The purpose of this adjustment is to accommodate a new vehicle sales use for a Jaguar/Land Rover dealership. The proposed use is the subject of a separate site development review,SDR2017-00005. The MUC zone includes land around the Washington Square Mall and land immediately west of Highway 217.Primary uses permitted include office buildings, retail, and service uses. Also permitted are mixed-use developments and housing at densities of 50 units per acre. Larger buildings are encouraged in this area with parking under, behind or to the sides of buildings. In addition to the standards of this chapter,development within this zone is subject to the standards of Chapter 18.670. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR A PERIOD OF EIGHTEEN(18)MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject 4.48 acre site is within the Mall Subdistrict of the Washington Square Regional Center Plan District. The property to be developed is the subject of a previous Lot Line Adjustment application (LLA2017-00010,issued November 8,2017) that resulted in a property line coincident with the lease line for the redevelopment under consideration in the associated site development review,SDR20017-00005. The subject property is part of the Washington Square Mall development and is under the common ownership of Macerich, Inc.The property previously included both a movie theater and a restaurant;the theater has been demolished and the restaurant is proposed to be demolished prior to redevelopment. The proposed development includes an automobile dealership and accessory uses including parking, storage, and motor vehicle service and repair. The applicant proposes construction of a 64,432 square foot main building that includes the showroom, associated offices, repair and maintenance areas, and a two-story parking garage. A separate 1,435 square foot pavilion building is proposed along the frontage of Greenburg Road. In order to accommodate the full range of automobile services, the applicant proposed a drive-through car wash as part of the development, west of the parking garage. A separate access lane not associated with the car wash is provided between the car wash and the western property line. The application for the associated site development review (SDR2017-00005) was submitted on September 12, 2017. Subsequent to that application, the Tigard Development Code, Title 18, was completely reorganized and renumbered. The application under current consideration is reviewed using the current criteria,which have different numbering than the code in which the SDR application is vested. Where appropriate, references to the former code numbers are provided in parentheses where current code citations are made. The purpose of this cross-referencing is to clarify that this approval applies to both the current code and to the code in which the associated SDR is vested. SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.310.040(18.765.040) General Design Standards D. On-site vehicle stacking for uses with drive-through service. 1. All uses providing drive-through services shall provide an on-site stacking lane for inbound vehicles as provided in Table 18.310.1(Table 18.765.1). 2. The director may reduce the length of the inbound stacking lane by means of an adjustment to be processed through a Type I procedure, as provided in Section NOTICE ON DECISION ADJ2018-00005 JAGUAR LAND ROVER PAGE 2 OF 5 18.710.050, using approval criteria in 18.790.030-B-5. The applicant has proposed one drive-through mechanical car wash to be included in the Jaguar Land Rover dealership development under separate review as SDR2017-00005. Table 18.310.1 provides minimum stacking lane lengths for various drive-through uses.According to the table,car washes require 75 feet per washing unit. The applicant is seeking to reduce the stacking lane from the required 75 feet to 50 feet. Therefore, the adjustment is considered using the approval criteria in 18.790.030.B.5. 18.790(18.370) Variances and Adjustments 18.790.030.B.5(18.370.020.C.6.g)Adjustments to Chapter 310, Off-Street Parking and Loading g. Reduction in length of stacking lanes shall be processed through a Type I procedure, as provided in Section 18.710.050. The approval authority shall approve or approve with conditions a reduction in the length of vehicle stacking lane required by 18.310.040.D.1 (18.765.040.D.2) if such a reduction is deemed appropriate after analysis of the size and location of the development, limited services available and other pertinent factors. The approval criteria for the reduction of a stacking require an analysis of the size and location of the development, limited services available, and other pertinent factors. No other approval standards are provided, and each of these is considered below. The code is not clear if the analysis of the size and location of the development includes all proposed improvements on the site or only the car wash portion. For the purposes of this approval, staff makes the determination that only the size and location of the car wash within the site merits consideration. The proposal for the 4.48 acre site includes two buildings — a 1,435 square foot pavilion building and a 65,669 square foot building including sales, office, and repair uses, as well as a parking garage. Additionally, the site plan shows 97,638 square feet of paving for parking and inventory storage and display. The proposed mechanical car wash is relatively small, with a footprint of approximately 1,275 square feet. The car wash is proposed to be located behind the parking structure along the western edge of the property, in an area predominantly used for service access. It is isolated from the accessway to the property from Washington Square Road. Given the size of the car wash in relation to the overall property, and its location away from public and private streets,it is reasonable to conclude that there is little potential impact to the functionality of the development or the adjacent street network in granting the adjustment. This criterion is met. The next criterion is consideration of the limited services available. The applicant has provided the following statement: "The proposed car wash is not for the general public, but is being provided as a service for those vehicle owners who have their vehicles in for servicing. Only Jaguar/Land Rover staff will be taking vehicles through the car wash after the vehicle owner has dropped off the vehicle for servicing. Therefore, the number of vehicles that might be stacked in line for this service is controlled by the service department, and can be regulated so as not to have more vehicles in line than can be accommodated without having a negative impact..." While the code is not clear on what "limited services available" means, it is reasonable to interpret this phrase as applying to the services provided by the drive-through facility.The applicant has demonstrated that the services of the mechanical car wash are limited, in that they are not publicly accessible and the NOTICE OF DECISION MJ2018-00005 JAGUAR LAND ROVER PAGE 3 OF 5 intent of the stacking lane requirement can be met through other means as a result of these limited services. Therefore, this criterion is met. The final approval criterion is consideration of other pertinent factors. In this case, consideration of size, location,and limited services are sufficient to grant the adjustment,and so the only other pertinent factors would be any negative impacts caused by the granting of the adjustment. The applicant provides the following statement: "The parking that is in the vicinity of the car wash, and thus, the stacking lane, are for the employees of the Jaguar/Land Rover sales and service facility, and not the general public. The drive lane for...vehicles brought to the car wash facility is behind the building containing the Jaguar/Land Rover sales and service uses,and not in an area where customers would be driving or parking. In addition, it is not likely that anyone looking for the bicycle parking area, which is inside the building, would be [a]ffected by the proposed adjustment to the stacking lane..." The stacking lane is effectively being reduced from three vehicles to two. Staff concurs that the negative impacts of this reduction to the stacking requirement are negligible or non-existent. This criterion is met. CONCLUSION: This proposal is in compliance with the applicable standards of this Title. SECTION VIII. Dear Schuyler, We are requesting an adjustment to the amount of vehicle stacking for a car wash as required by Code section 18.310.040.D.2 and Table 18.310.1 which includes a requirement to provide 75 feet of stacking lane for a mechanical care wash. The Code goes on to state in 18.310.040.D.2: 2. The director may reduce the length of the inbound stacking lane by means of an adjustment to be reviewed through a Type I procedure, as governed by Section 18.710.050, using approval criteria contained in 18.790.030.C.5. 3. Stacking lanes must be designed so that they do not interfere with parking and vehicle, pedestrian and bicycle circulation. Stacking lanes for the purpose of selling food must provide at least one clearly marked parking space per service window for the use of vehicles waiting for an order to be filled. In the application we submitted for the Jaguar/Land Rover dealership Development Review we addressed this Code section with the following response: A mechanical car wash is being proposed along the west side of the parking structure. See Sheets A1.1 and L1.1 for its exact location.The car wash is not for the general public. Only Jaguar/Land Rover staff will be taking vehicles through the car wash after the vehicle owner has dropped off the vehicle for service.And,the car wash is located in an area to be used for employee parking rather than customer parking,which is provided to the east of the parking structure. A distance of approximately 45 feet is provided at the entrance to the car wash for stacking,which is less than the required 75 feet found in Table 18.765.1 above. The car wash is in an area of the development where pedestrian and bicycle traffic will be at a minimum. The applicable Code sections has since been changed, and the correct table is 18.310.1, but the Code reads the same as before.And, we have determined that we can provide 50 feet of stacking land, rather than the 45 which we had expected to be able to provide. The approval criteria found in Code section 18.790.030.C.5 and responses to those criteria are found below: 5. RESPONSE:The requested adjustment will not have an adverse effect on parking, as the adjustment will not reduce the amount of parking provided. With the change to provide the car wash, and stacking area, the parking stalls have been relocated to the parking structure where storage has been removed to allow for the required parking spaces. c. Reductions in minimum parking requirements in existing developments for transit improvements shall be processed through a Type II procedure, as provided in Section 18.710.060. The approval authority shall approve or approve with conditions up to a 10 percent reduction in the total minimum vehicle parking spaces required in Table 18.310.2, at a conversion ratio of 1 space per 100 square feet of transit facility, when the applicant: i. Incorporates transit-related facilities such as bus stops and pull-outs, bus shelters, transit oriented developments and other transit-related development; and ii. Meets the following requirements: (A) A transit facility shall be located adjacent to a street with transit service.The facility should be located between the building and front property line, within 20 feet of an existing transit stop, or the facility may include a new transit stop if approved by TriMet. (B) A transit facility shall include a covered waiting or sitting area. d. Reduction in required bicycle parking shall be processed through a Type II procedure, as provided in Section 18.710.060. The approval authority shall approve or approve with conditions a reduction of required bicycle parking as required by Table 18.310.2, if the applicant can demonstrate that the proposed use by its nature would be reasonably anticipated to generate a lesser need for bicycle parking. RESPONSE:The requested adjustment does not reduce the amount of bicycle parking for the development for which the car wash is being proposed. f. The use of an alternative parking garage layout parking shall be processed through a Type II procedure, as provided in Section 18.710.060. The approval authority shall approve or approve with conditions an alternative design of parking garage that differs from the dimensional standards in Figure 18.310.2 when it can be demonstrated that: i. the proposed structure meets design guidelines of the Urban Land Institute's (ULi) Dimension of Parking, current edition; or ii. a similar structure functions efficiently using proposed modified layout, circulation and dimensions. RESPONSE: The requested adjustment does not have any effect on the parking garage, as the proposed car wash is outside of the garage. g. Reduction in length of stacking lanes shall be processed through a Type I procedure, as provided in Section 18.710.050. The approval authority shall approve or approve with conditions a reduction in the length of vehicle stacking lane required by 18.310.040.D.2 if such a reduction is deemed appropriate after analysis of the size and location of the development, limited services available and other pertinent factors. RESPONSE: The reduction in the required stacking lane length is from the requirements of Table 18.310.1, which requires 75 feet, and we are proposing 50 feet. As mentioned in our submittal for Development Review for the Jaguar/Land Rover Sales and Service facility(SDR2017-00005), the proposed car wash is not for the general public, but is being provided as a service for those vehicle owners who have their vehicles in for servicing. Only Jaguar/Land Rover staff will be taking vehicles through the car wash after the vehicle owner has dropped off the vehicle for servicing. Therefore, the number of vehicles that might be stacked in line for this service is controlled by the service department, and can be regulated so as not to have more vehicles in line than can be accommodated without having a negative effect on the parking in the vicinity of the car wash. And, the parking that is in the vicinity of the car wash, and thus, the stacking lane, are for employees of the Jaguar/Land Rover sales and service facility, and not the general public. The drive lane for which the vehicles brought to the car wash facility is behind the building containing the Jaguar/Land Rover sales and service uses, and not in an area where customers would be driving or parking. In addition, it is not likely that anyone looking for the bicycle parking area, which is inside WHPR-iffic the building, would be effected by the proposed adjustment to the stacking lane, as it is very unlikely that anyone arriving to purchase a vehicle from the facility will be arriving by bike, and of course no one arriving to have their vehicle serviced will be arriving by bike. The bicycle parking is most likely to be used by employees of the sales or service areas, and will be familiar with the car wash facility and should not be affected by the lack of stacking. In summary, the requested adjustment to the stacking lane for the proposed car wash, will not have any adverse effect on the general public nor those people arriving/leaving the Jaguar Sales and Service areas, as the car wash is in an area which will not be used by them. And, any adverse effect on the employees of the Sales and Service areas will be minimal, at worst, as the area where the car wash is located is in an area of low traffic, and when there is more traffic is when the shifts change, and is also when the car wash will be used the least. And, as previously mentioned, there is 50 feet of vehicle stacking proposed, which is enough for 2 vehicles, versus the 3 vehicles which would fit when 75 feet of stacking is provided, which will be plenty of space for the number of vehicles using this service. Schuyler, please let me know if you need any additional information in support of this adjustment, or if you disagree with any of my responses.
