The findings and conclusions on which the Director based his decision are noted below. A. FINDING OF FACT 1 . Background Conditional use approval for a legal advisory service to be operated from the home on the site was denied by the Planning Commission in • May, 1976. No other applications regarding this site have been reviewed by the City. 2 . Vicinity Information The subject parcel is bordered on the east by single family . residences. Immediately to the south is a 42 foot by 120 foot land locked property used as a garden. Further south are additional single family residences. These parcels are all zoned R-4.5 (Residential, 4.5 units/acre) . The Birches apartment complex is located to the west: of the subject property. Across Greenburg Road are single family residences and a group care residence for adolescents. These parcels and the subject parcel are zoned R-12 (Residential, 12 units/acre) . 3 . Site Information and Proposal Description The parcel is presently occupi-A by a two story house and an III additional two story residential unit that was constructed in 1987. A double garage occupies the ground floor of the additional unit. The two units are connected by a dei,<. The Community Development Code restricts fence height to throe feet in the area from the front yard setback line forward . The fence was constructed after the enactment of this fence height restriction and ther•efo•'e the fence is in violation of this requirement. The Community Development Code allows the Director to permit a height greater than otherwise permitted in order to mitigate against potential adverse effects . The applicant has requested that the Director permit the additional height to mitigate the effects of road noise on the residential units. The applicant proposes to construct an additional freestanding •• residence on the east side of the property and to convert the original residence into two units. Because there will be more than two residential units on the property, the use is classified as multiple family residential, a permitted use in the R-12 zone. The proposed additional units will change the use classification of the property; • therefore, Site Development Review of the proposed site plan is required by the Community Development Code. • The applicant proposes to construct the 884 square foot residential unit in the southeast corner of the property. The residence would be • located 5 feet from the east or side property line when the Community Development Code requires a 30 foot side yard setback if the property abuts a more restrictive zone. The unit would be 15 feet from the south or rear property line whereas 30 feet is required by the Code. Variances to these setback requirements have been requested. A deck is planned to butt up against the fence on the south and east sides. The Code allows a deck to project into a required setback area to no more than 3 feet from a property line. The applicant proposes little in the way of changes to the existing landscaping except with regard to the area disturbed for construction of the residential unit. Access and parking will be provided by the existing 20 foot wide circular concrete driveway. The driveway includes 6 presently uncovered parking spaces, including 3 located in • front of the proposed detached unit. The applicant proposes to cover the 3 spaces located between the driveway entrances with an open-sided cover. Two additional covered spaces are provided in the existing garage. The proposed site plan calls for the existing driveway to be designated fur one way use with ingress to be provided by the western • driveway and egress provided by the eastern driveway. Storm drainage is proposed to be routed to an existing subsurface stormwater reservoir on the site. Sanitary sewer service would be provided through connection to the existing lateral that runs south to Lewis Lane. 4. The property fronts Greenburg Road and has two existing access_.3 . Greenburg Road is designated as a major collector and cur•reotly • has 60 foot of right--of---way, two traffic lanes, and no curbs or sidewalks . Half—street improvements to Greenburg Road will not be required at this time. A waiver of remonstrance agreement, executed by the applicant, for future improvement of Greenburg Road shall be recorded. 2. The two accesses will be allowed onto Greenburg Road provided that they are signed as "Entrance Only" and "Exit Only" and the current width is maintained at the property line as shown on the submitted plan. The accesses shall be paved and tapered to 25 foot of width at the road. The entrance shall be tapered to the north and the exit tapered to the south. 3 . The accesses do not conform to visual clearance area requirements of the Community, Development Code due to the existence of the • fence and trees and shrubs on the right—of—way and on private property. However, the Engineering Division believes that sight clearance for the entrance should provide adequate safety for • traffic and pedestrians because autos will only be entering from Greenburg Road at this point and thus will not be impacted by the visual obstructions. The exit does not have adequate visual clearance to the south. At a minimum the small, pruned cedar and fence post and rail in the right—of—way must be removed. A field visit by the Engineering Division will be required to determine • the extent of necessary clearing when the exit is opened to traffic. Additional clearing, including removal of some fencing and landscaping will be necessary at the time of road widening. 4. The property currently has sanitary sewer service to the rear of the property. Sanitary sewer connection permits are required for the additional units . Connections shall be according to the Uniform Plumbing Code. 5. The property currently has on—site storm/drainag^ retention consisting of a 10'x20'x18' deep, earth covered, rock filled reservoir. The existing system, reported by the applicant to be functioning adequately, shall be allowed to remain. However, if the system shall fail and cause storm drainage to flow onto adjacent property, an alternate method shall be required. • No other comments were received. B. The applicant' s concern with noise from Grecnburg Road is easily understood. Because the fence is already in existence and is temporary because it will need to be removed or shortened to provide adequate visual clearance when Greenburg Road is widened in the future, the Director believes it is reasonable to allow the continued use of the fence until that time in order to reduce the impacts of road noise. Replacement of the over—height fence at any time prior to road widening is prohibited. The Director also finds it reasonable to allow the fence to be over—height in the rear and side yards to provide additional buffering and separation of differing development densities. Setbacks The proposed site plan would situate the proposed single unit dwelling 15 feet from the rear property line and five feet fr'Am the east side property line. The Community Development Code requires a 30 foot setback from the side and rear property lines when the property abuts a more restrictive zoning district. The subject property abuts parcels zoned R-4.5 on the east and south sides. The additional setback requirement therefore applies. In addition, the site plan proposes construction of a deck that would abut the fence on the side and rear property lines. The CDC requires that a 3 foot setback be maintained between a deck and the property line (CDC 10.96,070) . The applicant requests a variance to the side and rear yard setback requirements to permit his site plan. The applicant asserts that the variances would help maintain the character of the neighborhood. Section 18. 134.050 of the Community Development Code lists the following approval criteria for a variance: 1 . The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same district or vicinity; 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; 4. Tigard OR 97223 Dear Mr. Drennan: This letter has been written at your request, to explain the basis for the city building department classifying a building(located at 11490 S • Greenburg Rd.) as an SR occupancy. [t must first be made clear that the city municipal code and/or zoning regulations are NOT used to determine the occupancy of a structure with respect to the building code, nor does the building code dictate the zoning regulations within the city. It is the responsibility of the building department to provide reasonable safeguards for fire and life safety for occu,)ants of buildings within the city. It is also the responsibility of the building department to classify the building under an occupancy which it most nearly resembles based on proposed fire and life hazard(note, this only pertains to fire and life safety regulations, not zoning) . Based on the information received from representatives of the Janis Youth Program during an inspection of the site in May of 1986, it was determined that the proposed use most nearly resembled an SR occupancy, based on the following: 1. The proposed use was that of a youth type shelter, housing on a temporary basis youths over the age of six who did not have any mental or physical handicaps. 2. Classifying the use as an I(institutional) occupancy did not seem applicable, as institutional type occupancies house occupants who are mentally or physically handicapped, physically restrained(i.e.jails,prisons) or those who do not possess sufficient facilities or abilities to take positive action in an emergency situation. 3. The proposed use could have fallen into an R—1 occupancy, somewhere between an apartment and hotel, which would have required little or no additional fire or life safety protection. Because of the age of the structure it was determined that the structure warranted additional protection for the occupants and structure itself. Therefore, it was determined the proposed use beet fit into an SR occupancy. The issue in question appears to he the use of the structure with respect to city municipal. zoning regulations, which is the responsibility of the city planning department to interpret and enforce. I hope this clears up the confusion with respect to the building department.
