You are currently operating a Bed and Breakfast in the Urban Services area, outside the Tigard City limits. In 1997, the City and Washington County agreed that the City of Tigard would have planning jurisdiction in the Urban Services area. This essentially means that all property in the Urban Services area must conform to the City of Tigard Standards. The City of Tigard does not allow Bed and Breakfasts in residential zones. You have provided information indicating you have been operating your business since 1995. While the County requires a Home Occupation permit to be obtained yearly for this use, it is clear that the Home Occupation standards are similar to the City of Tigard's Home Occupation standards, which are a one-time application and continue for the duration of the business. The City cannot issue a Home Occupation permit for you, however, because the use is not an allowed use in the zone. Because your existing use was allowed in the County with a Home Occupation permit (which you received) prior to the City taking jurisdiction in 1997, your use is considered pre-existing non-conforming. Because the City cannot issue a Home Occupation permit for a use that is not allowed, you are not required to obtain a permit. However, in order to continue to be considered non-conforming, you must continue to comply with the Home Occupation regulations 2 through 11 specified in your last Home Occupation permit obtained from the County in 1998. Currently, the City cannot charge a business tax for a business operating in an Urban Services area. However, if this policy changes in the future, you may be required to pay this annual fee.
