CITIZEN COMMUNICATION (Two Minutes or Less, Please) A. Follow-up to Previous Citizen Communication City Manager Wine said that while there was no follow-up to citizen communications, she was contacted by Darbie Mayberry with Tigard Cleaners located on Main Street regarding the parking discussion that was originally scheduled to be heard at tonight's council meeting, but had been rescheduled to a date uncertain. Ms. Mayberry provided Ms. Wine with a letter for council. Ms. Wine submitted her letter for the record, and told council it would be forwarded to staff. B. Citizen Communication—There was none. 3. CONSENT AGENDA: -There was none. 4. INFORMATIONAL PUBLIC HEARING: NON-RESIDENTIAL TRANSPORTATION SYSTEM DEVELOPMENT NON-RESIDENTIAL TRANSPORTATION SYSTEM DEVELOPMENT CHARGES TIGARD CITY COUNCIL MEETING MINUTES — October 3, 2017 City of Tigard 1 13125 SW Hall Blvd.,Tigard, OR 97223 www.tigard-or.gov I Page 1 of 5 Mayor Cook opened the public hearing and announced that anyone may provide testimony. Finance and Information Services Director LaFrance presented this item. Mr. LaFrance reminded council they had adopted the current Transportation SDC Methodology (TSDC) and fee for residential TSDC and provided background. He explained that approving this resolution would amend the current master fees and charges and create a non-residential Transportation System Development Charge. Mr. LaFrance said developers pay the fee when they apply for their building permits and the purpose for the fee is to help the city pay for the additional impact to the city's transportation system due to the increase in capacity to existing buildings as well as new development. Mr. LaFrance explained staff had done extensive outreach to the non- residential development community and they have analyzed multiple types of non-residential developments and how the fee would be assessed. He said back in April 2015, council adopted the methodology that shows the maximum the city could assess and the residential and non- residential allowed discounts. He said because of the outreach staff had done,they received a letter from the Tigard-Tualatin School District stating that while they prefer not to pay,what is before council tonight is something they can live with. Mayor Cook asked how many outreach meetings staff has had with the non-residential development community and what kind of attendance they had from that group at those meetings. Mr. LaFrance said they had two meetings with this group, they were well attended and there were robust conversations. He said it is because of those meetings that staff is recommending the fee and discount they are, as well as phasing in the implementation of the fee. Mayor Cook asked if anyone from the audience would like to provide testimony. There was no one. Mayor Cook closed the public hearing. Council President Snider stated they have had this conversation several times and what he is hearing back from staff is that while the non-residential development community does not love it, they can live with it. He said this is a good compromise and he can support it as proposed. Councilor Woodard agreed and his biggest concern is making sure the city has enough dollars going into the bucket to cover costs. Mayor Cook agreed and said the city has gone two years without getting anything and that it ends up being a five-year process rather than just the three years of phasing in. Councilor Goodhouse agreed. Councilor Anderson moved for adoption of Resolution No. 17-42 and Councilor Goodhouse seconded the motion. Motion passed by a unanimous vote. TOWN CENTER DEVELOPMENT AGENCY RESOLUTION IN SUPPORT OF HOUSING PROJECT Redevelopment Project Manager Farrelly gave the staff report and provided background. Mr. Farrelly explained that approving the resolution would direct the Executive Director of the Town Center Development Agency to write a letter of financial support for the Community Partners for Affordable Housing's Tigard Triangle project. He said the Community Partners for Affordable Housing (CPAH) is a non-profit affordable housing developer and service provider who provides services in Tigard and other surrounding cities. They are currently putting together financing for an affordable housing project that will be located in the Tigard Triangle Urban Renewal District. Mr. Farrelly said this project would help fill the gap in the shortage of affordable housing units in Tigard. Mayor Cook asked for a motion to recess the council meeting so they could call the Town Center Development Agency meeting to order. Council President Snider moved to recess the City Council meeting and convene the Town Center Development Agency meeting to order and Councilor Goodhouse seconded the motion. Motion passed by a unanimous vote. EXECUTIVE SESSION—At 6:55 p.m. City Council went into executive session to review and evaluate, pursuant to standards, criteria, and policy directives adopted by the governing body, the employment-related performance of the chief executive officer, a public officer, employee or staff member, under ORS 192.660(2)(1). City Council may return to town hall to consider additional non- agenda items. At 7:58 p.m. City Council returned to town hall to resume the business meeting. Council President Snider moved to appoint Shelby Rihala as Tigard's city attorney and authorize the city manager to enter into an employment agreement subject to ratification by the City Council, pursuant to Tigard Municipal Code 2.60 and Councilor Woodard seconded.
