APPLICATION SUMMARY FILE NAME: FAHLMAN WOODWORKING FILE NO.: Home Occupation Permit (HOP)Type II HOP2017-00028 PROPOSAL: This application is for a Type II Home Occupation at 9055 SW Oak Street. The applicant proposes to teach woodworking and construction classes, with a maximum of six (6) daily customers. The home occupation will utilize 392 square feet of an existing residence. No external changes are proposed as part of this application. APPLICANT: David M. Fahlman 9055 SW Oak Street Tigard,OR 97223 OWNER: Same as applicant LOCATION: 9055 SW Oak Street;WCTM 1 S135AB,Tax Lot 3403 ZONING DESIGNATION: MUE-1: Mixed Use Employment District. The MUE-1 and 2 zoning district is designed to apply to areas where employment uses such as office, research and development and light manufacturing are concentrated. Commercial and retail support uses are allowed but are limited, and residential uses are permitted which are compatible with employment character of the area. Lincoln Center is an example of an area designated MUE-1, the high density mixed use employment district. The Nimbus area is an example of an area designated MUE-2 requiring more moderate densities. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.742 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section V. BACKGROUND INFORMATION & PROJECT DESCRIPTION Site Information: The 0.29-acre site is located on the north side of SW Oak Street, east of SW Greenburg Road and west of SW Hall Boulevard. The property is currently occupied by a 1,596-square-foot detached, single- family dwelling, with an existing driveway. The site is located in the Mixed Use Employment District (MUE-1) and the Washington Square Regional Center Plan District. Proposal Description: This application is for a Type II Home Occupation at 9055 SW Oak Street. The applicant proposes to teach woodworking and construction classes, with a maximum of six (6) daily customers. The home occupation will utilize 392 square feet of an existing residence. No external changes are proposed as part of this application. SECTION IV. PUBLIC COMMENTS The Tigard Community Development Code requires that property owners within 500 feet of the subject site be notified of the proposal, and be given an opportunity for written comments and/or oral testimony prior to a decision being made. Staff mailed Notices of a Type II Proposal regarding this Home Occupation to affected parties on August 23,2017. The City of Tigard Planning Division received letters from Dr. Gene Davis and the Foreign Mission Foundation on September 5, 2017, which stated that the proposed Type II Home Occupation was inconsistent with the Washington Square Regional Center Plan (adopted by the City of Tigard in September 1999). RESPONSE: The subject property is occupied by a pre-existing detached, single-family dwelling. As outlined in Chapter 18.630 Washington Square Regional Center Plan District of the Tigard Community Development Code, pre-existing housing units in mixed use districts are permitted. Conversion of pre-existing housing units to other uses is subject to the requirements in 'l'DC 18.630. Additionally, all additions, expansions, or enlargements of existing uses or structures that exceed 20 percent of the gross floor area lawfully in existence at the time of the Plan District's adoption are subject to the requirements in MC 18.630. The applicant is not proposing a change of use; the subject property will continue to be a residential use, and the proposed Type II Home Occupation will be subordinate to the residential use of the property. In addition, the applicant is not proposing any additions, expansions, or enlargements of the existing use or on-site structures. Furthermore, the Washington Square Regional Center Plan does not include any restrictions on Home Occupations in pre-existing housing units. As detailed in Section V of this administrative decision, the proposed Type II Home Occupation complies with all statutory and ordinance requirements and regulations. SECTION V. APPLICABLE REVIEW CRITERIA& FINDINGS As set forth in Table 18.510.1 of the Tigard Community Development Code, home occupations are an allowed land use in all residential zones, subject to the approval standards and criteria contained in Chapter 18.742 Home Occupations. Relevant standards and approval criteria are addressed below. 18.742 Home Occupations 18.742.040 General Approval Criteria I10P2017-00028 FAI-ILN1AN WOODWORKING PAGE 2 Or 7 All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. A. Home occupations may be undertaken only by the principal occupant(s) of a residential property. The applicant is the property owner and principal occupant of the residential property in which the home occupation is proposed to take place. This criterion is met. B. There shall be no more than three deliveries per week to the residence by suppliers. The applicant's narrative indicates that there will no more than three (3) deliveries per week to the residence by suppliers. This criterion is met. C. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725, Environmental Performance Standards. This home occupation application is to teach woodworking and construction classes out of an existing residence. It is anticipated that none of the items listed above will be compromised beyond allowable levels as a result of this project. All activities will be conducted indoors between the hours of 8 a.m. and 10 p.m.This criterion is met. D. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. This home occupation will be operated entirely within the primary residence (an existing detached, single-family dwelling). In addition, staff reviewed the applicant's narrative and submitted floor plan to determine 392 square feet of floor area (or approximately 25% of the existing 1,596-square-foot residence) will be utilized for the home occupation. Accordingly, this proposal does not exceed the floor area maximums stated above (528 square feet, or 25% of the combined residence and accessory structure gross floor area). This criterion is met. E. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit. Any accessory building that is used must meet State Building Code requirements. No changes are proposed to the dwelling unit, and the home occupation is not proposed within an accessory building. This criterion is met. F. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. In December 2014, the City of Tigard Planning Division issued a Type I Home Occupation Permit (Case No. HOP2014-00053) for an office associated with a residential contractor business at the subject property. The applicant is now applying for a separate Type II Home Occupation Permit to also teach woodworking and construction classes out of the existing residence. The applicant's narrative states that the combined floor space for both business activities will not exceed'528 square feet, or 25% of the combined residence and accessory structure gross floor area. Additionally, the applicant will maintain separate Business Tax Certificates for each business. Staff conducted a search of city records, and did not identify additional home occupations for the subject site. This criterion is met. G. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. This home occupation will not have any storage and/or distribution of toxic or flammable materials that pose a dangerous risk to the residence,its occupants, and/or surrounding properties. Furthermore, Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal to review, and had no objections. This criterion is met. H. No home occupation shall require any on or off-street parking other than that normally required for a residence. This home occupation will not require any on or off-street parking, other than that normally required for a residence. In addition, the subject property includes an existing driveway that can provide off-street parking for the applicant and any customers. This criterion is met. I. The following uses are not allowed as home occupations: a.Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c.Junk and salvage operations; d. Storage and/or sale of fireworks The applicant's proposal for a home occupation does not involve any of the activities listed above. This criterion is met. J. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. The applicant's narrative states that only one (1) commercially licensed vehicle of not more than three- quarters ton gross vehicle weight will be parked outside the existing residence. In addition, the subject property includes an existing driveway that can accommodate any personal vehicles utilized by the applicant. This criterion is met. I I0P2017-00028 }'AHI,MAN WOODWORKING PAGE 4 OF 7 18.742.050 Type I and Type II Home Occupations Defined A. Home occupations shall be administered as either Type I or Type II uses. A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040, home occupations shall observe the following additional standards: 1. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises. Therefore the following is allowed for Type II home occupations: a. One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; The applicant proposes to have one (1) non-illuminated sign that is 1.5 square feet in size, and it will be placed in a window of the existing residence. This standard is met. b. No more than one outside volunteer or employee who is not a principal resident of the premises; At this time, the applicant is the sole participant in the proposed Type II Home Occupation. However,in the future, the applicant will be restricted to no more than one (1) outside volunteer or employee related to this home occupation.This standard is met. c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; The applicant states the business will not generate more than six (6) daily customers, between the hours of 8 a.m. and 10 p.m. In addition, the subject property includes an existing driveway that can provide off-street parking for the applicant and any customers. This standard is met. d. Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant's narrative states that any outdoor storage of materials, goods, or equipment will be screened entirely from view by a solid fence. Additionally, the storage will not exceed five percent of the total lot area,and will be located at the rear of the property. This standard is met. 18.742.060 Permit Procedures for Type I and Type II Home Occupations B. Type II home occupation permit. A Type II home occupation permit will be processed by means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and As detailed in the findings above, this application is in conformance with the standards contained in this chapter. Will be subordinate to the residential use of the property; and The business will be subordinate to the residential use of the property. This home occupation will occupy 392 square feet of floor area, or approximately 25% of the existing 1,596-square-foot residence. This criterion is met. 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. The proposed business will be entirely contained within the existing detached, single-family dwelling, and will not be detrimental or disruptive in terms of appearance or operation to neighboring properties and residents. This criterion is met. FINDING: The proposed Type II Home Occupation complies with all statutory and ordinance requirements and regulations, as demonstrated by the analysis contained within this administrative decision. SECTION VI. OTHER STAFF COMMENTS The City of Tigard Building Division, Engineering Division, and Police Department were sent copies of the applicant's proposal,and had no objections. SECTION VII. AGENCY COMMENTS Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal,and had no objections. SECTION VIII. David Fahlman purchased this property on November 13, 2015 and bought it to use in a non-conforming manner according to the Washington Square Regional Center Plan, approved by the City of Tigard in 1999, which "summarizes the results of a thorough public discussion about the future of the Washington Square study area." The tallest building in Washington County is the Lincoln Tower and all of the nearby zoning is MUE-1, requiring a minimum of 2-stories for development according to table 18.520.2. I own 9025 SW Oak to the north and east 3200, 0.66 acres. Together with lots owned by the Foreign Mission Foundation, for which I am President,these lots surrounds the east 3 side of the property. Additionally, 9020 SW Oak St, across from 9055 SW Oak, belongs to me. I plan to build at least 2 levels of parking under a 5 story stick frame on the same side of the street as 9055 SW Oak,which may not be feasible next to a one-story home occupation Type-II business. Any development across the street would additionally be diminished by a single-standing home business. This usage is simply out of place at Lincoln Center and David Fahlman was aware of this when he purchased the property and refurbished the house. In addition, if the application is approved, it will not allow for the 60-foot street planning dedication if the lot remains undeveloped. David Fahlman would have to be required to give up an additional 10-feet and widen/pave the road if he plans to retain the house for a personal business, as all other developers and owners in the vicinity would be required to do. Please reject this application or the entire area development will be negatively impacted, and not developed to its full potential as was planned nearly 2 decades ago under extensive research throughout the community. The task forth for the Washington Square Regional Center Plan spent intensive amounts of time in the year-plus-planning-process, and only came to such decisions based upon "extensive review of technical data, public input from open houses and surveys, and discussion by task force members and others in attendance at task force meetings."
