The purpose of the meeting is to review the Amended Director's
Decision - Site Development Review SDR 92-0021 - Ruble/PDG - Taco
Bell.
The Amended Director's Decision, issued on February 26, 1993 ,
supersedes the Decision issued on February 12, 1993 which was
appealed by the NPO.
The NPO will be reviewing their position on the amended decision
and decide if they want to:
• keep their appeal the same as submitted
• amend their appeal based on the amended decision
• withdraw their appeal

Dear Herman:
In response to Martha Bishop's inquiries regarding the status of
the NPO's appeal of the original decision for the above-referenced
case, I have checked on the process with legal counsel and
consulted with planning staff.
The Amended Director's Decision, issued on February 26, 1993 ,
supersedes the decision issued on February 12 , 1993.
The NPO, in order to review their position on the amended decision,
will need to call a special meeting. The NPO should advise if they
want to:
• keep their appeal the same as submitted
• amend their appeal based on the amended decision
• withdraw their appeal
Notification of the NPO's position on the amended decision with
regard to the appeal must be received by me no later than
3 : 30 p.m. , March 10, 1993 . There will be no need (per legal
counsel's advice) for the NPO to again request a fee waiver from
City Council.
I understand the Planning Commission public hearing has been
scheduled for March 22, 1993 , pending the NPO's decision to pursue
all or part of their issues of appeal.

I offer my assistance to the NPO with posting of the Notice of
Special Meeting and to supply copies of the amended decision to the
NPO members. Martha Bishop indicated she would deliver the
information to the NPO members.

You were out when I phoned and asked for a copy of the City of Tigard's
code enforcement. What requirements do you have for an impact—traffic study
when applicants apply for professional, business dist., P.D., general
commercial or community commercial designations? How do you determine thru
the city code processing what the applicant's impact will be on the adjacent
neighboring neighborhoods long established for families and individuals?
What is your solution to directives turning traffic onto local collectors,
minor, or major from interstate, state or local hwy. for access and ingress?
I need to learn of this code to access whether or not it is addressing local
city problems. Staff reported our code"is more strient than any other city"?

I've written to several/and expect responses back before our appeal is heard.
I appreciate the time and expense you will give to this directive. Hopefully
we will receive this info. soon enough for evaluation before the appeal that is now
in process. Being a member of NPO 3 in Tigard feel your input will be essential
being we all border one another incl. Wa. Co. that holds much territory within
our city jurisdictions. Thank you,

SUBJECT: Appeal of Staff Decision SDR 92-0021; Ruble/PDG (Taco
Time)
Dick, attached is the appeal received from NPO 3 (signed by Herman
Porter) reference the above-captioned Planning Staff Decision. I
understand that a representative from NPO 3 will appear at the
February 23 , 1993 Council meeting to request a fee waiver for the
appeal.
Please advise the applicant of the appeal. If the Council approves
the fee waiver request, the NPO and applicant should be advised as
to the date the appeal hearing will be scheduled before the
Planning Commission. If the Council denies the fee waiver, the NPO
must submit the fee by 3 p.m. on the third working day after the
Council meeting.
