Please keep in mind, the 180-day deadline for both your land use applications is September 20, 2016. If we do not receive documentation of your producer & processor licenses from OLCC by that date, then your applications will be voided, and you'll have to re-apply. Unfortunately, since this is a State-mandated deadline, there's no way for city staff to give an extension or "stop the clock." This 180-day rule is outlined in Oregon Revised Statutes Chapter 227.178, which states an applicant has up to 180 days from the date a land use application was submitted to provide missing information that was identified by the governing body (for reference, this information was identified in the letters I sent on April 27 and August 18). We have applied for the recreational producer license and as of this moment the status is "new". We figured it would be a two stage process; first to get the producer license, but we wanted to get the full blueprint from the architect so we can work on building stage one first. Once this is complete we can move forward with stage 2. We are getting the necessary paperwork and working on applying for the processing license but have not submitted it yet. Status is in "new" and the license number we have received is 1002757E94B. I have attached a screen print of the details on the status from my online OLCC account. From our understanding we have validated with the City of Tigard that the purpose of its use is allowed in the underlying zone and complies with all applicable requirements of this title. We have ensured that the propose of this development meets all of the following site location restrictions. These restrictions include being outside the MU-CBD zone as well as being outside 1,000 feet of a public or private elementary school, a secondary school,or career school that this being attended by minors. Although we are not a retailer or wholesaler we understand that all sale-oriented retail and wholesale sales uses to the public are subject to being located on a lots or parcel with frontage along Pacific Highway (Oregon Route 99W),being located outside 2,000 feet of another state-licensed retail or wholesale marijuana facility or outside of city limits,and outside 500 feet of a public library or Tigard parks and recreation zone. It is also understood that for non-retail uses and wholesale sales uses not open to the public are to be located outside 500 feet of residential zones,parks and recreation zones,and public libraries. Our hours of commercial operation will be limited to the hours between 10:00am and 8:00pm. We understand that general industrial uses with no on-site activity are exempt from this restriction.
