Clean Water Services ~ IG187001 ~ Amendment To The East Tigard Sewer Replacement (D-120) Project No. 6820 AMENDMENT TO INTERGOVERNMENTAL AGREEMENT
BETWEEN
CLEAN WATER SERVICES AND CITY OF TIGARD
This Amendment, dated effective August 1, 2017 is between Clean Water Services (District) and
the City of Tigard (City), and amends the parties' Intergovernmental Agreement dated June 29,
2016 (IGA).
RECITALS
1. City and District entered into the IGA for the East Tigard Sewer Replacement (D-120)
Project No. 6820 (Project) to provide sufficient hydraulic capacity in the sewer system.
2. During Project engineering, groundwater contamination requiring special excavation and
disposal was found on the industrial site through which the sewer crosses were
discovered.
3. Project Costs increased to handle the groundwater contamination, along with escalated
construction prices resulting from an exceptionally busy bid climate resulted in even the
low bid significantly exceeding the construction estimate.
4. City requested District pay an additional $370,000 as its portion of the increased Project
Costs, and City agreed to commit an additional $80,000 as its portion of the increased
Project costs.
5. The parties now wish to amend the IGA to increase District's Not-to-Exceed Amount.
TERMS AND CONDITIONS
1. Not-to-Exceed Amount
The total Not-to-Exceed Amount in Exhibit B of the IGA is increased from $1,634,632 to
$2,004,632.
2. Effect of Amendment
Except as amended herein,the IGA shall remain in full force and effect.
