It is the intent of the memorandum to address conditions of approval relevant to the installation of the boardwalk and installation of the oak savanna overlook as this is one phase of a multi-year project. As such,we have noted in the responses where the condition will be met prior to future phased development. Responses will be provided for each phase of park development meeting the conditions for CUP2013-0001 prior to release of applicable permits. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF A SITE PERMIT: To be reviewed and approved by the Development Services Division, Planning Department (Gary Pagenstecher, 503-718-2434) 1. Prior to site work, the project arborist shall perform a site inspection for tree protection measures, document compliance/non-compliance with the urban forestry plan and send written verification with a signature of approval directly to the city manager or designee within one week of the site inspection. C of A 1: The project arborist is Morgan Holen & Associates LLC. Morgan will inspect the tree protection measures installed, document compliance, and send written verification to the project planner prior to commencement of site work. This condition will be met. 2. Prior to site work, the applicant, if it is the City, shall show that the funds have been budgeted to plant the trees shown in the approved urban forestry plan. The applicant shall plant the trees and show that the maintenance funding is budgeted before final inspection. The budgeted funds will cover the city's average cost to plant and maintain a tree per the applicable standards in the Urban Forestry Manual for a period of two years after planting multiplied by the total number of trees to be planted and maintained. M1 C of A 2: No trees are proposed to be removed as part of the Dirksen Nature Park Boardwalk and Overlook improvement project. This condition is not applicable to this phase of development. 3. The applicant will enter the inventory data into the urban forestry plan or shall provide a fee to cover the city's cost of collecting and processing the inventory data for the entire urban forestry plan for the park development before final inspection. C of A 3: No trees are proposed to be planted as part of the Boardwalk and Overlook improvements. The forested wetland will be replanted with emergent vegetation and native shrubs by a restoration contractor after the boardwalk improvements are completed. Inventory data will be entered into the urban forestry plan in the future when street trees are installed as part of the Tigard Street improvement project. 4. The project arborist shall perform twice monthly site inspections for tree protection measures during periods of active site development and construction, document compliance/non-compliance with the urban forestry plan and send written verification with a signature of approval directly to the project planner within one week of the site inspection. C of A 4: Morgan Holen & Associates LLC will perform site inspections twice a month, or with greater frequency as needed. This condition will be met. 5. The applicant shall provide revised electrical plans that eliminates all lights along the Fanno Creek trail. C of A 5: Park plans were revised to eliminate lighting along the Fanno Creek trail from Tigard Street to Tiedeman Avenue. This condition has been met. 6. The applicant shall provide revised site plans that eliminate the proposed boardwalk/overlook structures within the significant wetlands on the site. C of A 6: The applicant applied for a Comprehensive Plan Amendment(CPA)to remove environmental protection over a small footprint of the resource to allow for the boardwalks to be installed as part of the project. See CPA2015-00002 for CPA approval. This condition is no longer applicable to the project. 7. Prior to issuance of a site permit, a Public Facility Improvement(PFI)permit is required for this project to cover sidewalk improvements,utility connections, and any other work in the public right-of-way. Five(5) sets of detailed public improvement plans shall be submitted for review to the Engineering Department.NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. PFI permit plans shall conform to City of Tigard Public Improvement Design Standards, which are available at City Hall and the City's web page (www.tigard-or.gov). If the work is performed by city crews or under contract with the city, a PFI permit is not necessary. All work shall conform with all applicable codes, standards and conditions of this case. C of A 7: The Dirksen Nature Park improvements will be phased over several years. Improvements within the public right-of-way will occur in a future phase of park development. Roadway and utility improvement plans encroaching into the Tigard Street right-of-way will be submitted prior to issuance of a site permit and PFI to complete that phase of the project. This condition will be met with that phase of park development. 8. The PFI permit plan submittal shall include the exact legal name, address and telephone number of the individual or corporate entity who will be designated as the "Permittee", and who will provide the financial assurance for the public improvements. For example, specify if the entity is a corporation,limited partnership, LLC, etc. Also specify the state within which the entity is incorporated and provide the name of the corporate contact person. Failure to provide accurate information to the Engineering Department will delay processing of project documents. If the work is performed by city crews or under contract with the city, a PFI permit is not necessary. All work shall conform with all applicable codes, standards and conditions of this case. C of A 8: The Dirksen Nature Park improvements will be phased over several years. This phase of the project includes installation of a timber boardwalk and construction of the oak savanna overlook. The forested wetland will be restored under separate contract by a restoration contractor. A PFI permit will not be required for this phase of work as the improvements will be located in the park and not in the public right-of-way. 9. The applicant shall submit construction plans to the Engineering Department which indicate that they will construct a half-street improvement along the frontage of SW Tigard Street. The improvements adjacent to this site shall include: A. City standard pavement section for a Neighborhood Route from curb to centerline of at least 16 feet B. pavement tapers to tie the new improvement back into the existing edge of pavement shall be built beyond the site frontage as necessary; C. concrete curb,or curb and gutter as needed; D. storm drainage, including any off-site storm drainage necessary to convey surface and/or subsurface runoff; E. At least a 5-foot concrete sidewalk plus at least a 5-foot planter strip with landscaping and street trees; a 10-foot separated trail is acceptable; F. street trees in the planter strip spaced per TDC requirements; G. street striping; H. streetlight layout by applicant's engineer,to be approved by City Engineer; I. underground utilities; J. street signs(if applicable); K. driveway apron(if applicable); and L. adjustments in vertical and/or horizontal alignment if necessary to construct SW Tigard St in a safe manner, as approved by the Engineering Department. C of A 9(A-L): The Dirksen Nature Park improvements will be phased over several years. The applicant will submit construction plans for the Tigard Street half-street improvements meeting the conditions outlined above in the future. 10. The applicant shall provide a construction vehicle access and parking plan for approval by the City Engineer. The purpose of this plan is for parking and traffic control during the public improvement construction phase. C of A 10: The Dirksen Nature Park improvements will phased over several years. This proposal is to perform work in the park just south of Tigard Street on Tax Lot 900 and Tax Lot 1000. A parking area is designated on Sheet D2 for work associated with the Oak Savanna Overlook. A material,equipment drop off,and staging area for the boardwalk is shown on Sheet Dl. 11. The applicant shall provide approval from TVF&R for access and hydrant placement. C of A 11: The Dirksen Nature Park improvements will be phased over several years. The Tigard Street half-street improvements will be constructed in future years. Plans will be submitted to TVF&R for access and hydrant placement. TVF&R comments will be submitted to the Engineering Department. This condition will be met prior to issuance of applicable permits for this phase of park development. 12. Prior to issuance of permits,the applicant shall pay the addressing fee as applicable. (STAFF CONTACT: Paul Izatt,Public Works). C of A 12: The park improvements will not require addressing. This condition is not applicable. 13. The applicant shall provide information and/or calculations as necessary to demonstrate the adequacy of the existing and proposed sanitary sewer system to serve the proposed development, including consideration of additional development within the area as projected by the Comprehensive Plan. C of A 13: This phase of the Dirksen Nature Park improvements consist of building a concrete overlook within the oak savanna and installation of a timber boardwalk. This condition is not applicable with this phase of park development. 14. The applicant shall provide on-site water quality facilities as required by Clean Water Services Design and Construction Standards(adopted by Resolution and Order No. 00-7).The preliminary stormwater report provides preliminary information on these facilities. Final plans and calculations shall be submitted to the Engineering Department (Mike McCarthy) for review and approval prior to issuance of the site permit. In addition, a proposed maintenance plan shall be submitted along with the plans and calculations for review and approval. C of A 14: This phase of the Dirksen Nature Park improvements will not provide an on-site LIDA water quality facility. The impervious area being created is 366 square feet for the concrete overlook. The boardwalk decking consists of open steel grating. Future phases of development will continue to provide water quality treatment. This condition will be met for impervious areas installed in excess of 1,000 square feet. 15. An erosion control plan shall be provided. The plan shall conform to the "Erosion Prevention and Sediment Control Design and Planning Manual, February 2003 edition (and any subsequent versions or updates)." C of A 15: Erosion Control Plans were submitted with the building permit site works application. A 1200-C permit has been issued for the entirety of the project and recently amended for this phase of the project. The 1200-C plans are under separate cover. This condition is met. 16. The applicant shall obtain a 1200-C-N General Permit issued by the City of Tigard pursuant to ORS 468.740 and the Federal Clean Water Act if necessary. C of A 16: The 1200-C has been issued by DEQ/CWS. This condition has been met. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO A FINAL INSPECTION OF THE STREET OR STRUCTURES. Prior to a final building inspection,the applicant shall call for a final planning inspection to ensure the project was completed per the approved plan. C of A 17: The Dirksen Nature Park improvements will be phased over several years. Upon completion of the boardwalk and overlook improvements, a planning inspection will be requested to ensure the project is completed per the approved plan. This condition will be met. 18. Prior to final building inspection, the project arborist shall perform a site inspection, document compliance/non-compliance with the urban forestry plan and send written verification with a signature of approval to the city manager or designee. C of A 18: The Dirksen Nature Park improvements will be phased over several years. Upon completion of the boardwalk and overlook improvements,the project arborist will provide written verification to the staff planner. This condition will be met. 19. Following final building inspection the tree establishment period shall immediately begin and continue for a period of two years. C of A 19: Street trees planted as part of the Tigard St Half-street improvements as will be maintained by the City of Tigard Parks Department in perpetuity. This condition will be met. The applicant shall confirm the existence of and/or dedicate additional ROW as necessary to provide at least 27 feet from centerline along SW Tigard St. C of A 20: Right-of-way will be dedicated on Tigard Street to provide a minimum of 27 feet from centerline heading south. This condition will be met when the Tigard Street improvements are constructed. 21. The applicant shall pay the applicable fee-in-lieu of stormwater detention prior to final building inspection. C of A 21: The project is adjacent to Fanno Creek and detention is not required. The Fee-in-lieu is paid per phase as required. This condition will be met per phase. 22. All elements of the proposed infrastructure (such as transportation, sanitary sewer, storm drainage, water, etc.) systems shall be in place and operational with accepted maintenance plans and certified by an engineer with expertise in that area prior to a final inspection of the street or structures. C of A 22: All elements of the proposed infrastructure will have a one-year contractor warranty and then will be under the operation and maintenance of the City of Tigard Public Works Department. This condition will be met. 23. The applicant's engineer shall submit a final access report to City engineering staff which verifies design of driveways and streets are safe by meeting adequate stacking needs, sight distance, width, clear area, design, and deceleration standards as set by the City and AASHTO. The applicant shall obtain approval of this report prior to final inspection of the proposed street and structures. C of A 23: The Dirksen Nature Park improvements will be phased over several years. The Tigard Street half-street improvements will be constructed in future years. The proposed boardwalk and overlook improvements will not affect access from the site to Tigard Street. This condition is not applicable to this phase of project. 24. All utilities along the frontage of Tigard St shall be relocated underground. C of A 24: The existing overhead utility lines have been designed to be underground. The condition will be met when the half street improvements are constructed. 25. All new utilities serving the subject property shall be constructed underground. C of A 25: The new utilities (power, water, storm, and sewer) have been designed to be constructed underground. The condition will be met when the half street improvements are constructed. 26. There are existing sewer and other easements running across the subject property. The applicant's site plan shows access will be maintained to these easements and no structures may be placed in these easements. Prior to final inspection of the street and structures, the applicant's engineer shall certify that these requirements are met. C of A 26: This condition of approval will be met.
