Activities will take place within a temporary 1,280-square-foot tent located in the on-site parking lot at Embassy Suites (9000 SW Washington Square Road). The MUC zone includes land around the Washington Square Mall and land immediately west of Highway 217. Primary uses permitted include office buildings, retail, and service uses. Also permitted are mixed-use developments and housing at densities of 50 units per acre. Larger buildings are encouraged in this area with parking under,behind or to the sides of buildings.In addition to the standards of this chapter,development within this zone is subject to the standards of Chapter 18.670. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request for a Temporary Use Permit. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FROM JANUARY 20,2018 TO JANUARY 25,2018 TUP2018-00001 PAGE 1 OF 3 SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 9000 SW Washington Square Road; southeast of SW Scholls Ferry Road, and southwest of SW Hall Boulevard. The 4.90-acre site is made up of one tax lot (WCTM 1S126BC, Tax Lot 1500), and is occupied by a commercial lodging use (Embassy Suites), with associated parking and landscaping. The property is located in the Mixed-Use Commercial (MUC) zone, and the Washington Square Regional Center Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.440 Temporary Uses: 18.440.030 Types of Temporary Uses A. Seasonal or special event. This type of temporary use is a use that by its nature will last less than 1 year.Examples of this type of use are those associated with the sale of goods for a specific holiday, activity or celebration, uses associated with construction or seasonal use. This type of use does not apply to businesses seeking a temporary or interim location. These types of temporary uses include: 3. Use associated with festivals or celebrations or special events; The proposed temporary use is associated with the sale of goods for a specific activity, and will last less than one year; therefore, this proposal meets the description of a special event. This Temporary Use Permit is being process through a Type I procedure. 18.440.050 Approval Criteria A. Seasonal and special events.The approval authority shall approve or approve with conditions seasonal and special events when all of the following are met: 1. The use occurs only once in a calendar year and for no longer a period than 30 consecutive days, except as provided in paragraph 6 of this subsection; The proposed temporary sales event will take place only once this calendar year.Additionally,the use will occur between January 20, 2018 and January 25, 2018, which is a period less than 30 consecutive days. This criterion is met. 2. The use is permitted in the applicable base zone; This proposal is for sales-oriented retail use,which is permitted by right in the MUC zone. This criterion is met. 3. The applicant has proof of the property owner's permission to place the use on the property; The application included the property owner's written authorization to place the proposed temporary use on the subject property.This criterion is met. 4. There will be no parking utilized by the customers and employees of the temporary use that is required to meet the minimum parking requirements for the other use(s) on the property, as required by Chapter 18.310, Off-Street Parking and Loading. TUP2018-00001 PAGE 2 OF 3 In 1991, the City of Tigard Planning Division approved a Site Development Review on the subject property for an expansion of Embassy Suites (Case Nos. SDR 90-0025 and VAR 90-0040). In this administrative decision, city staff approved a joint use parking agreement between Embassy Suites and the adjacent One Embassy Centre(9020 SW Washington Square Road;WCTM IS126BC,Tax Lot 1506). As outlined in'l'UC 18.310.030.C.1,"The size of the joint parking facility shall be at least as large as the number of vehicle parking spaces required by the largest use as provided in Section 18.310.070."Embassy Suites is the largest use,with a minimum off-street parking requirement of 358 spaces (1.0 space per guest room). In Case Nos. SDR 90-0025 and VAR 90-0040,staff determined there was adequate parking in the joint parking facility, with 620 spaces provided. For the proposed temporary sales event, the applicant will occupy 20 parking spaces with a 1,280-square-foot tent. This will reduce the total available parking to 600 spaces, or 242 spaces in excess of the minimum requirement for the largest use. This criterion is met. 5. The use will provide adequate vision clearance, as required by' Chapter 18.930, Vision Clearance Areas, and shall not obstruct pedestrian access on public rights-of-way. The applicant's site plan demonstrates that the proposed temporary use will take place within a 1,280- square-foot tent located in the on-site parking lot at Embassy Suites.Accordingly,the proposed tent will not be located in any public right-of-way,and will not impact vision clearance or pedestrian access.This criterion is met. SECTION VII. PROCEDURE AND APPEAL INFORMATION Notice: Notice was mailed to the applicant and property owner. Final Decision: The decision of the Director on Type I Procedure is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. An approval for the temporary use by the director shall lapse if: PLANNING/EIVGINEERING 1. Substantial construction of the approved plan or onset of the approved activity has not begun within the approval period; and 2. Construction or activity on the site is a departure from the approved plan. D. Renewal of approval. A temporary use approval may be renewed once by the director for a period not to exceed one year. Approval for a seasonal or special event use may be renewed on an annual basis in the same manner as if it were an original application. Notice of the decision shall be provided to the applicant. E. Renewal for temporary residential sales office/model homes. A permit for temporary sales offices and model homes may be renewed on an annual basis in the same manner as if it were an original application as long as 50% or less of the total number of dwelling units have been issued occupancy permits. Using a Type I procedure, as governed by Section 18.390.030, the Director shall approve, approve with conditions or deny based on findings that all of the following criteria are satisfied: 1. The use occurs only once in a calendar year and for no longer a period than 30 consecutive days, except as provided in paragraph 6 of this subsection; Y C S 2. The use will provide adequate vision clearance, as governed by Chapter 18.795, Vision ATM Clearance, and shall not obstruct pedestrian access on public rights-of-way. 6. Seasonal markets are permitted in the C-G and MU-CBD zones and may operate from April through October. The applicant shall provide"market rules and policies" for city approval, which are consistent with the seasonal market use description in 18.785.020.A.2 and will be observed for the duration of the permit. Market rules and policies shall include hours of operation, location, product guidelines, vendor obligations, vehicle loading/unloading, and any other applicable policies guiding the operation of the market. The city may also consider the following criteria: a. Provide documentation demonstrating adequate and safe ingress and egress exist when combined with the other uses of the property, consistent with applicable standards of Chapter 18.705, Access,Egress and Circulation; b.
