STAFF RECOMMENDATION / ACTION REQUEST Staff recommends adoption of the resolution amending the Master Fees and Charges to establish the non-residential transportation system development charge. KEY FACTS AND INFORMATION SUMMARY In April 2015, Council Adopted the current Transportation SDC Methodology (TSDC) and the fee for a residential TSDC. The methodology included a recommended 70% discount for residential TSDC (which was adopted) and a nearly 90% discount on non-residential TSDC. At the time, Council did not pass the Non-Residential TSDC based on the impact it could have on commercial development in general and schools in particular plus the lack of outreach to the commercial development community when compared to the residential development community. Since that time, staff has met with the Non-Residential development community to hear their concerns and incorporate them into the proposed TSDCs. In December 2016, Council had a workshop on the Non-Residential TSDC where feedback from the non-residential community and recommended changes to the implementation of the fee were discussed. The presentation included three example developments. Council requested more example developments. Staff has completed more example development as presented in Exhibit B. In doing so, and comparing the results to the county Transportation Development Tax (TDT), staff found wide variation in fee amounts. This is caused by differing discounts by commercial development type in the TDT. Examples include: o Elementary School TSDC at 153% of TDT o Coffee kiosk TSDC at 164% of TDT o Variety/General Retail store TSDC at 82% of TDT o Recreation Center TSDC at 94% of TSDC Most of the examples have a TSDC that are below 80% of the TDT. Based on this analysis, the proposed Master Fees and Charges sets the TSDC to the amount in the methodology, but not to exceed 80% of the TDT. Other recommendations that carry over from the December 2016 workshop and are proposed in the Master Fees and Charges include: o The Transportation SDC be implemented at the amount recommended by the methodology study. The amount recommended discounts the charge by about 90 percent. o Implementation of the non-residential Transportation SDC start in 12 months from adoption. o The charge be phased in over the 12 to 36 month time frame. OTHER ALTERNATIVES Council can vote to oppose the resolution and not adopt non-residential TSDC's. While the District would rather there not be a TSDC that has a significant financial impact on future school construction and takes away from our classrooms and students, we see the current recommendation as an improvement from earlier proposals. The fact that the non-residential TSDC will not exceed 80% of the Transportation Development Tax (TDT) charged as set by Washington County is important to the District and we support that proposal. Without this limitation,our estimated TSDC for a new elementary school would exceed the TDT by 153% while the TSDC for many other non-residential properties will be significantly less than 80% of the TDT. Again,we appreciate the City's work to send forward a proposal that has a much lesser impact on future school construction and opportunities for our students. STAFF RECOMMENDATION / ACTION REQUEST Staff recommends approval of the resolution. KEY FACTS AND INFORMATION SUMMARY Community Partners for Affordable Housing (CPAH), a non-profit affordable housing developer and service provider serving Tigard, Beaverton, and S.W. Portland is putting together financing for a site at 11090 SW 68th Parkway in the Tigard Triangle Urban Renewal District. The project will help address the shortage of affordable units in Tigard. The $14 million Red Rock Commons project would provide 48 units serving a mix of tenants, including people making 0-60% of median family income. CPAH is currently assembling funding from many different sources, including Federal HOME funds, state Local Innovation and Fast Track (LIFT) Housing Program funds, Low Income Housing Tax Credits, Metro and Washington County. In planning for its sources of funds and development costs, CPAH has projected a gap in financing and has requested funding under the Tigard Triangle Urban Renewal Plan Re/Development Assistance project. Financial assistance of affordable housing is consistent with the goals and objectives of the Plan. A letter from the TCDA Executive Director that expresses TCDA financial support,will help the project secure other financing. The final amount of Re/Development Assistance is contingent on Community Partners for Affordable Housing securing other financing and review of their updated financial need. The Board of Tigard Town Center Development Agency would take action committing to a specific amount at a future Board meeting. OTHER ALTERNATIVES The Board of the CCDA could decide to revise or not to adopt the proposed resolution. COUNCIL OR CCDA GOALS, POLICIES, MASTER PLANS Tigard Triangle Urban Renewal Plan Goal 5 Provide financial and technical assistance to new and existing businesses and housing developments that contribute to the Area's diversity and vitality, and help it transform into a mixed-use and pedestrian-oriented district. Objectives: 5.3. Support the development of mixed-use buildings that provide a variety of housing types and storefront spaces for a range of community and commercial needs. 5.4. Assist in the development of affordable and workforce housing. Attachments TCDA Resolution CITY OF TIGARD, OREGON TOWN CENTER DEVELOPMENT AGENCY RESOLUTION NO. 17- A RESOLUTION EXPRESSING FINANCIAL SUPPORT FOR THE COMMUNITY PARTNERS FOR AFFORDABLE HOUSING PROJECT IN THE TIGARD TRIANGLE AND DIRECTING THE EXECUTIVE DIRECTOR OF THE TOWN CENTER DEVELOPMENT AGENCY TO WRITE A LETTER OF SUPPORT WHEREAS, Goal 5 of the Tigard Triangle Urban Renewal Plan is to: "Provide financial and technical assistance to new and existing businesses and housing developments that contribute to the Area's diversity and vitality and heo it transform into a mixed-use and pedestrian-oriented district;" and WHEREAS, Objective 5.3 of the Tigard Triangle Urban Renewal Plan states "Support the development of mixed-use buildings thatprovide a variety of housing types and storefront spaces for a range of community and commercial needs,"and objective 5.4 states `Assist in the development of affordable and workforce housing," and WHEREAS,Community Partners for Affordable Housing, a non-profit housing developer,plans to build an affordable housing project on a site at 11090 SW 68th Parkway; and WHEREAS, Community Partners for Affordable Housing has a financial gap in their project and has requested funding under the Re/Development Assistance project in the Tigard Triangle Urban Renewal Plan; and WHEREAS,a letter expressing financial support,will help the project secure other financing; and WHEREAS, the final amount of Re/Development Assistance is contingent on Community Partners for Affordable Housing securing other financing and review of their updated financial need, and later Board of Tigard Town Center Development Agency action. NOW,THEREFORE,BE IT RESOLVED,by the Tigard Town Center Development Agency that: SECTION 1: The Executive Director of the Tigard Town Center Development is authorized to sign a letter of support for a TCDA contribution in Re/Development Assistance to Community Partners for Affordable Housing's Tigard Triangle project. SECTION 2: The amount of Re/Development Assistance will be formally approved at a future TCDA Board meeting and is contingent on Community Partners for Affordable Housing securing other financing TCDA Resolution No. 17- Page 1 and review of their updated financial need. SECTION 3: This resolution is effective immediately upon passage. PASSED: This day of , 2017.
