As far as water quality facilities or homes being built in an access easement (regardless of ownership)they are a city permitting issue that does not involve the County Surveyors Office. However, it is a legal issue that the beneficiary has controlling rights over and if homes are built could have significant loan impacts and title issues. (There are no buildable lots affected.) Its our understanding that we can show the easement on the plat and record it OR get the easement relinquished. (The developer is working on the relinquishment as I write this.) Dale intends to record the plat with the easement shown based on the options you have provided. He will continue to attempt to obtain relinquishment after the plat records.The alteration we are making to the plat for the benefit of the City and address their concerns is to change the ownership of the tract from the City to the HOA so that it is not a City issue should in the highly unlikely event there be an attempt to utilize the access easement by the beneficiary. Please confirm in short that we can record the plat with the easement shown and thank you very much for your time on this! Dale, my understanding is that there is some question as to whether the easement is limited to the first 80 feet along the southern border of the parcel or whether it extends the entire length. If the former, we could issue your permit without further ado. If the latter,then your site plan would have approximately 5 feet of the proposed house in the easement, and that would require us to keep the application on hold until the easement is relinquished. We hope to resolve the question of the length of the easement tomorrow morning and I'll have more information for you then.
