This modification request is to remove one 66-inch Giant Sequoia, which was originally planned for preservation. Removal is now needed due to the amount of damage that would occur as the result of installing a new storm line for the new building construction. The I-P zoning district provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odors, vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped, and pedestrian-friendly. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.790 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. UI'R2017-00001 Interstate Rooting Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site and Vicinity Information The applicant previously received approval for a Site Development Review (SDR2016-00003) for a 17,000 square foot combined warehouse and office building located at 15065 SW 74th Avenue. The 3.59 acre site is comprised of two legal lots. The existing office building will be demolished while the existing warehouse will remain on site. The site is zoned Industrial Park (I-P). Properties to the north and south are also zoned I-P, directly to the east are railroad tracks and the properties to the east are zoned Light Industrial (I-L). Across Fanno Creek and to the west is zoned Residential (R-7). The area along 74th consists primarily of industrial warehouses and offices. Site History: It appears the interstate roofing operation started sometime in the mid-1980s. Staff conducted a search of City records for the subject property and did not find a record of the original site development review. There have been various building, mechanical plumbing, sewer permits for minor construction. There is also a history of previous pre-applications in 2003, 2008, and previous site development review and sensitive lands review in 1999 that expired which proposed expansion of the existing roofing business. Proposal Description The applicant proposes to modify the Urban Forestry Plan approved under the Interstate Roofing Site Development Review (SDR2016-00003). This modification request is to remove one 66 inch Giant Sequoia (#19) located in the southwestern portion of the site directly west of the shed that is proposed to be removed.The removal is requested due to the amount of damage that would occur to the roots as a result of installing a storm line ten feet from the trunk to serve the new building. The applicant has stated that moving the storm line is not feasible. These activities are not exempt from the Type I modification review outlined in the Tigard Community Development Code section 18.790.090 (Modification to the Urban Forestry Plan Component of an Approved Land Use Permit). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.790 Urban Forestry Plan: 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor(the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; A revised Urban Forestry Plan that was coordinated and approved by certified arborist/tree risk assessor, Rob Crouch (the project arborist) has been submitted. This standard is met. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual (UFM); A revised tree preservation and removal site plan that meets the standards set forth in the Urban Forestry Manual has been submitted.This standard is met. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and A revised tree canopy site plan that meets the standards set forth in the Urban Forestry Manual has been submitted. In addition, the project landscape architect has included a signature of approval and statement attesting that the revised tree canopy site plan meets all of the requirements in Section 10, Part 2 of the Urban Forestry Manual.This standard is met. 4. Meet the supplemental report standards in the Urban Forestry Manual. UFR2017-00001 Interstate Roofing Urban Forestry Plan Modification 2 The site is zoned I-P; accordingly, the minimum required effective tree canopy for the entire site is 33 percent (Section 10,Part 3, Subsection M of the Urban Forestry Manual).The revised supplemental report (date stamped April 20,2017) showed a site effective canopy of 46%. This standard is met. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. The proposed modification to the Urban Forestry Plan Component of the approved Interstate Roofing Site Development Review (SDR2016-00003) does not meet the exemptions listed under subsection B; therefore, this modification shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist provided a report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. The original plan assumed that adequate protection would be possible for the tree. However, after the site was staked the arborist notified the applicant that the storm line would be in conflict with the protection of tree #19. He then recommended the line be moved or consider boring under the tree roots. The project engineers determined that due to the amount of root damage the tree would not be stable during trenching. It was determined to not be feasible for the applicant to move the line or trench; therefore they are requesting the tree be removed. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist states that the previous plans did not account for the necessary amount of disturbance within close proximity to the tree and there is no practicable alternative to the proposed modification. Removal is necessary for construction based on site inspection of proposed construction. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The project arborist submitted revised effective tree canopy cover data and tree removal plan to demonstrate compliance with Section 18.790.030. This criterion is met. FINDING: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Interstate Roofing (SDR2016-00003) meets all applicable approval criteria, and can be approved. FROM: Rob Crouch, ISA Certified Arborist and Tree Risk Assessment Qualified RE: Modification to Urban Forestry Supplemental Report for Interstate Roofing-- New Building Construction Summary I do not recommend the retention of tree #19, a 66 inch Giant Sequoia, due to the amount of damage that would occur as the result of installing a storm line for the new building construction. I recommend the modification of the Urban Forestry Supplemental Report for Interstate Roofing New Building Construction. Removing this one tree will not prevent the project from complying with Section 18.790.030 of the City of Tigard City Code. Background Joyce Jackson, RLA, prepared the Urban Forestry Supplemental Report for Interstate Roofing New Building Construction on January 25, 2016. I started working as the consulting arborist in December 2016. My first assignment was to tag the trees and stake the location for the Tree Protection Fencing. On December 19, 2016, I sent an email saying the storm line is in conflict with Tree # 19 and the line should be moved or consider boring under the tree roots. I have been informed that the storm line cannot be moved. Discussion This section of the report includes my recommendations as well as a determination of compliance with City of Tigard Code Section 18.790.070. D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. Recommendation The Tree Removal and Protection Plan has the storm line located approximately 10 feet from the trunk of Tree #19, a 66 inch DBH Giant Sequoia. I have requested that the storm line be moved or installed by boring under the roots. The engineers on the project say it is not feasible. Due to the amount of root damage to the tree, it will not be stable during the trenching. This is why I am asking to modify the plans and have the tree removed before the storm line is installed. Having Tree#19 removed will not prevent the project from complying with Section 18.790.030.
