city's cost of collecting and processing the inventory data for the entire urban forestry plan for all stand-grown and open-grown trees. 18.520.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Application A. Approval process. Except as exempted in Subsection 18.520.070.B, an application for a modification to the urban forestry plan component of an approved land use shall be processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Subsection 18.520.070.C. The applicant proposes to modify the Urban Forestry Plan originally approved under Case No. SDR2017-00005. Specifically, the applicant proposes to change the tree preservation plan, provide additional trees, and to meet the stand-grown tree standards of the Urban Forestry Manual rather than the open-grown tree standards used under the original approval. These changes are necessary for the applicant to meet the requirements of their Clean Water Services service provider letter(SPL 17-002745). The applicant is not exempt under the provisions of Subsection 18.520.070.B,and therefore must obtain approval for the proposed modifications using the process provided in this Section. C. Approval criteria. The approval authority shall approve or approve with conditions the modification to the urban forestry plan component of an approved land use application when UFR2018-00006 Jaguar Land Rover—Urban Forestry Plan Modification 4 all of the following are met: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist has provided a revised report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. Applicant's Statement:The approved Urban Forestry Plan for the JLR project was modified to implement vegetated corridor enhancement and mitigation improvements required by Clean Water Services (CWS) defined in SPL File no. 17-002745. The SPL issuance on April 17, 2018 follows the April 2, 2018 Site Development Review approval, necessitating the vegetated corridor enhancement and mitigation modifications. Staff Response: This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The applicant has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.520.030. (Ord. 17-22§2) The applicant submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with Section 18.520.030, including tree preservation, protection, and canopy standards as demonstrated above.This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Jaguar Land Rover development meets all applicable approval criteria. The tree plantings in the vegetated corridor meet the stand-grown tree standards as described in Section 10 Part 2 Paragraph M (pg.10-4)of the Urban Forestry Manual.The Tree Canopy&Soil Volume Plans illustrate a mature tree canopy dripline,selected tree types are from the native tree list in the Urban Forestry Manual, and the illustrated dripline sizes are consistent with the dimensions of the native tree list.All stand-grown trees are equivalent to a 1-gallon container,and all trees within the stand-grown area average no closer apart than 10 feet from new or existing trees,and average no further apart than 20 feet from new or existing trees. All trees within the stand-grown area are a minimum of 30 feet from the face of the nearest habitable buildings.All trees within the stand-grown area are a minimum of 2.5 feet from any hard pavement surfaces. There are no overhead utilities within the stand-grown area,so there will be no conflict with aerial utilities. Every tree within the stand-grown area is identified on the tables included in the Tree Canopy&Soil Volume Plans,and the Landscape Plans. 4.Meet the supplemental report standards in the Urban Forestry Manual. RESPONSE:The Urban Forestry Plan—Supplemental Report Requirements described in Section 10 Part 3 of the Urban Forestry Manual requires the project arborist or landscape architect to address all items in part 3.B through P. Between the responses contained in this Urban Forestry Modification Summary and the Page 2 May 16, 2018 modifications to the Landscape Plans,Tree Preservation and Removal Plans,and the Tree Canopy Site Plans, applicant believes the Supplemental Report standards have been met with this Summary Memo. Tree Canopy Fee If the supplemental report demonstrates that the applicable standard percent effective tree canopy cover will not be provided through any combination of tree planting or preservation for the overall development site (excluding streets)or that the 15 percent effective tree canopy cover will not be provided through any combination of tree planting or preservation for any individual lot or tract in the R-1, R-2, R-3.5, R-4.5 and R-7 zones(when the overall development site meets or exceeds the standard percent effective tree canopy cover), then the applicant shall provide the city a tree canopy fee according to the methodology outlined in the tree canopy fee calculation requirements in the Urban Forestry Manual. RESPONSE:The deficit in tree canopy cover over the non-parking site area was noted in SDR2017-0005 Conditions of Approval No.14.The condition required payment of fee-in-lieu for 12,814 square feet of tree canopy.According to the tree canopy fee calculation applicant calculated the fee-in-lieu to be$37,801.13 ($2.95 per SF x 12,814 SF).With the vegetated corridor enhancement and mitigation modifications,the total tree canopy coverage requirement is met,so no fee-in-lieu is required of the applicant. Section 10—Urban Forestry Plan Standards Part 1 Tree Preservation and Removal Site Plan Requirements RESPONSE:The Tree Preservation and Removal Site Plans approved as part of SDR2017-00005 complied with Section 10, Part 1 of the Urban Forestry Manual Plan Standards.These plans were modified to include the CWS Vegetated Corridor enhancement and mitigation elements,including new tree protection information. The requirements of Section 10,Part 1 have been met. Part 2 Tree Canopy Site Plan Requirements RESPONSE:The Tree Canopy Site Plans approved as part of SDR2017-00005 complied with Section 10,Part 2 of the Urban Forestry Manual Plan Standards.These plans were modified to include the CWS Vegetated Corridor enhancement and mitigation elements,including new proposed trees,protected trees,and updated tree canopy coverage calculations.The requirements of Section 10,Part 2 have been met. Part 3 Supplemental Report Requirements Re-tabluate or recalculate the tree canopy percentages. RESPONSE:The tree canopy coverage percentages have been recalculated and the tables updated. Applicant will be conditioned to pay an additional tree establishment bond and additional inventory fees for each additional tree over the 96 shown in the approved Urban Forestry Plans. RESPONSE:Applicant understands and agrees to pay additional tree establishment bond and inventory fees assessed as a result of the modifications to the Urban Forestry Plans.
