APPLICATION SUMMARY FILE NAME: Columbia Gunsmithing, LLC CASE NO.: Minor Modification (MMD) MMD2016-00025 PROPOSAL: The applicant is proposing a change of use to a tenant space in an existing industrial building at 15995 SW 74th Avenue. The space,approximately 314 square feet in size, is changing from an office to a sales-oriented retail use, Columbia Gunsmithing,LLC. The I-P zoning district provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor, vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped,and pedestrian-friendly. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360.060.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2016-00025 Columbia Gunsmithiug,LLC 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED: 1. Prior to occupancy, the applicant shall contact the staff planner,Lina Smith at (503) 718-2438 or LinaCS@tigard-or.gov for final walk-through. All on-site parking areas shall be clearly striped as required by the standards outlined in IDC 18.765.040. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 15995 SW 74th Avenue; north of SW Durham Road and west of SW 74th Avenue. The subject property is a 314-square-foot tenant space located inside an approximately 16,000- square-foot industrial building. The building is located on a 6.52-acre tax lot that includes two additional industrial buildings and associated landscaping. The property is also partially located in the FEMA 100-Year Floodplain,and contains a significant wetland with an associated Clean Water Services Vegetated Corridor. The site is zoned Industrial Park (I-P), as are surrounding properties to the north, south, and east;adjacent properties to the west are zoned Medium-Density Residential (R-12). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a Minor Modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: Because the applicant has only proposed a change of use, which primarily affects off- street parking regulations, that is the main focus of the review. The change of use is from an office to sales-oriented retail. The 6.52-acre property is a mixed-use, multi-tenant site, and is therefore subject to the required minimum vehicle parking formula outlined in 'IDC 18.765.030.D. The applicant submitted an aerial photograph that shows 86 parking MMll2016-00025 Columbia Gunsmithing,I.I.0 2 spaces on site. Staff conducted a site visit to the subject property, but was unable to confirm the final parking count, as on-site parking spaces were not clearly marked. Accordingly, this decision includes a condition of approval that requires all on-site parking areas to be clearly striped per the standards outlined in TDC 18.765.040,prior to occupancy. Upon review of the applicant's narrative and plans, staff finds that, as conditioned, all applicable requirements of this Title are met. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do not apply. Therefore, the proposed development is not a major modification.This criterion is met. CONCLUSION: The proposal is a Minor Modification of existing site development and is in compliance with the applicable requirements of this Title. SECTION V. Completion of landscape installation. Landscaping shall be installed prior to issuance of occupancy permits, unless security equal to the cost of the landscaping as determined by the director is filed with the city recorder assuring such installation within six months after occupancy: 1. Security may consist of a faithful performance bond payable to the city, cash, certified check or such other assurance of completion approved by the city attorney; and 2. If the installation of the landscaping is not completed within the six-month period, the security may be used by the city to complete the installation. D. Business tax filing. The applicant shall ensure that all occupants of the completed project, whether permanent or temporary, shall apply for and receive a City of Tigard business tax prior to initiating business. 18.360.050 Major Modification(s) to Approved Plans or Existing Development A. Determination request. An applicant may request approval of a modification to an approved plan or existing development by: 1. Providing the director with three copies of the proposed modified site development plan; and 2. A narrative which indicates the rationale for the proposed modification addressing the changes listed in subsection B of this section. B. Evaluation criteria. The director shall determine that a major modification(s) will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density, or lot coverage for residential development; 2. A change in the ratio or number of different types of dwelling units; NA 3. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; 61(44/66.54 5/1.4a-64- rilA,v to% 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of paragraphs 1 through 10 of this subsection. Al C. When the determination is made. Upon determining that the proposed modification to the site development plan is a major modification,the applicant shall submit a new application in accordance with Sections 18.360.030 and 18.360.070 for site development review prior to any issuance of building permits. 18.360.060 Minor Modification(s)to Approved Plans or Existing Development A. Minor modification defined. Any modification which is not within the description of a major modification as provided in Section 18.360.050 shall be considered a minor modification. B. Process. An applicant may request approval of a minor modification in accordance with 18.360.030.B and as follows: 1. Providing the director with three copies of the proposed modified site development plan; and 2. A narrative which indicates the rationale for the proposed modification addressing the changes listed in 18.360.050.B. C. Approval criteria. A minor modification shall be approved, approved with conditions or denied following the director's review based on the fmding that: 1. The proposed development is in compliance with all applicable requirements of this title; and 2. The modification is not a major modification. 18.360.070 Submission Requirements A. General submission requirements. The applicant shall submit an application containing all of the general information required for a Type II procedure, as governed by Section 18.390.040. B. Additional information. In addition to the submission requirements required in Chapter 18.390, Decision-Making Procedures, an application for the conceptual development plan must include the L.)* following additional information in graphic, tabular and/or narrative form.
