Ordinance No. 18-05 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL ORDINANCE NO. 18- AN ORDINANCE REPEALING CHAP 1ER 5.24 OF THE TIGARD MUNICIPAL CODE RELATING TO MEDICAL MARIJUANA FACILITIES WHEREAS, Tigard City Council adopted Ordinance 14-04, creating TMC Chapter 5.24, in February 2014, in response to recent state legislation allowing for the establishment and licensing of medical marijuana facilities; and WHEREAS, in response to the uncertainty about medical marijuana licensing requirements and the future of the industry, TMC Chapter 5.24 temporarily prohibited medical marijuana facilities licensed by the State of Oregon in order to allow City Council additional time to consider and adopt proper zoning or other regulations for medical marijuana facilities;and WHEREAS, Chapter 18.430 of the Tigard Development Code contains standards for the siting of marijuana facilities within the City,including medical marijuana;and WHEREAS, TMC Chapter 5.24 is no longer necessary and conflicts with the provisions in the Development Code. NOW,THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Chapter 5.24 of the Tigard Municipal Code is repealed in its entirety. SECTION 2: This ordinance shall be effective 30 days after its passage by the council, signature by the mayor,and posting by the city recorder.
