The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.790 UFR2017-00005 Specialty Retail—Urban Forestry Plan Modification 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 13125 SW Pacific Highway; on the north side of SW Pacific Highway, east of SW School Street, and west of SW Walnut Street. In February 2016, Tigard City Council approved a Comprehensive Plan Amendment and Zone Change (Ordinance No. 16-05) to modify the site's comprehensive plan designation and zoning district from Medium-Density Residential (R-12) to General Commercial (C-G). In May 2016, the City of Tigard Planning Division approved a Site Development review for the subject property (Case Nos. SDR2016-00004 and ADJ2016-00006). This approval was for a 15,085-square-foot specialty retail store, with associated parking and landscaping. The applicant proposes to modify the Urban Forestry Plan approved under Case Nos. SDR2016-00004 and ADJ2016-00006. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Chapter 18.790 Urban Forestry Plan: 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor (the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; A revised Urban Forestry Plan that was coordinated and approved by a certified arborist and tree risk assessor (the project arborist) has been submitted.This standard is met. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual; A revised tree preservation and removal site plan that meets the standards set forth in the Urban Forestry Manual has been submitted.This standard is met. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and A revised tree canopy site plan that meets the standards set forth in the Urban Forestry Manual has been submitted. In addition, the project arborist has included a signature of approval and statement attesting that the revised tree canopy site plan meets all of the requirements in Section 10, Part 2 of the Urban Forestry Manual. This standard is met. UFR2017-00005 Specialty Retail—Urban Forestry Plan Modification 2 4. Meet the supplemental report standards in the Urban Forestry Manual. A revised supplemental report was prepared and submitted by the project arborist, Morgan Holen & Associates, LLC. This report includes the required inventory data for existing open grown trees, as outlined in Section 10, Part 3, Subsection D of the Urban Forestry Manual. The site is zoned C-G; accordingly, the minimum required effective tree canopy for the entire site is 33 percent (Section 10, Part 3, Subsection N of the Urban Forestry Manual). Through the revised supplemental report, the project arborist demonstrates how the effective tree canopy for the entire site is 41.9 percent. This standard is met. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. The applicant proposes to modify the Urban Forestry Plan originally approved under Case Nos. SDR2016-00004 and ADJ2016-00006. The applicant is required to provide right-of-way dedication by ODOT, and is modifying the Urban Forestry Plan to accommodate this dedication. The revision also incorporates, "minor changes to the proposed planting plan as prescribed by the landscape architect to improve spacing, soil volume, and pedestrian and vehicle circulation." Additionally, the applicant proposes to plant new street trees in the SW School Street right-of-way (adjacent to the project site,and off site), in compliance with conditions from the original land use approval. These modifications will result in a decrease to tree canopy coverage from the original Urban Forestry Plan. Accordingly, this revised Urban Forestry Plan is being reviewed through a Type I procedure, using the approval criteria outlined below. D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist has provided a report and statement (dated October 25, 2017) certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modifications. In particular, the previous approval for a new specialty retail store at the subject site included a requirement for ODOT right-of-way dedication. Accordingly, the applicant proposes to modify the Urban Forestry Plan in order to accommodate this dedication.Additionally, the applicant proposes to plant new street trees in the SW School Street right-of-way (adjacent to the project site, and off site), in compliance with conditions from the original land use approval. Accordingly, the proposed Urban Forestry Plan has been modified to meet these requirements, and to "improve species selection, spacing between trees, and pedestrian and vehicle circulation, and to increase soil volume,including the use of covered soils so the planted trees have better growing space." Based on details in the project arborist's report, staff finds this criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist states, "There is no practicable alternative to the proposed modifications...The proposed plan improves the previously approved plan in terms of species selection, spacing, and UFR2017-00005 Specialty Retail—Urban Forestry Plan Modification 3 available soil volume for growing space. These changes provide the most practicable Urban Forestry Plan for the project and satisfy the City's requirements."This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. (Ord. 12-09 §1) The project arborist submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with Section 18.790.030,including tree preservation,protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Site Development Review for Specialty Retail (Case Nos. SDR2016-00004 and ADJ2016-00006) meets all applicable approval criteria,and can be approved. SECTION V. In reviewing the previously approved Urban Forestry Plan drawings,the landscape architect prescribed changes to the proposed planting plan to improve species selection,spacing between trees, and pedestrian and vehicle circulation, and to increase soil volume, including the use of covered soils so the planted trees have better growing space. The previously approved urban forestry plan did not account for these changes, which were made at the landscape architect's discretion in order to improve the overall plan.The City's canopy cover requirements continue to be satisfied and no payment in lieu of planting is proposed. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and There is no practicable alternative to the proposed modifications.There are alternative planting plans that could be used, but the proposed plan improves the previously approved plan in terms of species selection,spacing, and available soil volume for growing space.These changes provide the most practicable Urban Forestry Plan for the project and satisfy the City's requirements. 3. The subject property is located at 13125 SW Pacific Highway.This report describes the existing trees located on and directly adjacent to the project site, provides arborist recommendations for tree removal, retention and protection, and describes the effective tree canopy cover needed to meet City requirements. This report is based on observations made by International Society of Arboriculture (ISA) Certified Arborist and Qualified Tree Risk Assessor Morgan Nolen (PN-6145A) during a site visit conducted on March 31, 2015. This report was revised on October 25, 2017 based on site plan modifications resulting from ODOT required right of way dedication along Pacific Highway, minor changes to the proposed planting plan as prescribed by the landscape architect to improve spacing, soil volume, and pedestrian and vehicle circulation, and to include removal and replacement of off-site trees within the School Street right of way as required by the City's condition of approval items 1-3. ISA Board Certified Master Arborist (PN- 6145B) and Qualified Tree Risk Assessor Morgan Holen revisited the site on June 21, 2016 in order to collect inventory data for the six existing trees in the off-site School Street right of way west of the project site. More recently,we coordinated with DOWL to develop the revised Tree Preservation and Removal and Tree Canopy Site Plan drawings. Modifications are identified in bold underlined type.These changes are not exempt from a Type I land use decision to modify the Urban Forestry Plan component of an approved land use permit because the modifications result in the slightly less future tree canopy through tree planting as the previously approved urban forestry plan did, although the minimum canopy cover requirement continues to be exceeded.The relevant criteria are discussed herein.The applicant will be required to pay a $711 review fee to the City. General Description The existing site is a vacant and undeveloped lot along the northwest side of SW Pacific Highway just north of SW School Street. In all, 14 trees were inventoried, including four on-site trees and 10 trees located off-site within 25-feet of the development impact area and within the School Street right of way west of the project site where sidewalk improvements are required. The four on-site trees include one non-native and invasive sweet cherry (Prunus avium), a multi- stemmed Port-Orford-cedar(Chamaecyparis lawsoniana), an unknown deciduous tree with advanced decay, and a purple-leaf plum (Prunus cerasifera) that has been heavily pruned over the years for power line clearance. Removal of these four on-site trees is recommended for the purposes of site development. The 10 off-site trees include three small ashes (Fraxinus spp.) measuring smaller than the City's six inch diameter threshold for regulated trees and one red oak (Quercus rubra) measuring approximately six inches,which are located within 25-feet of the project site, and six tuliptrees (Liriodendron tulipifera) measuring seven to 10 inches in diameter, which are located in the off-site School Street right of way west of the project site.The red oak and tuliptrees are planned for removal for the proposed sidewalk extension and improvements. Urban Forest Plan—Supplemental Report 13125 SW Pacific Highway,Tigard,Oregon April 5,2015 I Revised:October 25, 2017 Page 2 The three small ashes along the northern boundary of the project site can be protected during site development. However,the City's conditions of approval items 4 and 5, regarding verification of the installation of tree protection measures and twice monthly site inspections and monitoring reports are not applicable since the three trees planned for preservation are below the City's six inch diameter threshold for regulated trees. Nevertheless,the contractor should provide for their protection because they are located off-site.The crowns of these trees do not overhang the project site. An existing six foot chain link fence to be removed and replaced with a new fence at the end of the construction period shall serve as tree protection fencing throughout construction. The contractor may coordinate with the project arborist prior to removing and replacing the fence adjacent to the neighboring trees for on-the-ground monitoring and documentation. Otherwise, no tree protection specifications are provided. A complete description of individual trees located on and adjacent to the project site is included in the enclosed existing tree inventory data (attachment A). Effective Tree Canopy Cover Attachment B,the planted tree inventory, describes 34 trees proposed for planting, including 20 street trees and 14 trees located in and around the proposed parking lot. The proposed spacing between trees provides the closest and best spacing possible. The required quantity of street trees is determined by dividing the total right-of-way length by 40. The lineal street frontage abutting the project site along Pacific Highway is 285 feet; seven street trees are required and eight are proposed.The lineal street frontage abutting the project site along School Street is 195 feet; five street trees are required and five are proposed.The lineal street frontage along School Street on the adjacent site west of the project where sidewalk improvements are proposed is 280 feet; seven street trees are required and seven are proposed.The width of the right-of-way is 16 feet along Pacific Highway, requiring a minimum of 700 cubic feet of soil volume, which is provided for each of the eight street trees.The width of the right-of-way is 10.5 feet along School Street, requiring a minimum of 500 cubic feet of soil volume,which is provided for each of the 12 street trees. Note that 30 cubic feet of covered soil is proposed at street tree 137 near the corner of Pacific Highway and School Street to improve the available growing space. The 14 parking lot trees will provide a total combined mature tree canopy area covering 30.2% of the parking lot area, which satisfies the minimum requirement of 30%. In addition, parking lot trees are required to have 1,000 cubic feet of soil volume each. At least 1,000 cubic feet of open soil volume is available for 11 parking lot trees; covered soil is proposed at parking lot trees 126, 127, and 128 to satisfy this requirement and improve the available growing space. The proposed 14 parking lot trees and 13 street trees abutting the project site provide 22,260 square feet of effective tree canopy cover.The overall development site is 53,078 square feet.Therefore,the overall development site has 41.9%effective tree canopy.The minimum required effective tree canopy for the overall development site is 33%; therefore, the effective tree canopy cover requirement for the overall development site is met. A summary of the effective tree canopy cover across the overall development site is included as attachment B. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual, which illustrate how the Urban Forestry Plan requirements are met. Sheet L100, included in attachment E, provides the landscape planting plan for the off-site School Street right of way. Soil Characteristics and Specifications for Improvement Native soils at the project site consist of Woodburn silt loam, which is deep, moderately well- drained, and capable of supporting healthy tree growth. No soil improvements are proposed. B. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual. They shall be planted in accordance with the American National Standards Institute (ANSI) standards for tree planting (A300, Part 6) and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock (ANSI Z60.1) for Grade No.1 or better. Double stake trees if needed for stability. Criteria for Urban Forestry Plan Modifications Tigard Municipal Code Section 18.790.070 requires that any modification to the urban forestry plan component of an approved land use permit shall be processed as a Type I land use decision.There are exemptions to the Type I procedure,which are not applicable in this case.Therefore,the approval criteria in subsection D of this section are applicable: 1. In reviewing the previously approved Urban Forestry Plan drawings,the landscape architect prescribed changes to the proposed planting plan to improve species selection, spacing between trees, and pedestrian and vehicle circulation, and to increase soil volume, including the use of covered soils so the planted trees have better growing space. The previously approved urban forestry plan did not account for these changes, which were made at the landscape architect's discretion in order to improve the overall plan.The City's canopy cover requirements continue to be satisfied and no payment in lieu of planting is proposed. 2. In this case, 34 trees are proposed for planting.A tree establishment bond in the amount of$15,810 is required.
