12/20/1988 - Minutes UTILITIES AND FRANCHISE ~"Mmut MINUTES 1 . Called to Order at 7:00 p.m. 'WA-04-01V PRESENT: McReynolds, Barrett, Walsh, -1*4o", Wayne, Luiohner' Miller' Schmidt 2 . Minutes accepted. 3 . Coy Humphrey - unauthorized persons removing garbage - wants to know what City of Tigard should do about problem. Phil Grillo - interpretation of franchise - exclusive franchise - persons picking up reoyolabluo and anyone allowing it may be in violation of ordinance - wants to see what we can do. Questions - are waste haulers picking up fast enough? Humphrey - wants to know what will be enforced and notify everyone involved. Wiitala - PaoTruot began development 1972 - 1974. Police contacted and told them that nothing could be trucked after it leaves the building. Problem - outoide people coming and going through containers and throwing things they do not want on ground and taking what they want - i .e. , cardboard, Leiohner, - picks up about everyday - offered bins for recycling but someone else has control over cardboard, McReynolds - stated laws beyond city law - i .e. , state requirement for recycling - board and law' s position that haulers should recycle everything - losing revenue from private individual recycling efforts - can not prevent companies contracting to sell . Wiitala - businesses throw away good stuff - position has been that stuff was businesses'- position of management company was that police position would be hard to sell . Whose stuff is it? McReynolds - catch 22 situation Grillo - if pallet outside but not in garbage can, should be property of business until disposed of in garbage - opinion that if materials in garbage - one issue, not in garbage - another issue, Miller, - once it is garbage - nothing to prevent tenant deciding on trash and mooring materials in and out. Grillo - once it is trash - use criminal and can not be criminal if permission granted - what if tenant has agreement with someone else - both in violation of exclusive franchise. McReynolds — thre%waouueo: 1 . If materials in garbage area — can be hauled only by haulers. 2. Materials not in area and if picked up without written permission of tenant — theft. 8 . Reoyolableo — some material automatic reoyclableo i .e. , pallets, air tanks — should be franchised. Cardboard — price up. Private reoyclero — new ordinance to deal with private reoyolero — charge a fee. McReynolds — gave above three points to Humphrey as guidance for enforcement — directed Wiitala to come up with guidelines for garbage disposal. Haulers objected to second point — can not give permission because do not "own" garbage. Miller — attempting to provide service — have rules to live by — attempting to avoid issues caused by other people going through garbage. Grillo — would like to see resolved without enforcement — could support Gerry' o three points — Coy could enforce. Gerry — can not resolve who owns reoyolableo, etc, — can not be addressed right now — responsibility rests with legislators . Wiitala — get communication going. Grillo — ordinance is not clear on what is waste — what is intent of person putting out. Miller — suggested Wiitala and Mike and tenants get together and educate tenants — Mike and Wiitala agreed. Gerry — thanked for input. 4. Yard debris has been identified as recyoable material — developments Cities have been asked to develop a plan to recycle by February 15. Two other options : 1 . Co with Metro' s recycling plan. 2. Washington County looking at a recycling plan — Tualatin basin wide — with USA — Steve Lawrence Have to decide: 1 . Is City going to do plan? 2. Who is City will do plan? 3 . Du we want someone else to do plan — i .e. , Metro? Gerry — fools that we should go with larger group — i .e. , Washington and see what happens . Walsh appoint to attend organizational meeting for Washington County with Tum. Will wait until Metro and/or Washington County come up with plans — will participate in Washington and Mike Walsh and 'Tom will represent on committees , 6.
